| The House Republican leadership has scheduled a floor vote on Thursday on a Senate version of the Violence Against Women Act that, if enacted, would strip constitutional rights from Americans prosecuted by Indian tribes for alleged acts of domestic violence. The bill was sponsored by Democratic Sen. Patrick Leahy of Vermont, and opposed by the conservative bloc in the Republican Senate Conference--as well as by Senate Minority Leader Mitch McConnell of Kentucky and Sen. The rights guaranteed by the Constitution are under enough attacks. This makes the problem worse. Once a person is stripped of US citizenship they may be beyond the legal Pale of protections and may be dealt with in any way by "the authorities". I have recently read that there is at least one secret British Court which strips British citizens of their citizenship, after which some have been murdered in drone attacks. Declaring a person to be a non-citizens makes them "stateless persons" so they can be disposed of at will.

I read the first paragraph to see its the Senate version so of course it is un-Constitutional. Voting on it does not mean they support it unless they vote for it.

Makes no sense at all. You can´t repeal the Constitution or protections under the Constitution with an act of the legislature - you have to amend the Constitution. And there´s nothing in the Constitution that allows us to take away constitutional protections for trial by tribes. They can´t deny due process any more than they could say the First Amendment doesn´t apply on an Indian reservation. This is silly and stupid.

I´d say this will never stand once it gets to SCOTUS, but John Roberts destroyed my faith in their doing anything right ever again. Where on earth did this travesty of a bill originate? And why? Allow me to offer an example that shows the problem.
If you are driving on the NYS thruway between the Pa border and Buffalo, you will see signs claiming that you are in native american territory, under the jurisdiction of the tribe. And let´s say you exit the thruway, and go into an indian gas station, and are accused of some sort of violence against the clerk at that gas station.
You would be under the jurisdiction of the local indians.

And the same thing could happen at one of those indian casinos in nys, which are allowed to operate because they are located on indian territory. Levin talked about this in detail this week. This legislation would elevate bad language to the level of an assault. And once convicted, you cannot own firearms any longer. Oh, and it allows foreigners to claim a need for asylum. There´s nothing good about this bill, and they wrap it up in a fake name as a way to bully people into voting for it. Two-thirds of Democrats now believe Obama´s health care reforms will either hurt them personally or have no effect on their daily lives, a Quinnipiac University poll released Thursday shows. The unemployment rate, because of a terrible statistic, is down to 7.6%. The number of people in this country who are not working is shameful. Ninety million Americans are no longer in the workforce. Ninety million. People not in the labor force grew by 663,000, and now 90 million. That´s the labor force participation rate. This is 1979 levels.
