The e-mail service used by National Security Agency (NSA) leaker Edward Snowden is suspending operations. And they can’t tell us why — although this cryptic post heavily suggests it has something to do with a government request for information: I have been forced to make a difficult decision: to become complicit in crimes against the American people or walk away from nearly ten years of hard work by shutting down Lavabit. After significant soul searching, I have decided to suspend operations. I wish that I could legally share with you the events that led to my decision. I cannot.

All common carrier and commercial TSPs have to keep records regarding the use of their systems AND sometimes the messages transmitted or on file. Emails kinda´ just sit there, right ~ waiting.

They must do these things to conform to law ~ mostly for reasons of consumer protection ~

I have argued that the laws requiring creation of the records are the problem ~ not NSA. They simply take advantage of what states require.

Unless we eliminate the records you will have every country with the capability spying on everybody!

It is inescapably the case that the biggest complainers about NSA have nothing whatsoever to say about the laws requiring those records to be created.

I wish every internet service that was forced to give private information to the government without a warrant would do what this guy has done. Shut it all down until we KNOW what they are doing to us. These services that comply with these unconstitutional demands are complicit in the spying. They have the obligation to suspend their service if they are forced to become spies.

Snowden is not the traitor. The traitor is anyone who supports these acts of tyranny aginst a supposedly free people.

The traitors are those who go to the State legislatures and demand the creation of the meta data ~

~ don´t create those records and there´s nothing to have NSA or the Chicoms or the Russians or the Germans to try to access.

We all have to watch (well, I guess if you are retired or unemployed) the President´s news conference today which is scheduled for 3 p.m. eastern time. You can catch it on C-span (no commercials) - I´ll watch it on my computer. Let´s see if any member of the press asks the President even one question about this article. They all read the Washington Post, so they all know about it. The First Amendment should be very important to them too.

#13 - Ordinarily, I´d never watch him; try not to listen to him as well, but I thought after his performance on Leno´s show it is important that we listen carefully to his responses (true, everything may already be scripted), and also see how clear-eyed he is. And I am a member of the distaff.

There is no question that Washington DC is Law Breaker, Constitution Smasher, City! And, that all of Congress is on "the take",

Cryptography should be regarded as arms and protected by an amendment similar to the second amendment. "Congress shall make no law abridging the right to encrypt communications." The NSA itself sought to call encryption software "munitions" and restrict its use. It is clear that the founders would have included this in the constitution if they lived today. Mark Levin has been making a case on this point talking about the history of general warrants. We will see if he has something similar to this suggestion in his new book.

Sounds like Snowden had a high enough clearance and sufficient access to have been required to sign away his privilege to maintain a private file of encrypted messages.

Folks who are imagining this guy isn´t a commercial spy and/or saboteur are barking up the wrong tree.

HE HAD HIGH LEVEL SECURITY CLEARANCES. People who have them have legal obligations that come with them. That´s why their holders make the big bucks.

Once you sign away your rights and privileges for money, you´ve signed them away.

You are not protecting my 4th and 5th amendment rights by nosing after Snowden.

To those who say our government is our servant and therefore should neither spy secretly on us nor keep their information secret from us:

Government is indeed our servant, by right, by Common Law, by our Constitution, and by statute. That much is true.

But our government cannot resist our enemies, foreign and domestic, without observing, through secret surveillance, as much as the law allows them to observe.

And where their observations give them even the least bit of leverage against our enemies, our servants in government must keep that information from us until the details (and technology) become irrelevant, though they must keep our Congress informed.

And Snowden is a traitor.

It appears that Lavabit was threatened with something pretty big forcing them to shutdown their email service. Holdie must have come up with another creative interpretation of the law that give Obie/Holdie authority to prevent Snowden from communicating with Putie, at least through this particular email service.
