| One of the necessary features of any law is enforcement. Taxes are laws, and if you don´t pay your taxes, the government swoops down on you like a raptor on a rodent. You then must either pay up or prove that you don´t owe the money the government says you owe. Otherwise, government can garnish your wages, take your house, or maybe even put you in prison. None of that applies to the "tax" that Chief Justice John Roberts "discovered" in the Affordable Care Act, which the legislation had mistakenly labeled a "penalty" for noncompliance

Even if the penalty is a "tax" as per Chief Justice Roberts, it´s not a tax that the Constitution permits the government to collect. The federal government can only collect taxes that are prorated among the states on the basis of population or on incomes per the 16th Amendment. Only by employing some really extreme judicial gymnastics can the good judge make the tax/penalty satisfy either of those requirements. The government does collect a plethora of "fees" but it doesn´t call them taxes (even though they really are taxes). And it can collect penalties as the result of civil or criminal prosecution.
If the only enforcement mechanism that the goverment has is refund forfeiture, no refund is easy to arrange.

Roberts is an absolute idiot! He violated his oath also. Judges do NOT write laws. He has damaged himself and the court beyond recognition. His opinions will always be suspect and nothing to the debate.

Before America embarks on changing the concept of marriage, I hope they will at least agree on examining cultures that do not define marriage as a covenant between one man and one woman. During the highly publicized exchange between Bill O´Reilly and Laura Ingraham on gay marriage, O´Reilly made this statement: "There are Bible thumpers, and all they do is say, ´I object to gay marriage because God objects to it.´ You don´t win a policy debate in America with that." Really? Before central control out of Washington was imposed in 2003, policy arguments for criminalizing homosexual acts were won explicitly "with that." And because of "that," the idea of gay marriage has been unthinkable throughout the history of the American nation.

It´s one thing for President Obama to be cocky and overstate his prowess at governing. People are used to politicians grabbing credit, and besides, you can always rationalize when it comes to explaining why things didn´t quite work out as you claimed they would - "the sequester ate my recovery" being the latest successful-enough example. But sports is something else. The basketball either goes through the hoop or it doesn´t. That´s why President Obama´s history of braggadocio regarding his prowess at hoops is having a potent effect on his overall public image, especially with those who are favorably inclined to him.

During his two day flurry of fundraising in Northern California, the President of the United States took it upon himself (and allow to be released to the public - not all of his fundraising comments make it to the masses) to praise the attractiveness of Kamala Harris, California Attorney General (snip) The remark, predictably, generated a little of what Allahpundit called a ´Blue on blue food fight." I suspect that was the intention. The president´s image as a manly man took a beating when he missed 20 of 22 basketball shots, all recorded on video.

The CEO of Starbucks basically told a shareholder that if the shareholder believes in traditional marriage he should dump his Starbucks stock. Historically the job of the CEO has been to make money and increase shareholder value. It would seem telling people who don´t share the CEO´s personal beliefs, whether it´s gay marriage or abortion, to dump the companies stock is not a pro-shareholder action. North Korea’s young leader Kim Jong-un is waiting for United States President Barack Obama to make a phone call to Pyongyang to discuss easing tensions on the Korean peninsula, according to Russia’s news agency Itar-Tass. Recent research indicates that the number of people who do not consider themselves a part of an organized religion is steadily on the rise. Interestingly enough, though the number of those religiously unaffiliated is increasing, there is little to no trend in the number of those who express atheist or agnostic beliefs. People aren’t saying they don’t believe in God. They’re saying they don’t believe in religion. They are not rejecting Christ. They are rejecting the church. This begs the question, “Why are we losing our religion?”
