GOP Begins To Fight Back Against
Obama´s Broad Executive Overreach

Breitbart Big Government, by Matthew Boyle

Has President Obama´s impunity come to an end? After five years of his flouting the letter and spirit of the law in an increasingly brazen fashion, congressional Republicans have been starting to ramp up their rhetoric about Obama´s lawlessness, their most concerted effort on the issue to date. Several new reports from top Republicans underscore the breadth of Obama´s executive overreach. Viewed comprehensively, it involves laws ranging from healthcare to immigration to privacy to technology to social issues to national security matters and more. Scandals like Benghazi, Operation Fast and Furious, the IRS targeting of conservative groups, NSA spying, CIA

Congress has published two reports and passed two bills in the House that will die in the Senate. What if the bills pass in the Sanate next year? What will their next move be when Obama vetoes them? There are Constitutional remedies for this that they are not prepared to use. The rest is politics.

Where are John Cornyn and Mitch McConnell on these issues? Keeping their heads down...it´s an election year and they are facing the voters. Seems like a good time to speak up, boys.

I agree with poster #1. While it is a positive that some members of Congress are at least thinking about these attacks on the citizens and our way of life, and putting them down on paper, in the end they are just words. They absolutely need to do something about this, more than talking and recording.

GOP begins to fight back...I don´t believe GOP and fight back belongs in the same sentence. It is too absurd. The damage that the leadership has done by refusing to come out the first time Obama overstepped his bounds with clear, concise and Constitutional reasons against his actions makes it hard to believe they are willing to begin anything much less than to fight. When any well reasoned argument against the President´s lawlessness was presented, the leadership went after the messenger. The problem is the leadership´s inability to recognize the enemy and it is not the good men who stand up to Obama´s tyranny. I am so disappointed by the leadership´s inability to foment a strategy. Republican leadership is too busy fighting a war against conservatives to realize they are defeating themselves by having presented little or no alternative to Obama´s policies. Until the knuckleheads with the power realize that the people are disgusted with the fact they would rather eat their own and devote their time to re-election than listen to what the people want, failure is assured. Boehner says we can´t do anything until we win back the Senate. I disagree. Present a united front, form a strategy to present the solutions that the people are begging for, and coalesce around one message. Lay the groundwork for success. Put a muzzle on McCain and his cronies and most of all, forget about comprehensive immigration reform. The people do not want it no matter what Rinse and Repeat says.

We are concerned here with two kinds of executive orders. One is unauthorized by law and is in violation of the law it cites. The other is authorized by a law to implement that law´s provisions. Obama´s EOs are the first and are in violation of that law.
Congress and the court must deal directly with Obama´s violation of law.

This will be tricky. Obama claims his acts are discretionary. I say many are ministerial, like his failure to enforce laws. But I´m not a lawyer.

"Mississippi v. Johnson 71 U.S. 475 (1867) was the first suit to be brought against a President of the United States in the United States Supreme Court. The state of Mississippi attempted to sue President Andrew Johnson for enforcing Reconstruction. The court decided, based on a previous decision of Marbury v. Madison that the President has two kinds of task: ministerial and discretionary. Discretionary tasks are ones the president can choose to do or not to do. Ministerial tasks are ones required by his job. In fact, if he fails to do them, he could be violating the Constitution. The court ruled that by enforcing Reconstruction, Johnson was acting in an "executive and political" capacity—a discretionary rather than a ministerial one—and so he could not be sued."

The house needs to petition the SCOTUS for an immediate ruling on the constitutionality of Obamas actions in ´not enforcing laws´ as written and basically changing them.

IF the SCOTUS members agree, fine, but for those who do not, that provides impeachable offences that can later be used to REMOVE them post Obie´s tyrany!

Time to recover rule of law and get rid of the progressive infestation in our govt. (totally)!

FTA: Sen. Ted Cruz (R-TX) has also issued a three-part series of reports on the matter called “The Legal Limit,” which totals 26 pages of examples of Obama’s lawlessness, legal analysis and details of how courts have rejected the Department of Justice (DOJ) explanations from Attorney General Eric Holder for the Obama power grabs. In his first report, for instance, Cruz details nine cases the DOJ lost in which the Obama administration was seeking—but ultimately failed to achieve—more power.

Obama doesn´t recognize legal limits of the Constitution. Cruz is identifying limits that the courts have already defined in DOJ losses. Cruz is an exceptional litigator and if he´s sharing his work product, he must be getting ready to file suit.

#6 I don´t think the msm is complacent as much as they refuse to investigate, they are uneducated as to government and the constitution and they are in love with an idea that does not exist. They show a lack of inquisitiveness that occurred in the past when everything previous presidents said and did were examined under a microscope.

