Fraud is a serious federal felony, usually punishable by up to 20 years’ imprisonment — with every repetition of a fraudulent communication chargeable as a separate crime. I haven´t had my coffee yet, so I can´t cite specific cases, but the U.S. Supreme Court has ruled that politicians are presumptively lying about stuff they talk about - that the public should expect that from politicians - therefore, lies are not actionable when uttered by politicians.

Yes, excellent article, I only wish that Andrew would have extended his description of the damages to the physical. How many people will die because of care denied them? Whether it be that they simply cannot afford the premiums or that the government decides that certain treatments are not covered. I have no doubt that at some point, soon if this is not stopped, the decision will depend on political affiliation.

Well I guess I learned that all the fraud laws in this country do not apply to politicians. If a CEO of a major business promised customers and shareholders what obama did they would be arrested, tried and convicted. Remember Jeff Skilling of Enron? He´s still in prison and obama has done the same thing. This just goes to show that those in DC are above the law, obamacare doesn´t apply to them, they have their own pension plan, etc it is time for the 28th Amendment!

By federalizing the regulation and control of medical insurance the Obots have removed a gazillion small suits over payment, nonpayment, provision of services, nonprovision of services, conversion and dislocation from private parties such as insurance companies, and the STATE COURTS to FEDERAL COURTS.

That was not a sound decision but it may well be meaningful.

As I´ve noted before the federal courts only handle 1/2 million legal actions per year. We are up to 53 million people today who have lost their insurance as a result of ObamaKKKare requirements.

I see disaster in the federal courts!

They are not cut out for this; they aren´t big enough; they are not experienced in these matters; nobody asked them (except Roberts waylayed a bunch of it to flow through The Tax Court first), and although I suspect the country could get along without a whole bunch of the federal judges, it´s possible there is some necessary business conducted there that will end up docketed 100 years from now!

Democrats are so stinkin´ smart ~ imagine what those infirm elderly leftwingtard and commie judges they stuck us with in so many courts are thinking now. They´ll have to work ~ lifting the daily caseload of preliminary filings should give them strokes.

Of course Obama committed fraud. It was a means to an end. Therefore, it was, in his mind, a reasonable and effective way to get what he wanted. Obama is on a mission to push this country into a government run health care system. This is just one of the steps on the way. He will not back down because things are working just the way they need to be. He wants to push the American people to the brink of personal bankruptcy so they will cry out for help from the government. Then he will be there smiling and ushering them into national health care hell.

Has there ever been a clearer case of fraud upon the public; fraud that is resulting in clear and proximate economic harm to hundreds of thousands of innocents?

Could you not argue, even, that fear for life or serious bodily harm as a consequence of loss of health insurance is at issue?

The evidence is clear and abundant. The perpetrators of this fraud have memorialized in internal communications their awareness of the fraudulent nature of the president’s promise and the intentional omission of material fact in his statements.

America must not abide this behavior in the office of the presidency, or the behavior of those who aid and abet it.

Why is anyone with one iota of common sense surprised by these articles and so called revelations of massive fraud, lies, and his continual attempts to destroy and defile this country. The remarks made by an ex Secret Service Agent the other day only confirm his total lack of conscience about destroying peoples lives.

Oh excuse me, I didn´t know this Health Law would destroy the best Health Care system in the world, someone lied to me, it wasn´t my fault, I didn´t know, I know nothing about computers, Michelle made me do it. By the way, I´ll fix everything with Executive Orders. I´ve stopped the embargo against Iran months ago, the Jews will just love that.

Just remember this at tax time. The money you pour into the treasury throughout the year, and every year goes to pay for people on the dole carrying around Obama phones, and voting Democrat from precinct to precinct, every election. But don´t you know, Voter ID is a bad thing.

As an add on, don´t forget those Illegal Criminals who are already voting, demonstrating, carrying Mexican flags and are supported by McCain, Obama, the Democrat Party and some GOP turncoats who don´t have a clue. I have to get some more coffee.

