On Saturday, I wrote about the standoff at Bundy Ranch. That post drew a remarkable amount of traffic, even though, as I wrote then, I had not quite decided what to make of the story. Since then, I have continued to study the facts and have drawn some conclusions. Here they are. First, it must be admitted that legally, Bundy doesn’t have a leg to stand on. The Bureau of Land Management has been charging him grazing fees since the early 1990s, which he has refused to pay. Further, BLM has issued orders limiting the area on which Bundy’s cows can

Private ownership of land has always been a sore spot for over-reaching despots. Think back to medieval times: no private land owners. A central planning government wants serfs, not land barons. Its so much easier to herd the populace when they own nothing but what they carry.

Hopefully this is a wake-up to the ststes. Take back yer land!

Voters in Nevada should be more concerned about why Harry Reid is more interested in Chinese development than he is about the people who put him in office and pay his salary.

Cliven Bundy is standing up to an overreaching government who are doing their best to put him out of business. This has been the government´s goal from the beginning as evidenced by all the ranches and ranchers who have disappeared over the last twenty plus years. The federal grazing laws were designed just for this purpose.

All you ranchers who are criticizing Cliven and his family better check behind you every now and then because the Feds will be coming after you...the means and laws just haven´t been perfected yet.

The government tests atomic bombs in Nevada, but Mr. Bundy´s cows are upsetting the turtles.Somehow the cows make ´em uncomfortable.

Those stupid desert tortoises. When I was spending a five-day, four-night all expenses-paid trip to the lovely National Training Center at Fort Irwin, California a few years back, we were warned not to drive/walk/go anywhere near one of the tortoises. Word was that they would get so scared, that they would urinate so much that they would dehydrate themselves and die quickly. I personally felt anything that frightened of other beings should be ´naturally selected´ out of existence, or at least have the sense to mosey its way away from our humvees, etc.

I´m glad to see this very balanced and detailed piece with the "must reads" today. Many thanks to OP for posting this.

FTA: "They are hostile to traditional industries like logging, mining and ranching, and if you have a puddle in your back yard, the EPA will try to regulate it as a navigable waterway. That is only a slight exaggeration."

This may not be an exaggeration at all. LDotters will recall the case of the Sacketts in Idaho, who began the process of clearing land for their dream home. They were not wealthy; they had only saved their hard-earned money to build their new home. Then an agent of the EPA showed up on their land and, without warrant, informed them that they must stop the process because the land was considered "wetlands". Never mind that there were already other homes there. Furthermore, if they did not stop immediately, they would be fined $37,500 PER DAY. And oh, by the way, you can´t sue us, said the EPA.

When the Sacketts looked into the issue of the land by checking the coordinates, they discovered that the land was not, in fact, on wetlands. No matter. Since then the Supreme Court ruled that the Sacketts have the right to sue. I don´t know where the case stands as of now.

Now why do I bring up the Sackett case? Because the Bundy case has now brought to forefront in the public square the issue of liberty vs. tyranny. The Bundy case is about much more than the last-standing, repeat the last standing, rancher in Clark County who hasn´t paid grazing fees. By the way, why is Cliven Bundy the last standing rancher?

Back to the Sacketts. They haven´t done anything wrong. Their land is private. Yet a Federal agency -- and by the way, most of these agencies are heavily arming their bureaucrats now (why?) -- can just walk arbitrarily onto PRIVATE land and dictate what a private citizen can and cannot do, instantly turning that private, law-abiding citizen into a criminal. That´s what this is about.

Now for those who are constantly wagging their tongues about how Citizen Bundy should have paid the grazing fees and all of this would never have happened, I can only say you´d better wake up and smell the coffee. If the Federal Government can harass people like the Sacketts, then they can -- and indeed we have seen that are doing so -- come after you, dear citizen. And mark my words, they will.

On another thread a poster says that the BLM typically does "come in with firearms, contracted cowboys, cattle trucks and helicopters." She saw this with her own family´s ranch.

I never knew this. I don´t think most Americans did. So livestock warrant a major armed assault while illegals and drug runners are allowed to pass through BLM lands at will? Even if Cliven Bundy does not have the federal law on his side, he has natural law on his side. Kudos to those who went out there to support him.

Excellent article. I now understand better the relationship between the BLM persecution of this rancher and Harry Reid. It´s all about money and influence peddling--something the senator and his family know a lot about.

Perhaps a two pronged attack might get some attention. Sometimes these actions start a steam rolling effect.

Start an immediate recall of Dirty Harry Reid. He is ripe for plucking. Impeach Obama in the House. I have some hope for the first one, but because of the cowardly leadership in the house, not much for the second one.

The BLM should be eliminated and so should the EPA. If you want to judge candidates in the next election, ask them for their opinions on eliminating those two Federal monstrosities.

