On Mar. 8, reporter Carl Cameron on Special Report on Fox News Channel was surveying potential GOP 2016 presidential candidates. Then he raised Ted Cruz--one of the most brilliant constitutional lawyers ever to serve in the Senate- the new 41-year old Hispanic senator from Texas. Cameron added, “But Cruz was born in Canada and is constitutionally ineligible” to run for president. While many people assume that, it’s probably not true. Cameron was referring to the Constitution’s Article II requirement that only a “natural born citizen” can run for

The author writes that he doesn´t remember McPain´s eligibility being questioned but there were numerous stories and challenges because of his birth in the Canal Zone.

Our daughter was born in Mexico, she is eligible tobe President under our laws since her mother and father are citizens and were temporarily living outside the country.

The author is correct that the stories should put the preponderance of proof on the shoulders of those who come up with claims that birth to an American citizen who is residing abroad somehow makes one ineligible. The existing law does not support that interpretation. It is a reason I thought questioning BHOnehead´s citizenship based on where he might have been born was a waste when there is little question of his maternity. The burden to prove he had renounced his citizenship or lost it has been on others and interesting stories are woven but not accepted by those who tens of millions elect our president.

Barack Obama´s father was a British citizen. And, despite the famed long-form birth certificate he released, we still don´t know where Barry was born.

It is NOT where you were born. It only matters the BOTH of your parents were US Citizens at the time of birth.

That is per the US Supreme Court in 1875 defining Natural Born Citizen in the Minor Case.

That is it. The debate is over.

#4, has the right of it, since the first congress said the same thing - it´s in the congressional globe. Anybody can look it up and read it if they want to know. Both parents citizens at time of birth means you´re natural born - that was the definition the founders were using when they wrote the constitution. The first congress specifically mentioned being born ´across the seas´ to parents who were both American citizens. So location doesn´t matter, your parent´s citizenship at the time of birth does.

Odd then that the Constitution states "natural born citizen" as a requirement for the pres & vp only. I guess they were just being silly!

Native born = born on us soil (like anchor babies)

Natural born = born on us soil to 2 US citizen parents.

It needs to be defined finally by the court.

Chester A. Arthur was James Garfields VP candidate in 1880. His qualifications were questioned because his father was an English citizen at the time of his birth.

John Fremont, the first Republican candidate for President in 1856, was born to a mother who was a US citizen and a father who was a French citizen. That was well known and never contested.

Bottom line is there isn´t a court in the land that would rule Rubio, Jindal, Cruz or Haley ineligible. Does that mean people who think otherwise will refuse to vote.

Natural born citizens have two US citizens as parents. If born on US soil, it is indisputable. A military base or embassy overseas is US soil.

That said, Ted Cruz does not qualify. Neither does obama but he is the President.

Ted Cruz would make an outstanding US Supreme Court Chief Justice. To me, that is his "best" next job.

#4: In 1875, the SCOTUS ruled that a person born of two US citizens is definitely a "Natural Born" citizen. It did not rule that a person needed two US citizens as birth parents to qualify as a Natural Born citizen.

There´s a big difference between the two. The court knew this and noted that fact in it´s written ruling along with the statement that that aspect of the constitution would have to be decided in some future court case.

Cruz is a Constitutional scholar, and apparently a remarkably accomplished one. If anyone knows if he´s eligible, that person would be Cruz himself. Any decision he makes about whether to run for the presidency will be predicated on that. If he´s eligible, and he wants to run, he´ll do so. If he´s not, and he doesn´t, he won´t. He probably would make an excellent Supreme Court justice, as one poster suggested.. My assumption--and I could be wrong--is that he´ll continue to serve Texas and the larger interests of the United States in the senate for a while. At his young age, he has a long career ahead of him.

John McCain´s citizenship was not in question because he was born at Coco Solo Naval Air Station in the Panama Canal Zone; at that time of his birth, the Panama Canal was under U.S. control. #10 is correct -- U.S. military bases everywhere are considered sovereign U.S. territory.

Now, if #4 is correct, then we can rule out Marco Rubio, whose parents were NOT U.S. citizens at the time of his birth, regardless of the fact Rubio was born in the U.S.

But keep in mind that, in many countries, if a child is born to U.S. citizen parents, that country may still consider you to be a citizen of that country, even though the parents will obtain a U.S. passport for that child from the Consulate. If I recall correctly, when the child turns 18 they can choose whether or not to retain their dual citizenship.

Ted Cruz´s mother was an American citizen. His father immigrated during the Cuban Revolution. I have been unable to find reference to him becoming an American citizen or not. However, any Cuban touching the shore of the U>S> can remain here for life. The parents were working in Canada, there were not emigrating to Canada. Any reference to ted Cruz´s father´s
citizenship would be appreciated.

Look it. The RULES of this game are that whomever/whatever the dems run, the republicans match with a slightly less appealing candidate that carries the same baggage. THEN we move on to discounting the dems baggage and emphasizing the republicans baggage. And voila, another dem is elected.

Let´s determine once and for all if according to law, real law not that crap our politicians spout, if Obama is a legal POTUS. If he is not every bill he signed, every regulation his administration made, every appointment he made and every executive order he issued is NULL and VOID. BTW I think the entire ticket would be invalid and that would be good because Biden is so totally stupid he would be just one more disaster the dems have forced on us.

That would keep congress busy for a good long while and maybe give the nation a chance to recover.

The interesting thing is the thought that Cruz is a potential 2016 candidate. He must have at least a few libs nervous.

