The Obama administration is poised to entertain a flood of new clemency applications from thousands of federal prisoners who were given harsh sentences under mandatory-minimum laws following drug convictions, Attorney General Eric Holder said Monday. Holder said in a short videotaped statement that he wants to shrink the federal prison population by a modest amount while ensuring ´that those who have paid their debts have a chance to become productive citizens.´ At the center of the move is a set of old sentencing rules that punished crack-cocaine offenders with more time behind bars than users or traffickers of powder cocaine.

In 90%+ of the ´minor´ drug cases, they took plea deals when they were in fact guilty of more serious crimes. Contrary to the leftist myth, nobody serves hard time for simple possession.

Well Holder has gone on the record as saying he would take care of "his people" so this is not a big surprise. And I suppose a lot of the people who are going to get out of prison look a lot like Obama´s would be son.

Well kudo´s to Holder/Obama if they do. Will be one of the few right things they did in their reign of incompetence.

The fact that 90% of these offenders copped a plea deal is a bug not a feature of the justice system. Read "Ham Sandwich Nation" by Instapundit Glen Reynold.

Keeping these non-violent offenders in jail serves no useful purpose and is a financial burden on taxpayers.

This useless war on drugs has been lost. Get over it. Move on.

While my libertarian sympathies incline me to agree with #4, at the same time, I can´t help but think this is a ploy to increase the pool potential Dem voters. Either via "pen and phone" or through voter fraud, attempts will most likely be made to allow releasees to vote.

The "War on Drugs" gave plenty of notice to the drug users. You may have libertarian sympathies, but there was plenty of slack, plenty of notice and plenty of easy judges who finally started enforcing the law. You may think these are innocents, so maybe you can have a discussion about Hayek or Von Mises when they´re ransacking your abode or sticking you up.

Well what are they going to do? There are no jobs outside of the energy business. My guess is that they will go back to doing what they did before. Recidivism rate will be high for this group hopefully the crimes they will commit won´t be too violent. But one thing is guaranteed the msm will not identify them as having been granted clemency by obama and holder. The Democrat Party at work destroying America.

I dunno, sometimes you guys amaze me. I cannot understand why anyone thinks someone should do hard time for non-violent crime.

There is nothing inherently wrong with using or selling drugs. There was no ´drug problem´ in this country until the beginning of the last century when a prohibition was put into place for heroin and cocaine. All the talk about users committing crimes to support their habit has to do with the resulting increase in price of the now blackmarket drugs. Heroin used to be sold over the counter for the same price as aspirin.

In the 1500s, coffee was illegal for non-royals in much of Europe. Why? Just because. In the 1900s many drugs were made illegal in the U.S. Why? Just because.

Now you´re fussing because Congress has moved to change some of the more Draconian sentencing...?

The idea that non-violent drug offenders are doing hard time is a liberal/libertarian myth.Mandatory sentences are given to those who deal in large quantities of hard drugs along with violence, usually involving guns.
For over 30 years I was a Fed prosecutor and if you believe that the illegal drug trade is anything but a life destroying, violent world that leaves nothing but misery in its wake, you are given to self deception. This insane plan will make cities a more dangerous place.

Agree with #20. Non-violent offenders go to State Prisons, but hard core, large quantity dealers and users go to Federal. Do I agree that we have lost the "war on drugs"? Yes I do. Should we turn the thieves dealing the drugs to our kids back out on the streets? NO!! As a defense attorney my drug dealing clients´ clients are the ones that steal cars, rob residences, break into businesses and help themselves to whatever someone else has to support their habit. Drugs destroy families and lives. They don´t just impact the person taking or using them.

I´ve read a number of the stories of people who would be eligible for clemency. In many cases their conviction, at first, seems like they were minor players. But more often than not they had a long rap sheet that including violent and criminal behavior.

Many here see this as getting potential voters on the Dem. rolls. But I wonder if there isn´t an even scarier motive for this action...bolstering his "civilian army" in case those "dangerous" domestic terrorists decide to fight back. I do not feel safe or comfortable in my country anymore and am looking over my shoulder in most areas of my life, including posting on this site. I hate that! The War on Drugs is just as flawed as the Eighteenth Amendment. It is asking for trouble for government to be intervening into conduct that is largely private. We are not in North Korea where everything can be the government´s business.
Ronald Reagan should have listened to Milton Friedman, not William Bennett.
btw the Constitution gives the President unconditional power to pardon persons of Federal offenses.

There´s another very dark possibility: if you are being pressured (or promised a reward) for releasing certain drug felons, you can cover your sleazy connections by releasing a whole class of drug felons instead of just the ones you want to release.
