I think about that too #1, but sometimes i wonder if he declared it a "tax" knowing that since it originated in the Senate, this could be contested as unconstitutional on that basis? I´m not a lawyer so i have no insight as to this, but i´m wondering if this was Roberts´ rationale at the time.

No, #2, that doesn´t make sense. If Roberts wanted a means to call it unconstitutional, he already had it and he even said so. That´s why he illegally rewrote the law to call it a tax. If he wanted to law dead, he would have not rewritten anything and just nullified it.

#2, if that were Roberts goal he could have accomplished it at the time by simply finishing the tax argument he started.

To this day Roberts ruling absolutely flummoxes me. Having read some of his earlier rulings, and especially his ruling in the Heller case, I was always struck by his exhaustive analytic process. Yet that same process is notably lacking in the Obamacre ruling.

He did certainly sow the seeds of the laws destruction by setting a pretty rock solid precedant that the feds cannot make funding for one program contingent on accepting another. Important because it stopd the feds extorting compliance. And he also set a HUGE precedant on limiting the commerce clause but still the ruling seemed quite uncharacteristic.

I keep waiting for the aha gotcha moment, but it has not yet come. Maybe he was just too smart for his own good, trying to set up the minority to have to overturn their own ruling in a future commerce or tax based argument but that seems just too gimmicky for a mind like Roberts´. I end up just plain confused.

FTA:"Howard Dean does have a record of telling the truth about Obamacare. He is the only Democrat who has admitted that Obamacare should have taken on tort reform, but didn’t, because the Democrats did not want to take on trial lawyers."

It´s pretty clear that Obama would be pleased as punch to put the entire world on either Obama Care or Medicaid and pay them up to $6,000 a year in subsidies to defray the cost of their health care, or give them "free" health care, with the ever diminishing number of Americans who actually do pay taxes loosing their current health care insurance and paying the freight. The Democrats know that they will pick up a huge number of new voters, many of them foreign born illegal aliens who Obama intends to legalize, by Obama doing that.

This is heading for a massive federal bailout with taxpayer money. That may have been the plan all along but there won´t be enough money. The feds won´t be able to keep taxing the ´wealthy fat cats´. Not enough of them. They will have to tax ALL wage earners horrendously or triple the deficit. This will guarantee a devastating recession/depression or hyper-inflation..

The Dems will, of course, blame it on greedy insurance companies or George Bush.

2. Resist, don´t go to the site, don´t fill out the forms, and for gosh sakes do not send anything to the IRS.

I get the impression obama couldn´t hit his own backside with both arms tied behind his back. The cretins who aren´t getting enough credit for this debacle (democare) are pelosi, reid, and the aforementioned justice roberts. Roberts had the opportunity to save the country and its people and chose to trash his courts credibility for what? Why? I think SCOTUS had been corrupted.

I think the aha gotcha moment will be when Baracky announces that it was declared a tax by the SC…and since only government is allowed to collect taxes, all premium payments to insurance companies or second parties are against the law, henceforth all insurance premium payments will be made directly to the IRS…monthly payments…or quarterly for the self-imployed. All others..it will be withheld from your salary, same as FICA,etc.

Single payer will be here. No fuss, no bother!

It will be another crisis moment when the stuff hits the fan again. Probably the day after the 2016 election.

WASHINGTON — LeBron James wants you to sign up for health coverage under Obamacare. So do Magic Johnson and Jonah Hill’s mom.