Yes, there was the brief kerfluffle (sp?) over McCain; George Romney was born in the American Embassy in Mexico, I believe--that was determined to be OK. Barry Goldwater was born in the Arizona Territory, not the US. It wasn´t a state yet; that counted.

He does have a flaw tho; he´s a republican. As noted by some posters, if he were a Dem he could have been born in Klingon and that would be OK.

OP - It´s really a shame that the Supreme Court hasn´t made a definitive statement on the meaning of "natural born". Congress has a share of the blame, too. Obama is the result of both dropping the ball, each for selfish reasons, IMHO.

It seems pretty clear to me that "natural born" was very important to the Founders who crafted the Constitution. They had real fears that a disloyal president would be elected and all their efforts at founding a country based on freedom and liberty without the chains of "slavery" to another country would be abolished.

Just remember, the authors of the Declaration of Independence and the writers of the Constitution would have been hanged or worse if their idea hadn´t worked out. They felt it necessary at the end of the Declaration to take an oath to each other:And for the support of this Declaration, with a firm reliance on the protection of divine Providence, we mutually pledge to each other our Lives, our Fortunes and our sacred Honor.

Maybe "divine Providence" is leading us along on this - we really desperately need His smiling face to shed His light on US.

If the child is born abroad to one citizen and one alien parent ..."for birth between December 24, 1952 and November 13, 1986, a period of ten years, FIVE after the age of fourteen are required for physical presence in the U.S. to transmit U.S. citizenship to the child." Obama was born 08-04-61, his mother 11-29-42. She turned nineteen in November 1961. That´s why he needs that fake HI passport to even suggest he´s native born.

This provision of the constitution is broken. The founders wanted to have a president who was loyal to the founding principles. Obama is clearly a red diaper baby. He was raised by Frank Marshall Davis. Obama Sr was away for all but a few days of his life. The thesis that the real father was Frank Marshall Davis is convincing. He should never be president because of his many lies and most of all because he is alien in his mentality to the founding principles of the country. Dear Sir,

The House of Representatives has had two shots at preventing Obama to be sworn in as President, just prior to his being sworn into office--they failed to act at either time. Under the 20th Amendment they are required to examine the President´s qualifications for office, which requires only a majority vote of the House.

His birth certificate proves he is a Citizen of the United States. If you read the qualifications for President under Article 1, Section 8, you will note the requirements for a Citizen of the United States to be President. You will find they all had to be born before 1788, when the new Constitution containing that requirment went into force. He is not old enough to be President.

Only those people who are "natural born citizens" are legally qualified to be President. If you will check his birth certificate, you will note he is also a British citizen, having been born of a father who was a British Citizen. Albeit, his father has renounced his British citizenship, Obama has not.

The Congress is required to enforce the Law of Nations, and has done so a number of times, as a brief examination of the cases will affirm. They also define what a Natural Born Citizen is, as well. Both parents must be born in the country of citizen parents.

I sent the above data to two congressmen, but have not had a reply. I don´t know if they bothered to affirm the 20th amendment, or not.

The Supreme Court has refered to ´natural-born cititzen´ in a handful of cases, each time readdressing Vattel´s original definition.

This reference is perhaps the clearest:

#4 is grossly mistaken, as is everyone who relies on Happersatt (1875) Wong Kim Ark (1898) overruled Haeppersatt, and held that anyone physically born on US soil IS a natural born US citizen (a citizen at the moment of their birth) no matter *what* the nationality of their parents is. (Both of Wong Kim Ark´s parents were Chinese nationals who had gone back to China, but he was still declared a US citizen solely by reason of the location of his birth)

That´s been US law for 115 years now, like it or not. That´s where "anchor babies" come from. If you want to make things different, you have to amend the Constitution.

The US Supreme Court will NEVER hear another case on this matter without that because they have considered the matter settled for the last 115 years, and they do not care to reopen it.

#44 and others - The Wong Kim Ark case determined that ´anchor babies´ are citizens, yes, but NOT natural born. The constitution doesn´t say 35 yrs old, resident in country for 14 years, and citizen - it uses the limiting qualifier ´natural born´ citizen - born of 2 parents, both of whom are citizens. In other words, a citizen may hold any political office except Pres/VP. The executive is reserved to a person who is at minimum a 2nd generation American, a ´natural born´ citizen.

1. Both your parents must be U.S. citizens at the time of your birth.

If both parents have to be eligible, then either two things are possible. One, Obama should be declared ineligible by a court and forced to step down. Or two, since there apparently is no way to get this issue into court and no way to get a court to decide it, it is left up to the political process. In other words, if you think Ted Cruz or someone else is ineligible, don´t vote for him.

Ever wonder why the term naturalized is used when a legal immigrant achieves citizenship?
Correctly interpreted that indicates the person is NOW equal to a natural born citizen. Their children are natural citizens and under US law that interprets as "born of the soil" all babies born on US soil are natural born also.
That can be difficult to accept especially since most of our states originated under British common law that ruled citizens were born of the blood meaning the father´s citizenship does not apply.
Now since American mother´s have constitutional rights their children are natural citizens no matter where the dad might have originated.
Do you remember the screams that the first test tube baby wasn´t a citizen ?

John McCain was vetted by a Senate committee, which examined his circumstances
to see if he was eligible as a "natural born citizen" and found him to be so.

No one could address this issue regarding Bammy because that would be racist.

The unemployment rate, because of a terrible statistic, is down to 7.6%. The number of people in this country who are not working is shameful. Ninety million Americans are no longer in the workforce.
