Justice Anthony Kennedy did the cause of gay marriage no favors when he ruled that the purpose of laws that uphold traditional marriage was to "disparage and injure" same-sex couples. By casting support for traditional marriage falsely as bigotry, he undermined the legitimacy of the holding in the case. Worse, he implictly excused the real--not imagined--bigotry of some gay marriage supporters against their opponents.

Comments:
On the surface, SCOTUS appears to have made a measured, intelligent decision, but Scalia´s dissent and the commentary of others reveals that this was an activist Court decision that demonizes a rather large segment of the population who believe homosexuality to be a perversion of the natural order of things. This is part of the legacy of postmodernism: tear down traditional institutions in favor of what the postmods believe are better, more sophisticated ideas.

It occurs to me that Hispanics seem to have a love of Christianity, especially Catholicism but more and more pentecostalism and evangelic Christianity. All those sections of Christianity are against same sex anything. Does God have a sense of humor and if illegals are legalized will they bring their more conservative Christian beliefs with them? This would make liberal´s heads explode.

I would suggest that the "State" has no legitimate interest in this issue. If there were not a laundry list of "Benefits" due to every fashionable group and protected class no-one would care about the Goober-Stazi´s definition of marriage.

This will prove interesting. The SCOTUS is use to attacking the Judeo-Christian religion. But now, some ´want to make a point´ homosexual couple is going to demand they get married in a Mosque. Then the Court can watch as Homosexuals and Muzzies learn to play. My guess is the Court will use this little difference of opinions to Declare Sharia law the law of the land. Except where homosexuals are involved.

The assault upon traditional values will now grow. The intolerance from the left has brought, in their opinion, great gains so why not step up the game. Despite their lawlessness and militancy they have been glorified by the media, academia and entertainment so it will only get worse with assaults on anyone who does not share their goals.

There is a book that has predicted all of this. It says we will see the day where man hates good and loves evil. Modern liberalism, given power by the Democrat party, is the vehicle to carry this scourge across the world.

I always believed the real purpose of DOMA was to give shelter to Democrats and keep conservatives from pushing for a federal constitutional amendment defining marriage back in the 1990´s. It could have gotten 2/3 of the states to ratify it then, but not now. On the other hand, if it had passed then, it would be a long time from now before 2/3 of the states would vote to amend the constitution again to remove it. Conservatives were snookered by Clinton and the Democrats. What else is new??

There is a strong practical link between childlessness and the social welfare state. Before the social welfare state childless people were often objects of pity regardless of social status and wealth (think Jane Austen) because of the strain they put on other members of the family who were expected to care for them in their old age. Many of those with homosexual inclinations married and had children because family and especially children were security in one´s old age.

What happens to all the gay couples and the childless straights when the social welfare programs collapse? We are heading dangerously close to one worker for one person on social security.

Lurking in the background is a strong belief by Justice Kennedy and the others who voted with him that EVOLUTION MEANS NOTHING.

Rather, they imagine marriage to be nothing but a relatively recent cultural indulgence of little consequence in a modern, industrialized society full of rents by the hour hotel rooms and the backseats of millions of cars.

Actually, human sexual breeding pair bonding is quite an ancient phenomenon. The most recent discussions of the ancient hominids we call Ardipithecus ramidus indicate they were involved in it a good 4.5 million years ago. Further, that this gave us the edge over our competitors.

So which is it USSC, are you a bunch of goobers or do you think science has some answers?

Gay marriage is not only not natural, it was bred out of our kind millions upon millions of years ago.

I´m tempted to offer a cash reward for any homosexual man who was denied the right to marry a female or any homosexual woman who was denied the right to marry a man.
However, as it is that words no longer have set meanings, we could get in the weeds as to who is male and who is female.

Kennedy´s opinion reads like it was authored by Andrew Sullivan. No wonder it drew Scalia´s impassioned dissent (which everyone should read). I can´t imagine that those two justices are speaking to each other very much these days.
