Obama administration officials are illegally delaying enforcement of a central provision in the president’s namesake legislation in a desperate attempt to manipulate the 2014 midterm elections and swell the ranks of those who look to government for healthcare. The White House is beginning to sense that when Americans realize the price of “free” healthcare, they’re likely to take swift vengeance on those responsible. (snip) Yet in a blatantly illegal move, the Obama administration is presuming to rewrite the ACA by choosing not to enforce provisions that are causing visible problems.

Comments:
Does the Constitution hold no reins on this guy? He chooses what he wants or doesn´t want to enforce (Example: DOMA) and that which he is prohibited in doing, he does anyway (Example: recess appointments while Congress is still in session.)

This will be hard to block. And, IMO, very few want the Employer Mandate anyway. Or other parts of ObamaCare for that matter.

It is hard to push a string. And making a government enforce is worse.

Obama can claim other items must have a higher priority. Say his resources are limited, etc.

Even if the courts grant standing and finally rule against Obama he will have stalled for the better part of a year.

The GOP and Professors can scream about the letter of the law. I expect little else.

The tax (penalty) on those who don´t buy insurance is going to create a huge public reaction. And then the angry citizens will find out that the illegal immigrants aren´t paying the penalty. And they´ll find out that if they live in one of the one of the states that didn´t create an exchange, that the subsidy for low income citizens may not be legal.

The reason the tax (penalty) on employers was delayed, it that it only can be assessed in states with a state established insurance exchange. The first time the IRS tries to collect the penalty in Texas there will be a VERY public lawsuit.

My guess is that the House Republicans will do everything they can to .... help the Democrats postpone the enforcement. What happened to all the GOP boasting about not funding obamacare? Now that obamacare is the law of the land Speaker Boner has done everything he can to get it funded. Time for a third party, to hell with the GOP.

The White House violated the law in forcing this unconstitutional Frankenstein monster on us, in granting waivers to democrat voting blocs, in calling a forced sale a tax, in threatening members of congress if they didn´t vote for it, in secret collaboration with the already-crooked insurance companies and their lobbyists.In short, the whole thing is criminal. I have just decided to delay implementation of my requirement to purchase health insurance until 2018. As I read the law, I have just as much right to do that as the president does in delaying the employer mandate.

The mandate may be postponed but you can bet the farm that the insurance increases by private insurance providers will NOT be postponed. Will it be enough to change votes in 2014 ? I guess that depends on how many people who actually pay for their insurance voted for obama . Everyone who doesn´t pay for anything won´t care any way.

The Democrat KKKongress set up some multi-year funding bills that need to be RESCINDED ~ but the DemoKKKrat Senate and Obamugabe aren´t likely to agree. The House can´t act alone.

On the other hand they can refuse to agree to any continuing appropriations, and, as I´ve predicted, any additional funding for the federal court system that´ll be turned into a rather dramatic traffic court equivalent as IRS seeks to recover $800 penalties from indigent yout´.

Added to the ObamaKKKare mess are some cross transfers of funding ~ which aren´t really Constitutional (since this is all a tax and they can´t appropriate, so they gots´ ta´ go to KKKongress to git de´ money!)

But all of that is trivial next to the thought that Obamugabe figured out he can just stop the functioning of any part of ObamaKKKare at will.

That means he can CUT OFF ALL MEDICAL CARE any time he wants.

First Republican President in office next needs to order a STOP to all medical care for leftwingtards for a period of 6 months. Now I know that sounds like Tough Love, but it is ~ we lub´ dem sooooo much ...... well, only so much, and not a smidgeon more ~ see how they like being kicked around like the bums they are.

There are problems already, though. The lady who works with us has already gotten the news that Blue Cross is cancelling her entire type of policy, the cheapest they offered. I have read that some other insurance companies have dropped people. My insurance has already doubled since last year and I dropped it in favor of using our secondary as our primary policy.

Too late for some people to be “excused.” We’ve already heard the bad news.

Any taxpayer can file under the False Claims act for collection of these penalties.

You´d actually get a big chunk of the money collected if you had your name on a whistle blower suit.

The Constitutional remedy is .. impeachment. Deliberately ignoring laws and refusing to enforce them is a high misdemeanor and crime against the Constitution. For myriad reasons, the House Republicans don´t have the stones to do it - and Big Brutha´ knows it.

Our very wise, and knowledgeable Ldotters have pointed out reasons why Obama can´t Constitutionally delay implementation just on his orders. I would agree that he can´t; however, it doesn´t seem to matter whether he and his decisions are Constitutional any more.

The Supreme Court couldn´t be bothered in 2008 to listen to the volume of evidence that Obama is not a "natural born" citizen as the Constitute requires. When Obamacare was passed in an unConstitutional process, the Supreme Court disregarded the lawful objections of many attorneys general. The cherry on the top was the John Roberts ruling that Obamacare was a tax, which is Constitutionally suspect.

All the safeguards purposefully built into the Constitution have been willfully ignored. I have a feeling that America has gone through something like this before only under a different name. It was called slavery. One point of view was rammed down the throats of the opposition. The Missouri Compromise which led to the Kansas-Nebraska Act, which led to the Civil War. Just read a brief recounting of that history - see if you can identify any characters that may have come back to life.

It´s just this type of actions that I have repeatedly posted that this country desperately needs to have another revolution. It´s time that we retake our government and reinstall the government that our founders intended. And, there changes that need to be made to prevent this from happening again. That can be done without trampling of the freedoms that we all cherish. The main problem is finding those who will step forward and lead the revolution.

@#7: to add to your point, the GOP House has voted several times to abolish Ocare, knowing full well Harry Reid would not take up the challenge. This, of course, is grandstanding by the GOP for public consumption only. If the republicans really wanted this gone the House would pass a new bill abolishing the legislation in its entirety, passing it over to the senate and then publicly hammering the Dems for their inaction.

Regardless, Ocare is here to stay. When it begins to affect individual pocketbooks, Congress may try a piecemeal approach at fixing problems, but they will never abolish it. Nothing govn starts ever goes away.

The House cannot act alone. Harry Reid will not take up any bill abolishing OCare and the Press will not advertise the inaction. There is no way to stop the trainwreck without control of the Senate and then you need 60 votes, and then you need 67 votes to override a veto. Do not needlessly blame the GOP, the House is powerless. Oh, defunding. Remember when Bill Clinton and the Press blamed the GOP for shutting the National Parks? This is a serious problem. Bust your butt to get the Senate so at least Obama can be forced to veto popular bills.
