defying gun control measures

Supporters of the 380 sheriffs in 15 states who so far have vowed to defy new state and federal gun control laws claim that legislation is starting to pop up around the nation to fire any state elected or appointed law enforcement official who doesn´t obey federal orders. The first effort emerged in Texas. Legislation proposed by Dallas Democratic Rep. Yvonne Davis would remove any sheriff or law enforcement officer who refuses to enforce state or federal laws. What´s more, it would remove any elected or appointed law enforcement officer for simply stating or signing any document stating that they

Turnabout being fairplay, I suppose we´ll soon be seeing similar legislation dealing with the federal executive´s dereliction in prosecuting our laws regarding illegal immigration, existing guns laws, DOMA, & etc. . .

Our allegiance is to the Constitution and to the men who died in the creation of this free country, not to the federal government. We will welcome those many loyal state and local law enforcement officers to our side when the time comes.

Slavishly ´following orders´ didn´t excuse Nazis from being convicted of war crimes. Nor will being a police puppet to unlawful statutes. But following one´s conscience may nonetheless carry consequences sometimes severe. That said, I seriously doubt that Democrat Rep. Yvonne Davis´ proposal stands a snowball´s chance of succeeding. The use of political power to control police has limits - particularly in Texas.

A sheriff is an elected official under state law, so I doubt the Feds can do anything about that. But, then, we are dealing with Libs whose brains have been invaded by space aliens.

The chances of any state bill proposed by a Democrat in Texas has just about zero chances of ever getting passes. ESPECIALLY a gun control bill.

We´re just waiting for the feds to start trying to get local law enforcement to start enforcing immigration laws!!

Besides which, Texas sheriff´s are elected officials and - unlike some states like Colorado - very difficult to remove from office under Texas laws. For starters, they would probably have to be indicted, WHICH ... in Texas, unlike most states, MUST be rendered by a Grand Jury.

IMHO, any Sheriff who DOES follow any unconstitutional orders from any federal level should be fired. Our County Sheriffs are our highest law enforcement official at the local level - no AG can do what they do.

Seriously, any anti-Second Amendment/gun control legislation from any Democrat, in Texas or anywhere else, ought to be, uh, shot down, shall we say....

This won´t fly in Texas, but other states will start to pick it up now. The memo has gone out.

I only wish some Republican somewhere would reciprocate where it´s REALLY necesary. Those who take an oath to uphold the Constitution should KEEP that oath. (Cue Oathkeepers....)

I can think of one sheriff the feds would love to get rid of...ASAP..
I was taught that the sheriff has juristiction over all federal laws...so of course they have to change this to control law enforcement..and there would be no leader for police officers if there were violence. and I bet the sheriff would be replaced with their own people..
I have to wonder just why the democrats are doing this to Americans. What is in it for dems...money...power..why are they giving this country over .... I sure dont understand it..

This adds validity to the conspiracy emails that are making the rounds that bamboozler is replacing military leaders with ones who will fire on US citizens. The socialists want everything their way with no defiance, bucking, resistance, insubordination, etc. They want absolute capitulation and compliance. Just look at Bloomberg´s stance on the soda wars as a model, says he isn´t backing down even after a judge slapped him down. Well one day it´s no longer going to be a war of words and I´m actually looking forward to getting my feet wet. And since the Feds aren´t following the constitution/cherry picking which laws they follow they can expect the same treatment as in no trials and a trip straight down to the Iron tree/Oak tree at the town square.

Obama won´t lift a finger to engage US enemies overseas except for button pushing drones and now all of a sudden he thinks he´s going to steam roll the American public with his misguided police state?! Ha! I don´t think so. He can´t run a nation, ruin this nation, fix this nation´s economy or win a civil war. He´s impotent, period.

Dear Ms. Davis,

Your position regarding civil disobedience baffles me. You seek to punish good men and woment who have simply stated that they will uphold the Constitution of the United States and that they will not enforce laws that run counter to it. To me this is a noble objective. If Bull Connor (Democrat-Alabama) had held to this standard, Dr. Martin Luther King may never have seen the inside of a jail.

But your position is even more troubling than that simple observation. Why are you not concerned with the failure of Federal Official to enforce Federal Laws? The ATF allows illegal arms transactions to occur, straw party sales that they knew were going to be illegally exported to a neighboring country, and the Department of Justice does nothing. The Voting Rights Section of the Department of Justice is presented with clear and compelling evidence of public intimidation of registered voters, and it does nothing. They were also presented with clear and compelling evidence of vote fraud in Missouri, Ohio and Florida, yet they do nothing, not even a public repremand to the various Secretary´s of State for their failure to combat a long term scourage of our Republic. Fnally, as a legislator in a border state you have certainly witnessed the catastrophic impact of the failure of the INS / ICE and Border Patrol to actually control our sourthern border.

In summation, shouldn´t you be supporting your local and state officials in holding the Agents of the Federal Government accountable for their failure to protect your constitutents? Instead of punishing your local officials for upholding their oath of office?

Any elected person takes an oath to protect and defend the Constitution of the United States.
By proposing such legislation Yvonne Davis is in violation of her oath and not fit to serve. She should be impeached and pending the outcome of impeachment, recalled by the voters of her district.

#6 Correct me if I am wrong but, a Sherrif is not only an elected official but, is also an employee of the county not the state.

As such, the only one´s that can fire them are the counties. Same goes for city and township police.

I believe that Sheriffs are ELECTED law enforcement officers and are the SENIOR law enforcement officers in their counties.

It is not in the scheme of things that the Executive branch of the federal government has the authority to fire a sheriff.
