Many Americans have been watching with great consternation the ongoing struggle between the Federal Bureau of Land Management (BLM) and the U.S. Marshals against Cliven Bundy and his family. There are no signs of either side relinquishing their position. Many onlookers have been informed that this dispute is over protecting the desert tortoise. But it is nothing of the sort. In fact, the reality of the dispute goes far underneath what is being talked about. The more appropriate source of the dispute is ground water as well as surface water -- this is a war over water. This is only one of the reasons why people are siding with Bundy. The government has no business changing the rules and using federal regulations to purposely usurp the state of Nevada and the agreement it had with Mr. Bundy.

Lots of opinions on both sides--I wonder where the truth lies. I suspect it is not with the government.

In any case, bringing a hundred or so armed men (not police, but rather "contractors") is not a good idea.

Controlling the water -- Agenda 21, sustainability, power over life & death of the people-- remember when the Democrat governor of Montana released the dam that flooded the Missouri and Mississippi Valleys a few years ago, destroying a multitude of farms and towns? "Government" (EPA)had been trying to buy those farms for decades at low prices. With the election of "the Won" they saw their chance. .. globalization and reduction of human population in progress.

According to the article linked in #2, the former superintendent of the Lake Mead National Recreation Area states that:

In 1993, we reduced the number of cows that could be grazed on the Bunkerville allotment to 150 because of the emergency listing of the desert tortoise as an endangered species.

Mr. Bundy objected to having the conditions of his lease unilaterally changed by a governmental organization that behaved more like an overlord than a responsible steward and manager, and we are supposed to take from that that Bundy is the bully?

It is NOT federal land. The land is owned by the county. It is "managed" by BLM. Look into the relationship between Harry Reid and the BLM. It has nothing to do with tortoises OR water!

#7, Landlords can change the rules. That´s a fact of life, whether it´s an apartment lease or a long-held grazing lease. Unfortunately, the landlord´s motives can be questioned, but that´s rarely a sustainable legal argument.

Mr. Bundy is under a court order to remove his cattle.

There are far better cases to rally behind when challenging a perceived government overreach.

#10, I believe the grazing allotment is owned by the county, not the land itself. The linked article says the allotment was sold to the county after Mr. Bundy´s lease was revoked for non-payment to the BLM (for 20 years!).

I believe we are talking at cross purposes, #11. As #10 so succinctly pointed out, this land is not owned by the Federal Government. It seems to me that this is the perfect case to talk about government overreach.

Wow. Unbelievable. Ladies and gentlemen, there goes the Declaration of Independence right out the window. Dittos #13.

The article linked from #2 is truly laughable. The author may very well be "familiar with Mr. Bundy´s history", but so are many others who have come to a very different conclusion. (And the desert tortoise was never in danger from cattle.)

Unfortunately for your argument #11 is that your next door neighbor cannot just claim to be your landlord without purchasing you building. The "building" in question is owned by the county and the state of Nevada. And in most states, if you have a lease and the property changes hands, the lease is still valid because it is an agreement to have rights to use of the property and must be honored by the next owner.

Ok, last post. This is from the Mesquite (Nev.) Citizen-Journal on March 11, 2014. The Cannon spokesperson is from the BLM in an interview:

Cannon says the BLM is working to comply with two court orders issued by Federal Judges, one in July 2013 and the other in October 2013. Those two orders follow numerous others issued by the courts clear back to 1998.

United States District Judge Lloyd D. George gave Bundy until Aug. 23, 2013 to remove his cattle from federal lands or have them seized and impounded. Instead Bundy filed an appeal of the ruling and a ‘Motion for Stay.’ Apparently neither action held.

In 1998, Clark County bought all valid existing grazing permits for Gold Butte, paying $375,000 to retire them for the benefit of the desert tortoise, Rob Mrowka of the Center for Biological Diversity said in 2012 after his organization filed suit against the BLM for not enforcing previous court orders. All other ranchers in the
area complied with the ‘no grazing’ rule except for Bundy who’s been called the last rancher left in Clark County.
Bundy tried paying his grazing fees to Clark County in the 1990s but they refused to take them. He quit trying to pay the fees shortly after. His original grazing rights allowed him to run up to 150 head of cattle in the area.

Bunch may owe a few dollars for unpaid government leases but that is it. He should pay them.

The overreach of the Feds is off the charts. This should be a situation that could be easily negotiated to a peaceful conclusion. However, the Feds must start with the true facts and it has nothing to do with the desert tortoise.