The Senate confirmed Neil Kornze to run the Bureau of Land Management, where he currently works as its principal deputy director. Previously, the native Nevadan worked on public lands issues in Majority Leader Harry Reid’s (D-Nev.) office.

When is Dingy Harry up for reelection? 2016? I guess he figures he has enough time now for people to forget about this incident. It seems pretty clear to me that someone wants the land. Otherwise why wouldn´t they just go after the money? They could put a lien on the property and do other things to collect on the judgment.

If the man is breaking the law arrests him. It’s not like he never goes to town, or hasn’t since 1993. What we are seeing is intimidation pure and simple. There is no need for the BLM to get all gussied up in their camo paramilitary garb lace up their combat boots and wave their AR 15s around like they are subduing the freaking Taliban. The man probably should have paid the grazing fees? I don’t know or care. What is ticking me off is our Police, BLM, DHS, Fisheries, IRS, and even the Postal Service arming up. These people including the police have no business pretending to be combat specialists, and giving them military grade weaponry is dangerous and stupid! All its going to take is for one of these wannabe Rambo’s to accidentally discharge their weapon and all he11s going to break loose. We saw what happened to the poor bum in Albuquerque, imagine what it will look like when they start firing into hundreds of people instead of just one.

#24 - Rush may be a better entertainer and have a sharper wit, but Hannity kicks his butt when it comes to standing for freedom. To heck with strategy - IT´S SHOWTIME and Sean has the discernment to know it and left Rush and others far, far behind. People are putting their lives on the line for our freedoms and Rush is silent?? We´ll see what Rush has to say today.

Obama has his domestic force that is just as well funded, just as well armed as the military in all these agencies having an armed enforcement arm. They have lots of ammunition stockpiled and Obama can use drones to kill americans if the situation requires it. They are itching for a fight where the government can attack the citizens and put them down. The restraint of the population to this point has been admirable. The provocations will get worse so more restraint is needed. As #13 says Bundy has natural law on his side and the sources of federal statutory law ( Reid ) are corrupt so it deserves no respect! Check out the relationship of this incident to Agenda 21 where the elites of the world have agreed to herd everyone into a few large cities returning most of the land to wilderness! Everybody needs to stay cool in these trying times!

I had the same thought #26, I wish I knew what the reason was. My guess would be that their weighing in is exactly what the tyrants want. The media would then link the instigation of an "armed insurrection" to Palin or Rush or whoever. Since the government can now, by fiat, indefinitely detain an American citizen without charges......?

I have been listening to podcasts of Joe Walsh´s (Walsh Freedom) radio show. He flew on impulse to the ranch last Saturday and got to spend some time with Cliven. He also took a swipe at Hannity for "planning" to get down there for support but since the feds left he never made it.

There was a man on Meghan Kelly´s show last night that claimed that he was there with a host of other people that were there to stand by Bundy against the BLM. He made the remark that most of them were will to die for what they believed in. And many of them were fully armed. It´s actions like this that make me believe that this country is sitting here with a hair trigger and a cocked hammer. It will only take a situation like this for a large segment of the country to erupt into a full blown revolution. As each day passes by, we are seeing more and more citizens getting fed up with the actions of an out of control government. And when in does erupt, I´ll be one on the first in line, even at my age.

Double plus for #21. Handle the Bundy matter as law enforcement. If he won´t pay a bill then proceed to auction off his ranch to collect. But do it through the courts. That will get his attention.

And if he won´t obey a specific court order then send the Marshals to arrest him. That will also get his attention.

After the Bundy´s behavior is dealt with any remaining cows wandering on federal land can be rounded up and sold off too. Same deal, do it legally.

We see one agency after another arming up and trying to be police, judge, and jury on any matter they wish. Not a good idea. Police and courts - local, state,and federal - exist to do that.

The BLM seems to have wasted money and effort and good will by trying to physically intimidate. Physical enforcement is why we have police and courts.

The reason, #24/25/26/28 is that there isn´t a good side to this tale. Mr. Bundy has revved up a lot of support, but he´s legally doomed and that was the case before the microphones showed up.

After we win the Senate and then the White House, I certainly hope the new Congress and administration can find a way to pare down the amount of public land held by the feds. States are severely hampered by government ownership of such a large percentage over which state governments have little control. Return it to the states in some way, or sell it to private buyers as in the old days of opening up and settling the country.

There will still need to be a Bureau of Land Management, but maybe some of the guns can be set aside.

Dots – Dingy Harry, his son, his crony in charge of the BLM, and a Chinese developer. By law you need to connect the dots, by gut feeling, you know that they’re all connected.

Let’s see, Federal regulations, established by Federal Law, tried by a Federal prosecutor, in a Federal court, now what could be more American than that? Having a government prepared with snipers to deal with American Citizens is much more assuring than using force to protect our borders. Every patriot should know that this administration is watching your back, it may be through a scope, but they’re watching.

