The San Francisco 49ers said they are aware of a TMZ report saying quarterback Colin Kaepernick is being investigated for an incident in Miami and are gathering facts on the incident. TMZ reported Thursday that police are in the beginning stages of investigating an alleged incident which TMZ said happened at the Viceroy Hotel in Miami earlier this month. The story said the police were investigating for "possible sexual assault," but Bay Area News Group crime reporter Natalie Neysa Alund wrote that the incident is not being investigated as a sexual assault. No charges have been filed at this point.

Why on earth any of these guys allow themselves to be alone with a female until they know them pretty well is beyond me. Of course, if he did something, let him be punished to the full extent of the law.

Guilty or not and we should with hold judgement until the facts are in. However, Mr Kapernick is the face of the Santa Clara 49ers and definitely should know better than put himself in such a situation. What a putz.

The April 1 incident involved a woman with whom Kaepernick reportedly had a previous sexual relationship and happened at the Miami apartment of Seattle Seahawks wide receiver Ricardo Lockette, according to a four-page police report. The woman filed the report with Miami police on the evening of April 3.

None of the players have been questioned, arrested or charged with any crime, Miami police spokesman Rene Pimental said Thursday.
