One week after a federal judge in Utah held laws against polygamy are unconstitutional, another Utah federal judge has held that the U.S. Constitution also contains a right to same-sex marriage, describing laws defining marriage as between men and women “irrational.” In his 53-page opinion for Kitchen v. Herbert on Dec. 20, U.S. District Judge Robert Shelby—who was appointed by President Obama in 2011—compared marriage laws that do not include homosexual pairings to racist laws. He noted that in its 1967 case Loving v. Virginia, the U.S. Supreme Court struck down as a violation of the Fourteenth Amendment a Virginia law

My test for what is "rational" concerning marriage has always been the "Pitcairn Island" experience. Put 10 gay couples on a deserted island and come back in about 20 or 30 years, and we´ll see how "normal" it is.

Amazing!
The first judge (a Dubya appointee, BTW) basically declared all laws against adultery unconstitutional.
The second judge, a Barry Soetero appointee, has gone completely around the bend. It seems he is divorcing marriage completely from its main purpose of protecting the family (one man, one woman, plus children).
I hope both of these rulings are reversed on appeal.

Not the first Federal Judges foisted on Utah. Last time the judges weren´t followed and went back East complaining until an Army was sent marching to stop the supposed rebellion.

Will be interesting to watch this one. Can´t recall judges and Porter Rockwell is dead and gone and I wonder if the Utah legislature can make a law that the Feds or the big government Democrat won´t make people wish to rebel about.

This isn´t the mid 1800´s in a cowboy wild west America but the American spirit is undaunted if still obedient to the processes of law.

The regime is lawless and the courts seem to be too. They think they can get away with it in beaten down Utah, but in the rest of the country we have just seen backlash against a TV program injustice.

Irrational as judged by the common consensus and dictatorial government the social democrats and humanists are creating, common consensus of the other folks however is never found a justification for tyranny Now is someone could somehow get the sheeple to connect the dots that links Big Government to the Democrats.

Maybe the Robertson´s of the new program Duck Commander and Family could talk for us?

Fantastic. You want the government out of the marriage business? Fine. You got it. Let´s let all "marriages" become whatever people want them to be. You want to marry 5 guys? Go for it. You want to have a traditional marriage under God in a churge? Go for it.

Everyone can marry any one they want and call it whatever they want.

However, if you want the government out of marriage, then you must be prepared for what that means. No more alimony, palimony, child support, no nothing, unless you have created your own cohabitation contract. Both husbands leave you with with the kids? Go fish. Your problem. Wife bail out with your bank account and her new lover? Should have had it written down, and if you did, you are free to go sue her for your breach of contract. Hubby and wife both leave you, the stay at home wife #2, with no visible means of support? Too bad, so sad. You wanted government out of marriage right? So go suck on that.

It´s funny. People want government involvement (save me, theres a flood! my husband owes me alimony!) when it´c convenient for them, and no government involvement (I want to marry my two best friends! I want the age of consent lowered!) when it suits their own wishes or perversions.

Since the left considers any view that disagrees with theirs to be irrational, this means the left no longer considers us to be fellow human beings. They view us in relationship to them as cattle in relationship to ranchers. How can we pretend to carry on dialog with a people that consider us sub-human?

Libs/progs/freaks want the government IN marriage and want us all to be forced to accept any sick, twisted, relationship as marriage.
Oh, and yes they also want custody, support, tax breaks, estate planning rules twisted inside out, and anything else they "feel" they are owed.
This won´t stop even if they start marrying their bejeweled portable snapping Chihuahuas.

I´ve read the Constitution once or twice, and I cant find marriage in it anywhere. No power to regulate, nor any prohibition against regulating it. No sneaky twisting of words like they did with the commerce clause and the Roe vs Wade case. Is it there or not? No it is not. Thus, it is either a state power or left to the people. Federal intervention is completely inappropriate.
Now we have 50 laboratories wherein it can be discovered whether people are more miserable with one spouse, multiple spouses, or same sex spouses.
See? Its not so difficult.

What is irrational is this judges´s blatant violation of the 10th Amendment:
The Tenth Amendment states the Constitution´s principle of federalism by providing that powers not granted to the federal government by the Constitution, nor prohibited to the States, are reserved to the States or the people.

Myron Ullman, Johnson´s predecessor at JCPenney, takes office as CEO. When Johnson was initially wooed by JCPenney, it was to serve as CEO with Ullman as Chairman.
