Startling Rift on Supreme Court
Springs From Error by Kagan
On Text of Obamacare Law

New York Sun, by Betsy McCaughey

A startling rift appeared Tuesday on the Supreme Court as the three female Justices came out swinging like Brunnhildes — women warriors — for what they erroneously labeled an “entitlement” to employer-provided contraceptives and morning-after pills. The Justices were hearing oral arguments in Sebelius v. Hobby Lobby Stores, Inc., a case hyped by the Democratic Party as a test for women’s rights. Justices Kagan, Ginsberg, and Sotomayor sprang on Hobby Lobby’s attorney , interrupting his every sentence and pummeling him with questions taken right out of the Democratic Party’s “war on women” playbook. That playbook was laid out in a

Good question ... Sounds like she didn´t read the ACA either!

There should only be one liberal woman on the court. Three liberal women can drive anyone crazy.

If these three women were representative of women in general, there would be no need of birth control.

If you aren´t aware - Betsy McCaughey is former Lt Governor of NY. She did extensive study/writing on ACA.

She wrote: Beating Obamacare: Your Handbook for the New Healthcare Law - available at Amazon.

From book blurb:

Betsy McCaughey, Ph.D., is a health policy expert and the former Lt. Governor of New York State. In addition to serving as Lt. Governor of New York, she has taught at Columbia University, held academic appointments in health policy at the Hudson Institute and the Manhattan Institute, written hundreds of articles for publications such as the Wall Street Journal, New York Times, Modern Healthcare, The New Republic, and received numerous awards for her writings.

I thought that the only entitlements or rights we have are 3.

1. life, 2. liberty and 3, the pursuit of happiness.
I don´t read abortion amongst these rights. or entitlements. I also don´t read..free housing, free food, or free cell phones.

of course those 3 libs are going to defend the right to an abortion.. they should defend the right to life, according to the constitution.
abortion is not health care..chemo therapy is..

Let us all pray to God that Betsy´s prediction is right. But with Breyer, Kennedy and Roberts holding the cards we cannot know. That a case like this would be a slam dunk (or no case at all) in a sane and just world shows just how far down into the authoritarian black hole our country has gone, thanks to the legions of dolts, handout-seekers, manufactured victims and robo-voters who put Bubba and Dear Leader into office (of course, Republican fecklessness certainly contributed).

Sadly abortion has become birth control for some. Women have to go three strikes to get to abortion one is to decide to have sex,two is to have unprotected sex, and third is to shun adoption. Women have choices that could save millions of lives and billions of dollars. Most of which could cost less than a dollar.

Women like Kagen who have chosen their careers at the expense of having children see pregnancy as an unfair burden on women. To them, the availability of free birth control and abortion are equivalent to any other government scheme to correct an injustice. They are essentially self haters who have no appreciation for a women´s God created uniqueness and the importance to society of motherhood. If you doubt me just remember the feminist mantra: A woman without a man is like a fish without a bicycle and replace man with child.

Ugly, mean, liberoid females are indeed entitled...

to purchase from any profitable retailer the vibrator/s of their choice...

in order to pursue happiness as Thomas Jefferson mentioned
in the Declaration of Independence...

Note that his was not a list of dependencies by individuals upon a
massive and intrusive Gummint to provide the funds for the fun.

Note that the Declaration is not our prevailing law.
The Constitution etc is.

And be careful about endorsing the opinions of DimWit presidents.
FDR had the Four Freedoms...
which I´d have to verify by looking up...
but I know one of them is...
Freedom from want...
and the rest of the welfare agenda.

Abortion originally was considered to be violence against women, a method for men to control them. Now we have women arguing in favor of going against the very nature of life itself, nurturing the young. I personally do not understand the rabid defense of killing babies by the very sex which carries them in their wombs. This case also points up the utter incompetence of Kagan who evidently does not know the difference between a law and a regulation. Even I who has never taken a law class know that, and this person is on the highest legal tribunal in the country.

Okay, if you don´t mind, I verified the list of the Four Freedoms...
which FDR mentioned in his 1941 State of Union address...

Besides Freedom from want...
I also could have included my next guess...
Freedom from fear...
And he mentioned...
Freedom of speech...
Freedom of worship...