This folly has the appearance of being a Obama /Kerry foreign affairs tabacle. When will the line be drawn ?

In Obama world every action must begin, first, with a lie; then a cover up by the regime and the msm...then a change in talking points. We are always from convolution.

What makes this interesting is that it comes as Obama´s federal government has been gobbling up land as I remember. There are disputes in several states. They are also using the EPA, BLM, NPS, IRS and his other executive agencies as unconventional weapons.

I´d like to know why Bundy is the last rancher. What happened to all the others? Were they forced out by the feds? This action will also force out Bundy. What then? Another solar farm?

There you go folks. A special interest group using the federal government to bludgeon private citizens on land owned by the state of Nevada to enforce its cult of environmentalism over a man using the land to let his cattle chew grass. Note, that the buyout was not paid to Bundy and he did try to pay the fees they demanded.

This is asinine. The land is serving no purpose but to soothe an environment cults ego. Add to this that it has been reported that a large number very same tortoises that just had to be protected are now going to be euthanized and its reserve going to be closed due to lack of funding. Wouldn´t it be ironic if a group of Chinese investors all of a sudden get access to the land to build a solar plant/field?

Once again, Bundy is fighting against a government hell bent on asserting is power for no other purpose than to show it can.

This has the feel of Lexington and Concord. An over-reaching and hostile government. A surrounded and embattled citizen. And a focal point for others to coalesce around. All the ingredients are there, and the only thing missing is the final spark.

This is a great opportunity for the Pubbies - - which, of course, they will blow.

Why should the Federal government own any land at all - - outside of the District Of Columbia? The Pubbies should declare that their policy is to turn over ALL Federal land, outside of DC, to the respective states in which they are located.

All land should be privately owned - - or owned by the states. That is what our beloved Founding Fathers intended.

Wake up, Pubbies - - if that´s possible. Turn over all Federal land to the states!

I think we would have to go back from 1880 when Bundy´s grandfather homesteaded the land and track it forward to 2014.
Seems to me the Bundy family was there before there WAS a BLM.
The California farmers are being destroyed (as is our food source) because of a Delta Smelt and a rogue government withholding water, Ranchers are being destroyed by a desert tortoise and a rogue government..I see this as a sign that this rogue government will move to control our water and food in the future. They took over our healthcare, didn´t they?
We will be starved, as Stalin starved Ukraine.

A certain ´lot´ seem to assume the Bundy´s are Conservative and are out full force backing the BLM and gov´t agencies. Are they paid disinformation trolls for the government?

Information on the BLM website and dated back about 2 years ago (conveniently deleted now, but not before a screen capture) specified the Bundy´s and their land is holding up a $5 BILLION deal Dirty Hairy Reid and son Rory have been working with the Chinese.

Re: post 11, you might want to take a look at Art. 1, Sec. 10, clause 1, generally referred to as the Contract Clause - where it states, in so many words, government cannot retroactively impair the contract rights of a citizen.
Moreover, I don´t know where you learned you contract law, but landlords are even more hampered in changing contracts than the average person, given the landlord tenant laws of the varies states. That´s the idea of contracts ... binding, enforceable agreements between the parties.

#21, is there a source for your claim that this land belongs to the state of Nevada? According to Wikipedia:

The majority of public lands in the United States are held in trust for the American people by the federal government and managed by the Bureau of Land Management (BLM), the United States National Park Service, Bureau of Reclamation, or the Fish and Wildlife Service under the Department of the Interior, or the United States Forest Service under the Department of Agriculture. Other federal agencies that manage public lands include the National Oceanic and Atmospheric Administration and the United States Department of Defense, which includes the U.S. Army Corps of Engineers.[4]

In general, Congress must legislate the creation of new public lands, such as national parks; however, under the 1906 Antiquities Act, the President may designate new national monuments without congressional authorization.

Each western state also received federal "public land" as trust lands designated for specific beneficiaries, which the States are to manage as a condition to acceptance into the union. Those trust lands cannot any longer be considered public lands as allowing any benefits to the "public" would be in breach of loyalty to the specific beneficiaries. The trust lands (two sections, or about 1,280 acres (5.2 km2) per township) are usually managed extractively (grazing or mining), to provide revenue for public schools.

#25, The Bundy grazing allotment was never a part of their 150 acre homestead, but simply an "allotment" or lease on public land not adjoining their ranch.