The thing that served to put the lid on this boiling pot was the government witnessing the American Spirit on horseback ready to truly “live free or die” (that phrase started in New England but after the revolution its spirit has moved out west). They underestimated the resistance because they get their ideas inside the beltway. Their pimply faced supporters pound their keyboards because just the thought of pounding a fence post would hurt their hands. I was taught when I was young that if you ever point a gun at someone, you better be ready to pull the trigger, it’s been reported that many of BLM officers weapons were lowered.

Our present government is treading into extremely dangerous territory by testing who would be willing to kill a fellow American – the one who resists or the one who enforces. I prefer we don’t get that answer, but I fear their testing will continue until they get the bloody answer: Freedom isn’t free.

Bundy tried to make payments by sending checks to the State of Nevada which they refused to cash. Rory Ried sat on the county commission when the deal was made to sell acreage to the Chinese for approximately 1/7th of the appraised value.
A photo op was taken recently with Ried and other dignitaries around the middle of March for ground breaking where the Bundy cattle grazed. Think Reid´s not in this stink up to his eyeballs........think again. Strange too that it´s been 2 years since they were last in Court and this NOW comes to a head without forewarning to remove the cattle because of impending improvements.....the turtles be damned. The BLM euthanized thousands of them because they said they didn´t have the funds to feed them...but had more than ample funds to pull this deal off.

The Bundys have the $$. They took a stand 20 years ago (when the microphones weren´t turned on) when the BLM stopped improving the land -- as they had agreed when they were charging him dues on those public lands. Taxpayer public land that he has a right to walk on just like we do.

Bundy continued to improve the land himself at his expense, while trying to pay his county those fees. But they wouldn´t take them. He was standing on the challenge that his family had (squatters rights if you will) been using that property far longer than the BLM was even in existence. 140 years, I think. His family maintained & improved that land & continues to. In a sense, he, like us "owns´ this federal land as a taxpayer. But he is using it for his cattle & maintaining/improving it. They owe roughly $300,000 to the BLM, not a million as is claimed.

The first issue came when they claimed the Desert Tortoise was endangered. He fought for years in court & won. They thrive w cattle there. Then they began the "cattle are trespassing" claim. Now we know why. Reid & Son want to build a solar energy plant (built by China!) on OUR tax-paid federal public land. We read somewhere that 90% of Nevada is owned by our federal govt. How does Nevada even call itself a state??? Utah is close to that, also I think Wyoming. The Feds are buying up less populated states. With our tax $$. Why?

I am sympathetic toward Bundy and I have nothing but disdain for this rogue government starting with the three branches of government at the top, down through all of the Federal bureaus who make their own laws by rearranging what Congress has passed to suit their own ideological twisted minds.

This is the United States of America and we have a written Constitution that is being violated daily by Government gangsters. They know their actions are going to cause a Constitutional crisis so they are arming up with tanks, billions of bullets and sophisticated weapons.

What can Americans do. Well citizens know who the sell out politicians are, but they don´t know who the real opposition out here is. The kind that will take any kind of opposition action. I´m too old to do much anymore, except write stuff like this.

The thing is, start now at the local level. Elect majorities in your government that will toss the vermin out of office. Stop your local government from buying sophisticated weapons. They don´t have any sane reasons for buying tanks for local police enforcement. Take down all of the spy cameras. The data they garner will be abused, and you know they will use it illegally. Take Obamas illegal pen away.

Regardless of who was right on the law, this was an overreach and a public relations disaster. That is why the BLM agents were called off. There needs to be a political solution to this situation--but I´m not holding out much hope with Dingy Harry in charge.

Every poster should try to watch the man who was on Megyn Kelly´s show last night. He took videos of the weekend standoff. He wasn´t siding with anyone, but found the Bundys real patriots who were willing to die for this. This man even went ahead of the Bundys and feared he would be shot by the BLM. I side with the Bundys.

My understanding is the Bundy family has had the land for well over 100 years. during that time, it became state lands not BLM land. Bundy´s land was never BLM land and the media perception that he owed grazing lease money to the BLM is completely false.

I think Bundy has a strong position on this matter. Interesting that Reid´s interest in the land was to take care of a Chinese company who planned to build a multi-billion dollar solar facility and the Bundies got in the way.

At least the title of this article makes sense...

So many good posts, but cannot believe Sarah and Mark haven´t weighed in for the Bundys... Am I the only one who remembers the Western states encouraging pioneer homesteading to settle in the West from 6th grade Civics class... Seems to me this would take precedent as Cliven Bundy believes. Follow the $$, especially from China... A Solyndra $500MM redo? Again, a states´ rights issue, like the War of Northern Aggression... [John C. Calhoun was a Statesman and a Gentleman.]
