Someone you probably are not familiar with has filed a suit you probably have not heard about concerning a four-word phrase you should know about. The suit could blow to smithereens something everyone has heard altogether too much about, the Patient Protection and Affordable Care Act (hereafter, ACA). Scott Pruitt and some kindred spirits might accelerate the ACA’s collapse by blocking another of the Obama administration’s lawless uses of the Internal Revenue Service. Pruitt was elected Oklahoma’s attorney general by promising to defend states’ prerogatives against federal encroachment, and today he and some properly

The resident has already shown that the provisions of this ´law´ mean nothing. He will simply wave his magic pen and expand the power of the IRS to take money from our bank accounts. It´s in the original bill that the IRS can do this ´in real time´.

The law was supposed to originate in the house, not the senate as per the constitution, and the supremes refused to touch it. So Will´s thesis is unsupportable.

The constitution is whatever 5 guys in black robes say it is.

The four words that threaten disaster for the ACA say the subsidies shall be available to persons who purchase health insurance in an exchange “established by the state.” But 34 states have chosen not to establish exchanges.

Given the bizarre rationale Roberts gave for not striking down Obamacare, I´m not convinced the predictions of other unconstitutional provisions will be deemed unconstitutional by the court.

While Will´s points provide basis for some hope, it´s hardly certain that they´ll be enough to nuke the heinous legislation.

Afterthought to #13 -- And even if we do get Obamacare repealed now, quite a few employers dropped employee health benefits to comply with it. Who expects they will just step forward to reinstate those benefits? And who expects insurers to revert their policy provisions and rates to what they were before ACA was passed?

To use an analogy, the poison has already started the cascade of system failures. The patient may still be living; but she is already lost.

What I´m wondering is whether we´ll suffer an interim period with some mangled approximation of Hillarycare before the whole thing collapses.

The Appellate Court Judge did something interesting in this case.

To appease his liberal friends he found For the IRS saying that they were following the law.

But... he found that those sueing Had Grounds To Sue.

9 our of 10 suits against ObamaCare have been dismissed because the Courts found that the claimant did not have Standing. This Judge demolished that arguement. So, now it is up to the SCOTUS.

On Jan 15 a District Court Judge in DC issued his opinion in favor of the administration and that the Federally operated exchanges are eligible for subsidies too.

Unless the Supremes take up the issue, it´s another dead end, unfortunately but not surprisingly.

Standing, in order to be heard by SCOTUS, requires that Harm must be proven by the plaintiff, OR, that Harm is imminent.

Either way, the SCOTUS has always been reluctant to overturn legislation; but it has happened. In this case, they are asked to reverse themselves. LMAO!

Actually, the entire Supreme Court should be impeached. NONE of them read the bill, I guess their clerks read portions of it..parts that went along with their leanings. Without reading it, they could not render an informed verdict.
360 million Americans depended on the Supreme Court to preserve and protect the Constitution, AND the rights of Americans to be free. They failed, miserably.

#30, the story is that Roberts adopted two children which would be overturned on a technicality if it were contested in court, so in exchange he sided with the admisistration on the ACA. Don´t believe it myself, but then again..

Re #24 -- #8 gives the four words that should be enough to motivate a Congressional repeal ("you can keep it" was a bald-faced lie).

#4 gives the four words that would justify impeaching the petty-dictator-in-chief ("I have a pen" -- sorry, but we prefer the republic to the authoritarian state.)

But #12 gives the four words to which George Will is referring ("established by the state").

Adoption illegal by Irish law because they only allow adoptions through agencies. So not illegal through US law. Word is birth mothers went to a South American country where private adoption was legal which was why adoption took place there.