I have no faith in the GOP. They have melled together with the democrats so closely that you can´t tell them apart.
The RINOs spend all their time attacking the conservatives that Obama runs with a ´free hand´ to do what he wants. Once Obama commits his crimes (which all his actions are) will the Republicans undo his acts. How do you undo illegal amnesty or will they at all?
This is a sick nation and the Republicans are part of the malignant tumor.

OK. If the Republicans can amass long lists of criminal acts that Obozo has committed in the past 5+ years, WHY AREN´T WE SEEING IMPEACHMENT taking place? And I don´t want to hear this prattle about it would never get pass the Senate. Impeachment processes would bring before the lo-fos and everyone else just what Obozo is doing to them and the country. A blistering learn action. And if and when the Senate refuses to take up the trial portion, or refused to remove him from office, that in itself would shoe the American public just who is in bed with whom. And would also give Republican a very large club to use during election time.

GOP: get back to me when you can detail the articles of impeachment that have been filed.

Impeachment and denial of funds are the sole remedies provided in the Constitution. The courts have no "standing" in this. Anything else is just another press release from Malaysia Airlines.

Zero does deserve to be impeached. There are justifiable grounds. It’s the right thing to do. And right now, it would be the greatest gift to the rats that I can think of.

Why our side can’t learn that this is not a fair fight boggles my mind. The rats have control of the majority of the press, the news networks, the late night comedians, the celebrities, the courts, and the education system. What do we have? Like the Ukrainians, we have right on our side. Yeah, right. History shows that no rat Senator that sided with Slick Willie during his impeachment suffered at the polls, they claimed it was about sex, not perjury, and the public bought it. This time it would be spun as “racist” and the results will be the same.

Talk of impeachment reminds me of the joke where God threatened to sue Satan, and Satan said, “Oh yeah, where are you gonna’ find a lawyer?”.

The only way we can get this republic to function as designed is either at the polls or at the point of our guns because we’ve already lost on the other battlefields. At times I believe zero is taunting us so he can assist us in our suicide

I agree that impeachment is right, but the time for it isn’t. I share in the frustration of our dilemma.

The GOP should not allow being labeled racist or being vilified by the press enter its calculus at all. Both ore those things are givens no matter what the GOP does.

And as far as the matter of impeachment not being able to clear the Senate conviction hurdle is concerned, that should not dissuade the GOP from impeachment in the House either. If impeachment is owed, then impeachment it should be, and let the Senate go down in history as unwilling to hold to the Constitution for reasons of political expediency; force the Democrats put their names to the defense of presidential lawlessness for history to see.

Obama and the Dems are doing a good job of impeaching themselves. Why mess up the process. Impeachment of the first black president will be pure suicide for the GOP. Emotion will override principle and the press will turn it into a three ring circus, the likes we may not recover from for a long time.

It´s all fine & dandy for Cantor, et al, to be puffing up their chests in high dudgeon but what counts is action!

It´s time to sue the Obama administration collectively and the DOJ, EPA, etc. individually. Yes, sue them in Federal court and demand a "writ of mandamus". Google it. That´s when an aggrieved party (namely the congressmen themselves) ask a judge to make a civil servant or elected official do their jobs! It worked against a mayor in the northwest who refused to enforce a law on the books which he was ignoring because he said he thought it was "unfair". He was sued --- and lost! The judge said he had to enforce the law, as written. The only way to change the law was for the mayor to have the city council vote to re-write it or make a case himself to show it was unconstitutional. But in the meantime, he had to enforce the law. Come on GOP --- time to put Obama´s feet next to the hot coals.

The GOP fight back is too little too late. The time to act would have been on the debt ceiling when they had the clear power of the purse. Since they passed on that fight they may as well lay down now when any objection to executive action will need about two years in the courts to MAYBE get the backing of another branch of govt. The fact is the executive by it´s nature can act quickly and the legislature and courts have great power but they are by nature slow acting. The GOP needs to convince skeptical voters that it will do something if it gets another chance. Each betrayal makes this more difficult or impossible and they put themselves in the position of fighting a futile rear guard action such as the Trey Goudy law demanding that Obama follow the law - if only he doesn´t veto it first! He is ignoring many laws and the constitution as well. Is one more law going to stop him?

Absolutely demand of the GOp what you don´t demand of yourself.
Unfortunately that party is currently the only other viable show around.
So put them down all the time and stay home instead of voting and call it standing on principal.
How is that working for for the country?
Also unfortunately Clinton was impeached for social misconduct instead of his actual acts of treason via giving China military data in return for illegal election funds.
That ruined the impeach remedy.
Now Obama is signing the internet over to probably the UN . If he succeeds bid any real iformation bye-bye.
Add his new scheme of come on illegals and sign up for you know what and your relatives won´t be deported.
Therefore if the GOP is making any effort back them insted of snearing.
I am not GOP just a conservative independent.