If Harry Reid has a dirty plot in the works, we´ll soon find out, but the Bundy dispute with BLM predates any interest the Chinese or Harry Reid had in Gold Butte. Mr. Bundy, at this point, is very effectively using Reid, the Chinese, water allocation to muddy up the dispute.

From maps, it doesn´t appear the Reid/Chinese land is anywhere near the Gold Butte protected area and Bundy´s ranch. The Reid proposal is 90 miles south of Las Vegas. The Bundy ranch and the forfeited lease are well northeast of Las Vegas. So, whatever Reid´s ugly motives are, the properties don´t seem to have any proximity.

Reid´s son, Rory is a registered lobbyist, as are all of Reid´s sons. He lost the last governors race to Sandoval(R). He represents the Chinese energy giant, ENN Energy Group, in its efforts to build a $5 billion solar farm and panel manufacturing plant in the southern Nevada desert. Guess where they want to locate it?

Reid has placed his former adviser, Neil Kornze as head of the BLM. He was confirmed under new Senate rules a couple of weeks ago. He does whatever Reid tells him to.

Reid wants Bundy´s water rights so he can ship the water to his buddies in Las Vegas. The only way he can get it is to drive Bundy out of business like he has to the other former ranchers in the area.

Reid and his corrupt cohorts are doing the same thing in Northern Nevada, where I live: Use the EPA to declare some critter "endangered." In Southern Nevada its the Desert Tortoise, up here it´s the Sage Grouse. Then the BLM moves in and drives the Ranchers out of business and they buy up the water rights.

In this case it´s a twofer: Rory Reid gets to make millions from his Chinese solar power overlords. Harry Reid has been doing this kind of land and water maneuvering for decades. How do you think he got to be a multimillionaire from his humble beginnings?

This is about more than grazing fees, court orders and turtles. It´s about one manifestly corrupt politician lining his pockets at the expense of all Nevadans.

Don´t expect Bundy to get any help from the Clark County Sheriff or the County Commissioners. They´re all in the pockets of the big-money guys in Las Vegas as well.

Most land takings by the Feds are by Executive order. So where is it in the actual Constitution that gives them this power? It isn´t!

I wonder why there is no reporting on conservative websites about this event?
My 2 cents: there is eerie resemblance of this standoff with dispossession of kulaks in fascist Russia in 1930.
Where are our repubic´s representatives and senators commenting on this horrendous situation? Even if Bundy is completely wrong that has to be discussed too. The repubics have a chance to be ahead on this.

The rhetoric surrounding this issue by the Clark county commissioner is appalling. He suggested that anyone from Utah traveling to Nevada to support Mr. Bundy had better have their funeral plans made. The dogs, the tasers, the snipers, the no fly zone...these are methods of intimidation.

Like most posters, I am sick of the government pushing tax payers around because some environmental wacko has used the court system to harass citizens. Obama has given silent consent to this behavior just like he has done with every other oppressive action by this administration. There chomes a time when you must make a stand. Either we stand for freedom and against tyranny or our republic is lost. God bless anyone who has the courage to stand because we it has never been more important than it is now. Government will always err on the side of tyranny because it is the very nature of the beast. Don´t Tread On Me!

We have our government buying up land so the STATE can control all. The people are to serve the STATE: not God, Not family, not themselves. This is Soviet in it´s outlook.

In addition we have China carving out ´spheres of influence´ by buying corporate farms here.(Reverse of what happened to China in the 1800s).
Where do we go to get Freedom? This IS the time and place this stops.

What Americans need to be concerned about is the government placing snipers in the hills and the free speech corrals they have established. Did anyone hear of anything similar happening during the Occupy movement’s takeover of public land?

Just imagine the outrage if there were snipers stationed in the hills to protect our border patrol agents, yet not a peep when it involves freedom loving Americans as potential targets.

If BLM is pulling out their "resources" it is only because this situation is getting so much attention in the alternate media and many people are rallying to the site. They don´t want this to get any bigger. Totalitarians like to do their dirty work in secret. When the supporters disperse, they´ll be back with a vengeance.

