Bundy´s Rebellion
New York Sun, by Editorial

Original Article

Posted By:MDMuskrat, 4/20/2014 10:52:35 AM

The thing that needs to be said in respect of the rebellion that has gathered at the ranch of Cliven Bundy is that it is as American as apple pie. At the rate things are going the Nevada ranchers are going to write themselves into American history right alongside Daniel Shays and the Pennsylvania backwoodsmen who confronted the federal government over taxes on whiskey. The echoes are uncanny — complete with the sanctimonious lectures from the federal government over the law and the righteousness of the anger of the rebels.

Mr. Buddy is a true American hero. He embodies the courage and conviction that first made this Country great.
My fellow "wolverines" and I have been honored to provide him with the support he needed to make the Feds back down.
Mr. Bundy is exactly the leader we need right now to counter the oppressive and overreaching regime that controls this country.
There is currently a petition circulating to run Mr. Bundy as senator from Nevada. I urge all Nevada citizens to sign this petition, and everyone should contribute to his campaign.
The foundation of democracy lies in the hands of its citizens; our system requires action from its citizens to ensure our rights are preserved.

Mr. Bundy is not a hero. He is a scofflaw and a leach on the public dime. Read the court documents. He works without a lawyer and claims various things at various times, not a single one of them having legal basis. The public lands which included the later state of Nevada were ceded to the US Government in the Treaty of Guadalupe Hidalgo in 1848. That predates Mr. Bundy´s claims to the land. He paid leasing fees for several years and then stopped. Yes, I know the feds changed the requirements of how the land could be used, but although Mr. Bundy now claims he is not a citizen of the United States, the BLM had the absolute right and authority to regulate the public lands. Mr. Bundy has yet to cite a precedent in his court pleadings that holds up in his case. He works without a lawyer, on a pro se basis. You know what they say about men who act as their own lawyer.

There are many government abuses that we should rise up in protest against. Mr. Bundy´s case is not one of them. If anyone ends up getting injured or killed, the blame is the rancher´s for inciting this ridiculous mob activity on his behalf.

What people who despise the Bundys of this world fail to realize is that, at the base of this, is outrageous government misconduct and overreach. That the laws are being made as vague as possible so that politicians can manipulate them to their own ends.

Is Bundy a perfect hero? Nope. Nobody is. But what Cliven Bundy offers us is the opportunity to shine a light on the abuse of citizens through the federal government´s regulatory process. Creating ruinous fees for the sole purpose of running people out of business and off their lands so corrupt "public servants" can further line their pockets is one of those things Americans used to be disgusted by.

Instead, some Americans are more disgusted by those who fight back. Sad days indeed.

I personally think that the reason the pro-establishment types are so determined to discredit Bundy and those who are standing with him is because they fear what might be exposed now that people are looking into the issue and paying attention.

There are now questions being asked about purchases of land in the area by BLM in which they paid far more than market value. After BLM secures the land the neighboring owners of lands abutting the BLM extend their land boundaries into the recently purchased BLM land.

Alaska’s resolution states:

Be it resolved that the Alaska State Legislature hereby claims sovereignty for the state under the Tenth Amendment to the Constitution of the United States over all powers not otherwise enumerated and granted to the federal government by the Constitution of the United States.

Be it further resolved that this resolution serves as Notice and Demand to the federal government to cease and desist, effective immediately, mandates that are beyond the scope of these constitutionally delegated powers.

While seven states – Tennessee, Idaho, North Dakota, South Dakota, Oklahoma, Alaska and Louisiana – have had both houses of their legislatures pass similar decrees, Alaska Gov. Palin and Tennessee Gov. Phil Bredesen are currently the only governors to have signed their states’ sovereignty resolutions.