So even the Liberoid Godfather of the Modern Welfare State...
DimWitz Icon FDR...
acknowledged that everyone in the world should have...
Freedom of worship...

So he played right into our hands on this Hobby Lobby case...

Showing even a broken clock is right now and then...

The scariest thing about all of this is that these three women are on the highest court in the land and except for Ginsberg, will be on the court for decades to come. The fact that their arguments have nothing to do with the Constitutional basis for the law does not portend well for the future of our Constitution. Their focus is on the "rights" of the government and not on the rights of the individual as spelled out in the Constitution. When you throw a person like Roberts in the mix with his convoluted reasoning during the original ACA decision, we are in for a very long and rough future for individual rights.

I don´t see this as a religious issue anyway. I also don´t see it as a medical issue. How is preventing the birth of a baby a medical issue? Health insurance does not cover everything that involves the family; to have a child or not have a child is a family decision and can be funded by the family or as the justices suggested from other aid sources.

Kagan seemed to be impatient to make the arguments that she hoped the government would make. The male justices asked questions to clarify and often the exchanges were three or four words long that were meaningless to those not familiar to the case law.

Stevens was obviously listening when he interrupted to ask, You mean Hobby Lobby could be required to pay for an abortion?

Clearly, the Mulva Wing of the Supreme Court wasn´t selected either for their command of the law or for their ability to crunch logic. Instead they´re there for being dependable adherents of liberal dogma, constitutional or not, logical or not.

But this really isn´t that complex an issue to resolve taking into account both constitutional precepts and the perceived needs of women. Women can have the right and the opportunity to work for employers (both governmental and private) who offer insurance that provides the abortions and the contraceptives they feel they need.

But who says EVERY employer and EVERY insurance policy must offer those specific benefits? Does the constitution say you have a right to be employed by a specific employer? Does it say EVERY employer must offer exactly the same insurance benefits? No. Emphatically no.

If you are a women who wants those benefits, get a job with an employer who offers those benefits. Case closed.

Please don´t laugh...I am not naive nor ignorant...but I thought judges were supposed to be impartial and apply the law objectively. And Supreme Court Justices are supposed to have a higher standard in that they are supposed to uphold the Constitution of the United States and ensure that any ruling made in a lower court supports the Constitution and protects the inalienable rights of the citizens that are enummerated within the document against any abuses by the government. That is NOT what these harpies are doing. It sounds more like those females are NOT acting as SC justices (or court judges of any kind) at all. They already made up their minds about the case before listening to ANY arguments. They even seem to be trying to do the job of the lawyer for the government!!

But we have rarely seen such an artless, amateurish coat-holder like Kagan. Every utterance from her is a childlike expression of belief in government first, last and always. In fact, like her equally unprepared boss, she is unable to distinguish the republic from the government.

I see the mottives of the three witches as more elementary than genocide or near Chinese-style infanticide(which is condoned by Soros): They want to make sure more women end up like they are and always will be-childless, something that comes natural to lesbians. They detest families, motherhood, are miserable and want other women to be miserable. Plus one of the One Worlder directives to diminish a country´s influence on world affairs, if not dissolve its existence entirely, is to keep a check on the population by preventing more chilfren from being born.

Have you all fallen for the MSM misinformation? This case is NOT about abortion or birth control. Hobby Lobby does provide coverage for 16 of the 20 products in the HHS regulations.

The claimants in these cases are invoking the Religious Freedom Restoration Act, which was passed almost unanimously by Congress, enjoyed deep and bipartisan support among legislators, activists, and experts, and was signed into law by President Clinton. They are doing exactly what the Act’s refreshingly united supporters expected and wanted claimants to do, namely, asking a federal court to decide whether certain regulations unnecessarily and therefore unjustifiably “substantially burden a person’s exercise of religion.”

So Kagan wants to have a "uniform" society. Well, so does every other communist/socialist/fascist in the world. That´s what they are all about.

And yes, abortion as practiced in today´s world is nothing more that another form of birth control. Period. Far too many women and men want to run around having "free sex" with any and all that will agree with them. And age doesn´t seem to matter. So when a girl becomes pregnant, she simply runs to the nearest abortion mill and "presto" every thing is now OK. And before long, she´ll be back for another session. And the scum that provide abortions and call themselves doctors are some of the worst in the country. I put them in the same class as trial lawyers that run around handling cases of very large malpractice suits. Nothing more that gutter scum.

