So the guns that were stolen via a burglary thanks to the idiots at NY Journal News publishing a map showing the addresses of the owners - - can the publisher/editor/staff be held liable if/when those guns are used in a crime?
As long as you took steps to safeguard the weapons such as leaving them in a safe when you are out of the house you should not be held liable. It is one thing for someone to steal them when you have taken reasonable steps to secure the weapons. It is another thing completely for someone like lanza´s mother to just leave them in a close unlocked when she had a psychotic son. But yes, lawyers would screw this up as well.
We need to carefully differentiate between mental illness (for example, somebody with depression "the common cold of mental illness") and phychosis or delerium. They are VERY different. The unintended consequence of lumping them all together is to freeze out people who have very treatable cases of depression from going to the doctor for fear of being stigmatized.
Weeding out the ´what if" scenarios that people always come up with, the proposals actually make some sense to me. If I am right, and they do make sense, then rest assured they will never be passed into law simply because they don´t ban any guns and banning guns is the ultimate goal of our communist controlled federal government.
Wonder how long it will be before I am hunted down and silenced for pointing out the obvious direction our federal government is headed?
Lawyers already have sufficient excuses to sue. We don´t need new laws. Whenever you have a criminal offense with really minimal penalties, you create the opportunity for a lawyer to go to civil court with the guilty or no lo contendere plea as an opportunity for collecting big bucks.
When the burglar, thief, rapist, murderer, etc enters your home and your weapons are in a safe, you are had. Makes sense to keep away from kids but your weapon must be handy and ready to fire if you are concerned for your safety. Have a safe to store them when you leave the home.
The duty to store guns so that unauthorized persons cannot access them does not make any exception for a gun “on duty” for personal protection. That is the gun you most do not want to fall into the hands of an unauthorized person.
