It’s like dropping a Ford Pinto engine into a totaled Ferrari body, patching it up and then selling it to some unsuspecting dupe as a “brand new Ferrari.” “But Republican governors are folding like cheap lawn chairs,” you say. “And political eunuchs in the GOP establishment are bowing to Obama like he bows to foreign dictators. Any hope of repeal is long dead, and besides, Chief Justice John Roberts put the final nail in the judicial coffin last summer, didn’t he? Any chance of killing the Obamacare zombie is gone, right?” Wrong.

The tax challenge is the most interesting of the four, particularly in light of Roberts opinion during the last go round. The Supreme Court is not a backstop for every passed ball that the legislature is too lazy to properly construct, but Roberts left the door open for a challenge on tax issues. That would mean shutting it down in its entirety.

Matt Barber has more faith in Roberts than I do.

The origination clause might be tough to prove, but the religious exemptions are anything but ambiguous. There is so much that is clearly unconstitutional about Obamacare, that I´m not resigned to accept this as the law of the land.

I haven´t heard anything about Liberty Counsel´s motion. If any LDotters know what´s going on, I´d love to know more. It´s good to keep hope alive.

I have always believed there is a link between Roberts deeming it a tax and the waivers for those by decree don´t need to pay the tax...I have no kudos for how Roberts came to his decision but I do believe there is just enough here to keep the topic front and center

I would love to believe we have a chance to kill Obamacare. Every reason listed in this article is entirely valid....

....but Obamacare was quite obviously unconstitutional the first time around, and for some odd reason, John Roberts simply refused to acknowledge this fact.

Perhaps Roberts gets a perverse charge out of occasionally raping the Constitution.

Perhaps someone has pictures of John Roberts and his boyfriend.

Whatever.

He has already demonstrated that he can´t be trusted on any serious issue. Given this fact and the fact that Obama just stacked the Supreme Court with two America-hating lunatics in Kagan and Sotomayor, I still don´t like our odds.

John Roberts, my hatred for you is boundless. The average twelve year-old possesses far more sense and far, far more HONOR.

I don´t think Roberts is gay, but even if he is, at this point, I seriously doubt that he would really care if he´s outed. He´s the Chief Justice of the Supreme court....for LIFE. Why would he really care if he´s outed in this day and age. And big whoop if he is.

First of all, Roberts might just be making his ruling based on the constitution. After all, the damn thing is a tax; it is going to go on your 1040 (if you have to pay the penalty for non-insurance).

Still, this could also be strategic. There is a way that this might play out very much to our liking. If this thing takes long enough to unfold, Obamacare might be overturned and then we see insurance rates DROP in response.

I´d love to see the MSM try to spin that.

FTA: I wonder if that was his strategy all along.

The day after the Supreme Court ruling, this was being talked about on Rush or Hannity, if memory serves...the possibility of a Roberts decision that deliberately opened the door to the unconstitutional tax bill that would totally defeat Obamacare. Is Roberts that smart and that shrewd and foxy? Sure hope so. If so, and the court rules this time to defeat Obamacare, no one will be able to say that the court rendered a decision based on political leanings of the court, one way or another.

Were the critters even aware the Supremes ordered another look at Obamacare or were they too drunk on supposed power for life and attempts to destroy the GOP to notice.
Obama did not stack the Supreme court with his women..He did replace outgoing extreme liberals with the same type of vermin.

Hopefully, Roberts will do the right thing this time around and pitch the entire bill into an incinerator. The problem is, a great deal of damage has already been done which cannot be recovered, which was sadly extended by the foolish decision last June.

For those that just can´t stand Mark Levin´s loud passion for his country- you may be interested to find out the large part his Landmark Legal Foundation has played in this battle. Just something he does when he´s not trying to turn off conservatives with with all that yelling.