Number 34:

Both sides plus other interested parties submit Legal Briefs supporting their side. The Justices have their minds made up almost completely before the Oral Arguments supposedly based on the briefs. Only minor issues remain and these sometimes are addressed in Orals. This is why Justice Thomas rarely asks questions. Obviously, Kagan was playing to the headlines.

FTA: Justice Kennedy, often regarded as the Court’s swing vote, asked the Obama administration’s lawyer: “Under your view, a profit corporation could be forced in principle … to pay for abortions?” The lawyer replied, “but there is no law like that on the books.” Justice Roberts shot back, “Isn’t that what we are talking about …?”

Wow. So much for a government by law rather than men (or in this case, women). We were taught when growing up that the "law" is determined by the Constitution and the people through their representatives. Bureaucrats and SCOTUS justices do not make law, Marbury v Madison notwithstanding. The thin veneer of legitimacy is that all are subject to the law, unless they are bureaucrats or wear black robes. I had concluded that the judicial is the most corrupt branch of government, before Mark Levin published his book on the subject. Nothing has occurred to alter my opinion. Our government is in need of serious overhaul, starting with the courts.

BTW: Why has there been no talk of the distinction between publicly and privately held corporations? That should have an impact on legal "personhood".

#51 - according to Wiki. There apparently isn´t any difference between for-profit and not for-profit.

Corporate personhood is the legal concept that a corporation may be recognized as an individual in the eyes of the law. This doctrine forms the basis for legal recognition that corporations, as groups of people, may hold and exercise certain rights under the common law and the U.S. Constitution. For example, corporations may contract with other parties and sue or be sued in court in the same way as natural persons or unincorporated associations of persons. The doctrine does not hold that corporations are flesh and blood "people" apart from their shareholders, officers, and directors, nor does it grant to corporations all of the rights of citizens.

To continue from Wiki - Citizens United gave the right of free speech to a corporation ...

Since the Supreme Court´s ruling in Citizens United v. Federal Election Commission in 2010, upholding the rights of corporations to make political expenditures under the First Amendment, there have been several calls for a U.S. Constitutional amendment to abolish Corporate Personhood,[7] even though the Citizens United majority opinion makes no reference to corporate personhood or to the Fourteenth Amendment.

Little thought is given to Constitutionality by the politically left-leaning justices. The incompetency shown by this administration from Obama on down is staggering. Rabid progressive ideology is the benchmark for high office no matter the position. It trumps every other qualification.

Greece, NY - A recent U.S. Supreme Court decision brought a lot of attention to Western New York Tuesday night. Efforts to maintain separation of church and state took center stage in the Rochester suburb of Greece where an atheist delivered the invocation to open a town board meeting. Dan Courtney, an atheist, did something no one with his beliefs had every done before in Greece when he gave the invocation. He used the Declaration of Independence as his inspiration. "We, as citizens, the beginning and the end, the Alpha and the Omega of our destiny, are not, as the

The differences between Hamas and Israel are so profound, it’s almost as though the two aren’t living in the same century. The Hamas war against Israel pits cheap rockets — basically the 21st-century version of an exploding cannonball — against a high-tech military so sophisticated, it can send harmless “door-knocking” bombs to land on the roofs of buildings to warn its targets inside that the next live bomb will level the place. The administration of Connecticut Gov. Dannel Malloy (D-WFP) has denied a request from federal officials to temporarily house up to 2,000 illegal immigrant children from Central America at a residence in his state for individuals with intellectual disabilities. Citing concerns about the condition of the aging Southbury Training School, the difficulties associated with caring for over 300 developmentally disabled clients, and legal and procedural hurdles, Connecticut’s state Office of Policy and Management (OPM) wrote to the U.S. General Services Administration’s (GSA) New England regional offices on Monday, indicating that Connecticut could not assist them. Congressional staffers investigating data falsification and whistleblower retaliation at the Department of Veterans Affairs regional office in Philadelphia were given a workspace there that was wired with activated audio microphones and video cameras, the chairman of the House Committee on Veterans´ Affairs said Monday. Committee investigators also glimpsed a notebook used by the agency´s regional director that bore written instructions to ignore their requests for information, Rep. Jeff Miller, R-Fla., said during a late-night hearing. Miller, chairman of the veterans committee, said he is “shocked” by the directives from VA officials to ignore congressional investigators. “You will not ignore this