The Obama administration quietly announced on Tuesday that it intends to change the way Americans learn about natural disasters and other major emergencies during radio and TV broadcasts, giving the president the ability to flip a switch and address the entire nation at once. The Emergency Alert System, the latest version of a program first established in 1951, blasts out emergency messages in the event of local weather emergencies, but can also be used to warn Americans about terror attacks and major natural disasters. In his message to the “Mexico/Holy See Colloquium on Migration and Development,” Pope Francis characterized the tens of thousands of illegal immigrants that have crossed the U.S. southern border as a product of globalization, suggesting that the phenomenon is happening worldwide. Francis proclaimed, “Despite the large influx of migrants present in all continents and in almost all countries, migration is still seen as an emergency, or as a circumstantial and sporadic fact, while instead it has now become a hallmark of our society and a challenge.” Emmer McCarthy for Vatican Radio said Francis expressed his concern for “the tens of thousands of

The First Lady of these United States has declared war on Chick-fil-A. It seems the home of plump juicy breasts and hot buttered buns has run afoul of the new Smart Snacks in School program. The program is a component of Mrs. Obama’s Healthy, Hunger-Free Kids Act of 2010. The new government regulations require snack items served in public schools to have less than two hundred calories. That includes vending machines, lunch rooms and other campus food venues. And that’s really bad news for kids at South Carolina’s Socastee High School. They’ve just learned they will no longer be allowed to buy Chick-fil-A

“Trust” is for Con Men: The reaction to the border chaos in Texas has accomplished one thing: It has exploded the lie at the heart of current “comprehensive” immigration reform plans. The basic structure of those plans is a swap of a) near-immediate legalization for b) increased border security in the future. The appealing idea is to let current illegals stay while taking the steps necessary to prevent further waves. The lie is the assumption that, once current illegals get their legalization, pro-immigrant activists in both parties will continue to support the second half of the bargain, the increased security. John McCain, an immigration hawk. Who knew? Mr. McCain, the highest-profile Republican of the U.S. Senate’s “Gang of Eight” that came up with amnesty as the solution to the immigration crisis — and it truly is a crisis — is finally taking a hard line against President Obama for his encouraging the tidal wave of illegal aliens swamping the southwestern border. “There has to be a halt to this,” Mr. McCain thundered Sunday on CNN. “That’s what we want, and the best way to do that is for planeloads of these young people to be returning to their country of origin

Contrary to what those who defend the right to own high-powered assault rifles believe, not all guns are created equal. Due to a combination of availability, portability and criminal usage the following five types of guns are the country's most dangerous. School Shootings: Widely Reported Tragedies Since 2000 - Using firearm trace data from the ATF, as well as FBI homicide records, we determined the types of guns most often recovered from crime scenes and/or used in murders. The numbers are stark: According to the FBI's 2012 Crime in the US data, nearly 70 percent of homicides for which the FBI received weapons data involved the use

It had to come sometime, and it came in one very bad week for the Democrats: that the many big problems with Hillary Clinton and Barack Obama finally grew too great for the press to ignore. Obama in his own different way is heading towards Nixon-like levels of weirdness, as, beaten down by the failures regarding his ventures, he appears to have quit his own job. A.B. Stoddard of the Hill says in effect he has stopped being president and chooses to live in a world of his own, shutting out the problems that have become overwhelming, giving dinners where he talks

Senate Budget Committee ranking member Sen. Jeff Sessions (R-AL) has warned all of his colleagues in Congress that President Barack Obama’s new immigration strategy—his plans to legalize millions of illegal alien adults through executive power—could destroy America as we know it. “I write to inform you of a development that threatens the foundation of our constitutional Republic,” Sessions, Congress’s top immigration hawk, wrote in a letter that was hand-delivered to all 535 members of Congress on Monday and provided exclusively to Breitbart News. Sessions cites a recent report from the National Journal, in which reporter Major Garrett detailed how, despite the ongoing

Attorney General Eric Holder encouraged Americans not to forget race while working for justice and equality in their country. “As it stands, our society is not yet color blind -- nor should it be -- given the disparities that still afflict and divide us.” Holder explained, “We must be color brave, and we must never forget that all are made better and more prosperous if all are given equal opportunities.” Holder made his remarks during a speech at Howard University on Tuesday for the 50th Anniversary Celebration of the Civil Rights Act. “We must take into account not only the

WASHINGTON — It was an enduring image of his presidency: a chastened Bill Clinton walking his dog while wife Hillary keeps her distance as the family leaves town at the height of the Monica Lewinsky scandal — but it was all part of a contrived public-repentance campaign, according to a new book. With Bill on the skids and his wife’s future prospects on the line, it was necessary for the pubic to see the president being punished, said Weekly Standard online editor Daniel Halper in his new book, “Clinton, Inc.: The Audacious Rebuilding of a Political Machine.” “They understood that