The Court today propounds a view of federalism that pays only lipservice to the role of the States. Although it says that the States "unquestionably do `retai[n] a significant measure of sovereign authority,´" it fails to recognize the broad, yet specific areas of sovereignty that the Framers intended the States to retain. Indeed, the Court barely acknowledges that the Tenth Amendment exists. That Amendment states explicitly that "[t]he powers not delegated to the United States . . . are reserved to the States." The Court recasts this language to say that the States retain their sovereign powers "only to the extent that the Constitution has not divested them of their original powers and transferred those powers to the Federal Government." This rephrasing is not a distinction without a difference; rather, it reflects the Court´s unprecedented view that Congress is free under the Commerce Clause to assume a State´s traditional sovereign power, and to do so without judicial review of its action. Indeed, the Court´s view of federalism appears to relegate the States to precisely the trivial role that opponents of the Constitution feared they would occupy....
That would be Justice Powell, dissenting in Garcia vs San Antonio.

but for the usual suspects, who reflexivly side with the big government and all its parasitical benefits: Justice Blackmun in Garcia: We doubt that courts ultimately can identify principled constitutional limitations on the scope of Congress´ Commerce Clause powers over the States merely by relying on a priori definitions of state sovereignty. In part, this is because of the elusiveness of objective criteria for "fundamental" elements of state sovereignty, a problem we have witnessed in the search for "traditional governmental functions." There is, however, a more fundamental reason: the sovereignty of the States is limited by the Constitution itself. A variety of sovereign powers, for example, are withdrawn from the States by Article I, 10. Section 8 of the same Article works an equally sharp contraction of state sovereignty by authorizing Congress to exercise a wide range of legislative powers and (in conjunction with the Supremacy Clause of Article VI) to displace contrary state legislation. By providing for final review of questions of federal law in this Court, Article III curtails the sovereign power of the States´ judiciaries to make authoritative determinations of law. Finally, the developed application, through the Fourteenth Amendment, of the greater part of the Bill of Rights to the States limits the sovereign authority that States otherwise would possess to legislate with respect to their citizens and to conduct their own affairs.

As his policies, foreign and domestic, are collapsing on pretty much every front, President Obama has increasingly sought refuge in talk about global warming. He wants the U.S. to reduce its emissions of carbon dioxide, and the EPA has done its best to bring this about via increasingly stringent regulations on coal-fired power plants. The Democrats wanted to enact cap-and-trade, but couldn’t get it through Congress, so Obama is doing the best he can through administrative action. Simultaneously, the administration has poured billions of dollars into specious “green” energy projects, many of which can’t be kept alive even with lavish

Every major strand of American conservatism includes a strong libertarian streak, because the value of liberty is fundamental to just about all conservative thought. But today, especially, is said to be the libertarians’ moment. What once was a fringe movement, politically speaking, has moved front and center in our political life. And yet, in my view, libertarians of both the capital L and small l varieties punch below their weight. They have not contributed as much as they should to the conservative movement. This is partly because libertarians tend to founder on foreign policy, where many are merely modern-day isolationists. But

The Israeli government has confirmed reports initially surfacing at the Associated Press and the New York Times that the bodies of three Israeli teenagers reported missing earlier this month have been found. The Israeli cabinet is conducting an emergency meeting on the matter. Officials are confident that they have found the bodies of Naftali Frenkel, Gilad Shaar, and Eyal Yifrach, who went missing in the West Bank earlier this month. Frenkel, a U.S. Citizen, and Shaar were 16 years old; Yifrach was 19. “They know it’s the three, they will know for sure after they do the autopsy," said an Israeli official to the newspaper on the condition of anonymity. He noted that the children appear to have been killed close to the time of kidnapping and had gunshot wounds. Israel's Haaretz newspaper added that the Israeli government was officially conducting a media blackout until all the details were confirmed.

Risen’s accomplishments in this area have been overshadowed by the emergence of Edward Snowden, but Risen should not be forgotten. We know of two valuable national security programs that Risen (writing with his colleague Eric Lichtblau) and the Times destroyed by their disclosure of them.
