Fox News reporter Jana Winter faces jail for doing her job too well. She´s not been accused of any crime, only of protecting the identity of confidential news sources while reporting an important development in a major national story. A Colorado court has now compounded a pending murder trial with a second legal case, one with profound First Amendment ramifications. The story started on July 20, 2012, when James Holmes walked into a midnight showing of the Batman film “The Dark Knight Rises” in an Aurora, Colo.

This isn´t a new issue. People have the right to say anything they want under the First Amendment but that doesn´t mean that a subpoena can´t reach the source of their information if it´s relevant to a trial. Putting aside the very difficult issue these days of precisely who is a reporter and who isn´t when lots of blogs are far better quality than newspapers, there´s absolutely no reason for a reporter to be exempt from the laws to which the rest of us are subject - including the rights of litigants - civil or criminal - to obtain information relevant to their cases. Fox knows this though I can´t blame them for trying.

Sorry, #2. Colorado has laws protecting reporters from revealing sources. FTA:

"In Colorado, there are other circumstances in which the Shield Law may not protect a reporter from divulging to a court information or its sources. First, the information has to be directly relevant to a substantial issue in the case. Second, it must be shown that the information cannot be obtained by any other reasonable means. Finally, the interest of the party seeking the information must outweigh both the First Amendment rights of the reporter and the public’s right to receive news information. All three of these conditions must be met."

The only thing relevant to the case is that the shrink TOLD THE COPS Holmes was "homicidal." And they didn´t do anything.

It´s not relevant, but it is inconvenient to libtard gun-grabbers. The reporter must be punished for stepping on liberal orthodoxy and revealing the doctrinaire idiocy behind their "gun control" noise.

Wasn´t Judith Miller of the NYT tossed in the clink for something like the same thing. Didn´t do her much harm. When she got out, she got a better gig at Fox News.

A Tennessee high school has decided to revise its field trip policy after a group of freshmen were taken to an Islamic mosque where they were given copies of the Koran and while a student who opted out of the trip was given a worksheet that alleged Muslims treated their conquered people better than the United States treated minorities.