FTA: "...even as he shifts the blame to the insurance companies..."

Please, all you wordsmiths out there, whether in print, on-line, or in television commentaries, please explain to all us poorly informed out here that ObamaCare is the Law, and for all insurance companies to conform to that law, they must make sure that their policies offer the coverage that is mandated by ObamaCare Law; e.g., all policies, must have maternity benefits for everyone, even young single men or 65-year old women. If your old policy does not have the one-size-fits-all coverage, your policy will be cancelled because it does not conform with the Healthcare Law.

Didn´t explain too well, but I hope someone will make it clearer so that another alibi for incompetence or fakery does not get set in stone.

For it was Alinsky who spent his life teaching would-be radicals (like Obama) that you can say what you have to say to get over the hump, but once you’re over the hump, you do whatever you want to do. In other words, it’s okay to present yourself as something moderate, even centrist, for the purposes of securing power, and once you’ve secured that power it is perfectly acceptable to revert to who (and what) you really are.

Having prosecuted fraud for over 30 years, I can verify that my former colleague Andrew is spot on. He is also correct that impeachment is a political process not a criminal process and will not take place for two main reasons: Obama is black and the senate is controlled by the Dims. The latter may change but the former will not. The best we can hope for is to take the senate and hold the house in 2014 and ride out the 2nd term with as little damage as possible.

#11 and #19 your initial analyses are correct except we are a nation of laws - and people - and our founding principle in this country was, and is, predicated on the fact that the politicians work for us and can be fired at any time through various means including uprisings, disobedience, etc.

We are entering perilous times. We have been lucky (or blessed by God) as a nation in the past. I hope God does us a solid at least one more time to get us over this hump - we need to do a lot of praying, I think.

As a sitting president, impeachment and removal is the only option. We would first need to get control of the Senate in 2014 to make this possible. A mighty tall order.

Let´s say for grins that the pubbies gain control and Obie is shown the door in 2016. In this case, he is subject to civil law as a private citizen.

While Obamboozler may get away with his fraudulent activities, his co-conspirators in the House and the Senate are big fat targets for removal in the 2014 elections. 67 Senate seats is probably out of reach for the GOP, but if the could reach that number, then impeachment would become a real possibility. 60 is not out of the question, though, and that would be enough to override a veto of ObamaCare repeal. The GOP needs to fight this next election like there´s no tomorrow.

Laws were in effect suspended on Nov 8, 2008. Rinsed and repeated on Nov 6, 2012. The only recourse is ballot box action that will overcome fraud .

Since Day One of the Won, it has been one big fraud after another. Giving taxpayer money to labor unions to buy votes. Vote fraud conducted by Acorn and other Obama-friendly groups. Giving money to green energy and electric car companies that had no hope of succeeding. Shutting down oil drilling industries to drive gasoline prices through the roof. Shutting down coal mines and car dealerships in attempts to control a private market. Transporting arms to dangerous foreign countries. Refusing to protect our borders. Attempting to take our small arms away in direct violation of the Second Amendment. Using the IRS to intimidate citizens according to political affiliation. Obamacare is just the latest and worst fraud.

Obama himself is too stupid and lazy to have planned all of this by himself but he made an excellent cheerleader. We need to build a list of names of all of his henchmen and take action. Pelosi, Reid, Schumer, Holder, Axelrod, Jarrett, the whole lot of them. The time for justice administered by the people has come since our "government" doesn´t seem to be interested.

Lying by a President is a not legally actionable, but there are many facets
of the O´law that are, such as the Individual mandate ( once even a single individual is financially impacted), the abortion mandate, the contraception mandate, religious freedom actions, tax implications ( no new taxes), and so forth. I believe that each of these matters, and others, are currently in litigation in the Federal courts.

Mere legalities do not relate to the first black President and whatever decisions he decides to make, Obama knows that, and the US Supreme Court reinforced that fact through Chief Justice Roberts decision in the Obama Care case.