The southwest states of the United States of America have a long tradition of recognizing “prior usage rights”. There are land grants that trace their history clear back to the 1600s. Water rights are similarly recognized based upon when the water was first used for agricultural usage. Cliven Bundy´s family´s grazing rights can be traced back 150 years to the formation and recognition of the State of Nevada in 1864. The BLM was formed in 1946. It is clear that the Bundys have prior usage rights that predate even the formation of the BLM. If you include the predecessor of the BLM– The General Land Office (GLO), which was formed in 1812, their formation could be considered to predate the Bundy´s usage, but the fact that the land was continually grazed for over 150 years shows that the GLO and the subsequent BLM not only allowed but agreed to the land usage by the Bundy family. The courts have erred in their rulings over these usage rights and have either set a dangerous precedent or followed in the footsteps of decisions that overstep moral and ethical boundaries regarding eminent domain. This dangerous trend is becoming the powder keg that we see being worked out in this case. The fact that multiple branches of the federal government have ruled against what should be standard law simply shows that they are either colluding or ignorant. The rulings by the judges are a prime example of progressive judges creating law...

I’m no longer considered a cowboy, if I ever was. However I did work on a eleven and a half section ranch for a while (1 section = 1 Sq. mile). Later in life I worked on an Oklahoma ranch during my summers in school, never did I see or hear of a cow attacking a turtle. They just do not interface. So the underlying problem where they reduced his heard population to 150 just does not work. I doubt that he could have stayed in business with a 150 count. The government wanted this land, cheap, and used its power the run the folks off. There is a snake in the rock-pile somewhere.

Not sure how pe-ing on Republicans (ala #23) will help turn this, or any or all unoccupied lands over to the states. Are the Republicans supposed to start carrying placards and marching along Pennsylvania Avenue? How? When? How many? Are you willing to fund the effort? How much?

Why can´t state legislatures (where the lands are situated) grow a pair and reclaim their own land. IIRC, state legislatures have both Democrats and Republicans as well as Independents.

A time for earnest prayer for peaceful outcome and that the process will be the opening of all the facts and the overreaching land managing feds who are heavily liberal and now hiring their own.

Superb thread! I´ve read every word and feel inadequate to add anything of value. However...

One poster states. "Landlords can change the rules. That´s a fact of life,...." This offers us a whole new way of thinking about the federal government. Since they own some 28% of these United States (and about 85% of Nevada) the feds are our landlords...and they can change the rules.

How does that make you feel, those of you who thought that you were living in a constitutional Republic, especially if you truly believe in the Tenth Amendment.

First we need to follow the money:

1. Harry Ried and his son stand to gain a significant kickback from the CHI-COM who want to build a Solar power station there.

2. The federal govenment can not own land, land is purchased or grabed and the site becomes a National Park Service area.

3. If you follow the model being used at the Bundy ranch, you will see that the Feds are using the same method for stealing American Indian Land.

4. You see a paramilitary force including Helicopters, snipers and drones. The BLM does not have a military mission in their charter.

5. In prior years this dispute would have been handled by the courts. If the BLM needed LEO support, the Governor of NV would have brought in the National Guard.

6. The actions of the BLM are both aggressive and intimidating, why?

7. So it´s not just water rights, its land rights so Dingy Harry and his son can help the CHI COM get their power plant up and running.

Note that even if the solar farm is not located on Bundy´s grazing land the Bundy grazing land can be used to count as remediation for the actual solar facility. Could it be that Clark County was planning to sell it to the Chinese company to use for remediation and keep the water right for use in Las Vegas? Follow the money! There may be a Reid at the end of that string.

This second post is off the topic of the original thread, but it pertains to #53’s Youtube link.

The presentation demonstrates why scientists are losing their credibility in my mind. He and his ilk were so sure of their original desertification theory that they were responsible for killing 40,000 elephants. He also stated that per the scientists’ recommendations, South Africa burns 6 billion hectors of grasslands for preventative measures, and each hector burnt was equivalent to the pollution of 1 thousand cars – that’s 6 trillion for South Africa alone! That´s quite an environmental accomplishment!

After 40 years of their recommendations leading to the devastation of grazing lands and billions spent, they have had to admit they were wrong. However, after explaining how advancing deserts could cause climate change, he can’t resist, he has to tell me that climate change (if it does exist) is due to my GMC Yukon burning fossil fuels. I guess it’s in their DNA. Their smug attitude of superiority degrades their credentials when they tell us to trust them and it serves as a reminder that no science is truly considered settled.

At the eleven minute mark of this 15 minute interview, Kansas Senator Pat Roberts is reduced to a stumbling, bumbling pile of a 47 years in Washington incumbent who can´t manage to coherently explain why he doesn´t actually live in Kansas anymore. And perhaps the worst of it is when he admits that he does click his heels together to go back to Kansas on occasion .... seemingly only when he gets an opponent.
