Fort Worth hospital ends life

Fort Worth Star-Telegram [TX], by Staff*

A Texas hospital said Sunday that it would remove life support from a pregnant, brain-dead woman following a judge´s order that it was misapplying state law to disregard her family´s wishes. J.R. Labbe, a spokeswoman for John Peter Smith Hospital in Fort Worth, issued a statement Sunday that says the hospital "will follow the court order" issued Friday in the case of Marlise Muñoz. Life support was terminated at 11:29 a.m. Sunday, family members told News 8. Heather King and Jessica Janicek, attorneys for Marlise´s husband Erick Muñoz, issued a brief statement to confirm what happened: "The Muñoz and Machado families will now proceed

I always said I would never want to be hooked up to life support..however, if I were pregnant, that would change..I would want my baby to have a chance at life. Reports about the baby being deformed have been woefully inadequate..why doesn´t the husband want his baby to have a chance to live? A very sad situation, yes, the mother is dead, but the baby was alive.

#2, in the court papers, the hospital itself said that baby would not survive (wasn´t viable) because of the nature of the deformities. And the mother herself was dead, according to the hospital, not in a coma or pvs. It was an awful situation with no good outcome. RIP, mother and child.

#2 was minding her own business. She was simply stating how she feels and asking why the father did what he did. Didn´t see any judgment or ideas on how to get involved in the decision.

This is a situation that can not decide a policy, no good outcome. The mother is deteriorating thus can not provide the fetus with whatever a healthy host provides in this circumstance. News reports (few and non specific) are that the fetus is deformed/non-viaable. I remember (many years ago) my anger at my son for putting my wife into pain during childbirth (normal), this husband lost his wife and the consolation is a child that needs 24/7 attention that may never know who he is. I consider myself "right to life" thus if this fetus can somehow survive the host off life support that would be wonderful and a miracle, if not let this family have peace.

There are only very rare cases when a family should not have the right to make the decision on when to remove life support. This was not one of them. The fact that we can keep an otherwise dead body "alive" does not mean that we should do so.

There was a case in CA several years ago where a pregnant woman was declared brain dead when she was about 20 weeks pregnant. There was a battle in court to determine whether to pull the plug immediately or wait a few more weeks so the baby would have a better chance of survival. In the end, the hospital kept the woman on life support for a some weeks and then delivered the baby.

This case was more problematic because the baby wasn´t as far along and was apparently in poor condition. I´d rather have a law that leans towards protecting the baby and have a judge make an exception in cases like this.

Note the use of the term "brain dead." Seems to me that this term is used when a brain may not be functional, but it is not dead.

The tests for being "brain dead" are extensive. It is not a term used lightly. It means there is no circulation to the brain. There are no brain waves. And includes the brain stem, which manages the most rudimentary functions like breathing.

I am sure they´d be delighted to have an alternative name for this condition. It is irreversible. When brain cells die, they do not regenerate. When the brain cells in the total brain including the brain stem no longer function, they are said to be dead. It is just a matter of time until they liquify.

To further attempt to clarify, when there is no circulation to the brain and brain stem - the total brain - the brain cells die and function ceases. There is no mechanical way to make a dead brain function.

Other organs, like the heart and lungs, can be kept functioning for a period of time with mechanical devices. Nothing can be done about the total brain.

For sensitivity reasons, the attorneys for the husband are not going into great detail about the extent of the abnormalities in the fetus.
But, they do say that gender cannot be determined , which indicates a pelvic deformity, in addition to the
admitted deformity in the lower limbs.
The attorneys for the family said the fetus also has fluid building up inside the skull and possibly has a heart problem.
The hospital agreed with the husband that the wife was brain dead and the fetus was unviable , but, they were prohibited by law from
allowing the vent to be removed.

Last month was a bittersweet seventh birthday for Twitter. The Union of Jewish French Students sued the social-media giant for $50 million in a French court in light of anti-Semitic tweets that carried the hashtag #unbonjuif ("a good Jew"). In January, Twitter agreed to delete the tweets, but the student group now wants the identities of the users who sent the anti-Semitic messages so that they can be prosecuted under French law against hate speech. Twitter is resisting. It claims that as an American company protected by the First Amendment, it does not have to aid government efforts to control

The health of those who enrolled in new coverage is being closely watched because many observers have questioned whether the new marketplaces would attract a large share of sick people, which could lead to higher premiums and ultimately doom the new law.
