I believe Marco Rubio, Bobby Jindal and Ted Cruz to be “natural born Citizens” and eligible to be President. Here’s why. 1. Summary There are few eligibility requirements to be President. 1) I think it is an absolute embarrassment that the Supreme Court would not touch any of the challenges to Obama´s eligibility and legally define the term to legally end this debate, either way.
2) I think the question that we should also be asking is why are many of the strongest candidates for President, including the last two Republican nominees, people who were either not born within the United States or, in the case of Obama and others on this list, to two citizen parents. Isn´t there anyone with two citizen parents qualified to be President?
Thomas Jefferson´s mother was born in England. He became president. Obviously no one at the time thought he was ineligible. Herbert Hoover´s mother was born in Canada. Whether she was a citizen of the U.S. when her son was born, I don´t know. Barack Obama´s mother was born in the U.S.

Thomas Jefferson was not considered ineligible to serve because he was a citizen at the time of the adoption. The only person to serve by that reason. There were eight copies of Vattel´s Law of nations on the table where the Constitution was drafted. Many participants including James Monroe (esp Monroe)have said that no other text influenced the drafting process and the resulting document more. Vattel clearly defines Natural Born as someone both whose parents are citizens of the country at the time of birth. This is a slam dunk. Having said that I agree that Rubio, Jindal are eligible because both their parents had renounced allegiance to their original country in process of getting a Green Card. That should be sufficient for 2016.
#4 - Martin Van Buren, the 8th president, was the first born to citizen parents. The first seven were eligible because of the following highlighted clause - which became obsolete once we got to Van Buren -

Agree with those of you who think the obvious intent of the framers was that the president be born to citizen parents - plural. Not just a citizen, which is what Hamilton originally wrote, but a natural born citizen, which Jay suggested and Washington concurred.
It is REALLY simple to me: "If both of your parents WERE NOT BORN in the USA, you ARE NOT A NATURAL BORN AMERICAN! Sorry for the yelling but sometimes folks just won´t pay attention. I´ve challanged my ´Conservative Representative´ to bring forth a bill which will once and for all explain the difference between ´Natural Born and Native Born.´ And will also terminate the ´anchor baby issue.´ If one of your parents ARE NOT an American Citizen, neither are you."

Hamilton’s suggested presidential citizenship eligibility requirement was that a Citizen simply had to be ‘born a Citizen’ of the USA, i.e., a Citizen by Birth. But that citizenship status was overwhelmingly rejected by the framers as insufficient. Instead of allowing any person “born a citizen” to be President and Commander of the military, the framers chose to adopt the more stringent requirement recommended by John Jay, i.e., requiring the Citizen to be a “natural born Citizen“, to block any chance of future Presidents owing allegiance to other foreign nations or claims on their allegiance at birth from becoming President and Commander of the Military.. Therefore, the President of the United States must be a “natural born citizen” with unity of citizenship and sole allegiance to the United States at birth.
I respectfully disagree with #5 re - Rubio and Jindal. Whether the parents were going through the Green Card process is immaterial IMO. They were still citizens of Cuba and India at the time of their sons´ birth.

Vattel´s Law of Nations is a book, not a law. It was written in French. The version we read in English today uses the words "native" and "natural born" without distinguishing between them. The version the framers were reading then didn´t use the term "natural born citizen" at all. The word used was "indigenes," which means "natives." "Indigene" is also used to describe vegetation and animals, so unless you can have a natural-born broccoli, it doesn´t mean that.
The passage in Vattel most often cited says that if you are born in a country, of which your parents are citizens, then you are a native/natural born citizen of that country. Vattel does NOT say that is the only way to be a native/natural born citizen. Saying "oranges are fruit" does not mean that only oranges are fruit. Vattel goes on to describe other circumstances where you would be considered native/natural born.
Vattel wasn´t writing about who should be president (obviously). He was writing about the allegiances of citizens to states, and how they are acquired. The authors of the eligibility clause of The Constitution likewise were concerned about allegiance, not lineage.
