A long-running child custody case took a dramatic turn Tuesday, when a Massachusetts juvenile court judge awarded permanent custody of teenager Justina Pelletier to the state Department of Children and Families. The ruling by Judge Joseph Johnston means the 15-year-old will probably stay in state custody until her 18th birthday unless her parents can prove they are fit to care for their child. The judge’s four-page decision, which was provided to the Globe, was remarkable for its detail and forcefulness. Johnston faulted Connecticut’s child protection agency for its failure to get involved in a case involving a child from its state, and

Sounds as though the parents hurt their case by doing some very unfortunate things as they were trying to regain custody of their daughter.

Is a gestapo state? What gives them the authority to take custody of a minor away from that childs parents!

The last paragraph:

Mahoney, the parents’ spokesman, said they are troubled that their daughter has yet to be seen by physicians at Tufts. Department of Children and Families officials said Pelletier’s visits at Tufts will take place soon, now that the parents “reached an agreement” with Tufts over a number of issues.

So she will be seen by the Tufts physicians whom her parents wanted to see her. Perhaps that will finally sort out this sad and rather complex case.

Remember that little kid in Florida..Elian Gonzalo´s.. Kidnapped in the middle of the night by armed Americans,taken back to Cuba because "he belonged with his father" in a communist country. So according to our government, that little boy was better off growing up in a communist country as long as he was with his father..
So why is this young child not better off with her parents.. Or is Mass. A communist state?

I had never heard of mitochondrial disease or disorder. Imagine most had not. Here is something interesting for us to be aware of:

CONCLUSIONS:

Patients with mitochondrial disorders can present with primary psychiatric symptomatology, including mood disorder, cognitive impairment, psychosis, and anxiety. Psychiatrists need to be aware of the clinical features that are indicative of a mitochondrial disorder, investigate patients with suggestive presentations, and be knowledgeable about the treatment implications of the diagnosis.

This case is horrible. The Mass DCH is out of control, dozens of scandals have been in the news here over the last year. every parent must legitimately fear taking their child to any ER in the state. They risk becoming the victim of DCF supervision.

This ruling literally boils down to the parents being unfit because they were not sufficiently compliant and respectful of the authorities who stole their child. Authorities who allow only a single one hour visit once a week with their daughter. A visit in a sterile cinderblock room "supervised" by as many as seven DCF and State police observers.

Oh, and just in case the parents are unhappy with the treatment of their daughter, they were put under a complete gag order. No doubt threatened with contempt charges, jail, high fines and permanent loss of custody.

This case stinks to high heaven, its no longer about the poor child it is a HUGE multiagency effort to cover up gross incompetence.

Oh, and just as an aside, MA governor Deval Patrick (who refuses to even reprimand the director of DCF over children who have been "lost" (and died) by DCF, is considered a frontrunner for a Dem Presidential Nomination if Hillary chooses not to run, or in 2020. Best pals with BO, the correct ethnicity and all that.

I wonder if Judge Joseph Johnson had a child held for a year against the will of his family if he would be all nice and polite about it? If the Judge is insulted about how enraged everybody is who learns about this case he should first consider that his own decisions are as wrong as both the hospital and DCF. Because the Judge is now offering his own medical opinion in this case he owns it all! You, are now the center of the problem Judge Johnson because there is no Justice for Justina in your GD court.

Since the diagnosis of Tufts’ physicians is being disputed or disregarded, you might expect that they would be assisting the Pelletier’s position. The diagnosis of mitochrodrial disease is an objective one, not like a psychiatric diagnosis which is usually only a matter of opinion. Why don’t we hear from them? Perhaps they feel that Boston Children’s Hospital physicians are smarter than their own. Recognizing that in medical situations, everyone is frightened to say anything, fearing that the HIPAA people, even more ferocious than the IRS, will fine them into extinction.
Going on for more than a year, outrageous. But perhaps typical for an issue with all knowing Mass social service people. There may be more to the story than we have heard.

Excuse me, a mere parent; but had any of us been put through what these parents have been put through by John´s Hopkins and the state of Massachusetts...I do say we too would have gone out of control at some points. They love their child and all the hospital had to do when they initially requested it was to return her to her doctor at Tufts. This ordeal appears to be a power struggle by the hospital to protect their faulty decision by deflecting the blame to the parents. It is disgusting.

This child is a bureaucratic pawn.