The World Health Organization is reporting that the rate of HIV infection among young gays is growing so rapidly the agency is recommending for the first time that men who have sex with men take anti-viral drugs as a preventative. Gay men in their twenties are too young to remember the panic in the gay community when HIV/AIDs was first discovered in the 1980s. With the advent of anti-viral drugs that make HIV, at least until the disease mutates, chronic but manageable, young men may be taking more chances sexually. Couple that with the general belief among all young men

Missouri Gov. Jay Nixon (D) has signed legislation that provides for a task force to write new education standards that will eventually replace the Common Core in his state. Nixon’s office announced his approval of the measure Monday, the last possible day the governor could take action on bills passed earlier this year, local news KMBC.com reports. The Republican-led Missouri legislature, which has battled the standards since their adoption in 2010, approved HB 1490 23-6 in the state Senate and 135-10 in the state House. Originally, the bill was intended to ban the Common Core standards entirely. Increasing numbers of

Senate Majority Leader Harry Reid (D-Nev.) on Tuesday asserted the Southern border is secure despite the massive surge of illegal minors from Central America that has overwhelmed federal agencies. “The border is secure,” he told reporters after the Senate Democrats’ weekly policy lunch. “[Sen.] Martin Heinrich [D-N.M.] talked to the caucus today. He’s a border state senator. He said he can say without any equivocation the border is secure.” Reid said lawmakers need to worry less about border security and focus instead on President Obama’s $3.7 billion request to help process the tens of thousands of children from Honduras, Guatemala

An internecine battle has broken out between the Obama administration and the School Nutrition Association (SNA) over the federal government’s requirements for school meal programs. The fight has gotten so nasty that Michelle Obama’s food policy czar, celebrity chef Sam Kass, who handed out awards at the SNA´s annual convention in 2012, was refused permission to speak at this year´s convention, held in Boston this week and attended by approximately 6,500 school nutrition workers. According to Politico, the brouhaha arose from the different goals each group has for the $11 billion school lunch program; some food companies "want to build

No one from True The Vote, the highest profile organization targeted by the IRS in the scandal involving improper scrutiny of conservative-leaning non-profits, has been interviewed by the FBI or investigators from the Department of Justice, according to the group’s President, Catherine Engelbrecht. This stunning revelation comes just days after Attorney General Eric Holder rebuffed the suggestion that an independent investigation is needed into the growing scandal. Holder told ABC News this weekend that a special investigation was unnecessary because “career people” and FBI agents were “doing a good, professional job” investigating the matter. The Times praised the Obama administration´s request for $3.7 billion in aid to deal with a crisis they think is a "myth." "The besieged border is a myth, and the arrival of a few thousand weary refugee children on buses does not make the myth true," the Times wrote. "Republicans are feeding the cycle, stoking panic about a

In his message to the “Mexico/Holy See Colloquium on Migration and Development,” Pope Francis characterized the tens of thousands of illegal immigrants that have crossed the U.S. southern border as a product of globalization, suggesting that the phenomenon is happening worldwide. Francis proclaimed, “Despite the large influx of migrants present in all continents and in almost all countries, migration is still seen as an emergency, or as a circumstantial and sporadic fact, while instead it has now become a hallmark of our society and a challenge.” Emmer McCarthy for Vatican Radio said Francis expressed his concern for “the tens of thousands of

The First Lady of these United States has declared war on Chick-fil-A. It seems the home of plump juicy breasts and hot buttered buns has run afoul of the new Smart Snacks in School program. The program is a component of Mrs. Obama’s Healthy, Hunger-Free Kids Act of 2010. The new government regulations require snack items served in public schools to have less than two hundred calories. That includes vending machines, lunch rooms and other campus food venues. And that’s really bad news for kids at South Carolina’s Socastee High School. The basic structure of those plans is a swap of a) near-immediate legalization for b) increased border security in the future. The appealing idea is to let current illegals stay while taking the steps necessary to prevent further waves. The lie is the assumption that, once current illegals get their legalization, pro-immigrant activists in both parties will continue to support the second half of the bargain, the increased security.
