According to a background briefer provided by the White House, President Barack Obama is asking doctors to help deal with guns. Here´s the relevant passage: PRESERVE THE RIGHTS OF HEALTH CARE PROVIDERS TO PROTECT THEIR PATIENTS AND COMMUNITIES FROM GUN VIOLENCE: We should never ask doctors and other health care providers to turn a blind eye to the risks posed by guns in the wrong hands. Clarify that no federal law prevents health care providers from warning law enforcement authorities about threats of violence: Doctors and other mental health professionals play an important role in protecting the safety

Oh goodie. I can just see my doctor doubled over with laughter at this latest insanity as he zooms from examining room to examining room because he is a board certified internist in Southern California who has a large caseload of Medicare patients--not sure that he´s accepting any new ones. O keeps talking and my doctor will take early retirement.

I asked the doctor I go to about that when Zerocare was first foisted on us. He said he would never ask in the first place. He said it was none of his business.

As a health care provider this concerns me greatly.

Am I now liable for a patient that commits gun violence? Will I be sued if I don´t report to the authorities and something happens with my patient?

I suspect I could be liable if it is now incumbent upon me to ask and document whether they have a gun at home, where the guns are stored, where the ammunition is kept etc.

I suppose I could chart "patient denies access to any guns", after telling the patient "I am supposed to ask you if you have access to any guns at home, because I have to report that to the government. You don´t, do you?"

It´s not like I am going to administer a lie detector test. I can´t control whether patients tell me the truth--I can only document what they tell me.

All you doctors out there look on the bright side! You are not supposed to make a living by curing illness so now you could be allowed to get yourselves some income on the side by reporting gun owners to the government. Government work pays well and it could support you while you undertake the volunteer work of healh care provider.

Perhaps Dictator would like to assign an ATF agent to each doctor. They can hold hands during surgery so the agent can capture the bullet fresh from the wounded individual..../s/s/s

#12 - when I worked trauma, there WERE in-hospital ATF agents that would observe bullets being removed--they would also collect them for evidence. It was so there was no mixup about the bullet during any criminal prosecution.

My husband and I refuse to answer questions about guns on those medical forms. Period. One doctor actually agreed with my husband that the question is inappropriate.

Doctor´s are already being required to ask a long list of personal questions of patients in order to comply with 0bamacare, including, ´´Does you house have a second story.´´ Now, 0bama adds this to the list?!!! How invasive of privacy can the dem pols get?!!! ...Enough already!

I never lie to my doctors. When they ask how often I exercise I say "I don´t exercise.", when they ask I´m getting enough calcium or veggies I say, without hesitation, "No.". I think my frankness surprises them but I figure it´s best they know the truth. However, being a gun owner has nothing to do with my health so if/when I´m asked I will refuse to answer or maybe, I´ll lie.

Exactly how will this actually prevent any killing? Does anyone believe people are going to be arrested or committed based on report of threat? This isn´t even a new law or proposal, obama is merely deflecting potential blame to physicians, and likely spawning a new class of malpractice lawsuits based upon notfollowing HHS defined best practices in interrogating and reporting patients based on gun ownership....this is a nightmare.

His 2nd Order should raise eyebrows ,too.
Actually, cause them to fly off.
2. Address unnecessary legal barriers, particularly relating to the Health Insurance Portability and Accountability Act,
that may prevent states from making information available to the background check system.

HIPAA has many draconian orders , like demands that all computers in physician´s office can never be viewed by the public.
If a spot check reveals an office computer at an improper angle , even just off a smidgen-the physician can face huge fines.
Physicians can even lose their licenses for picayune infractions.
But..now Barry wants physicians to tell the feds if someone
is depressed or stressed from marriage or job woes ?
We should all abide by Don´t Ask Don´t Tell as much as possible the next four looooong years.

I´m sure the ACLU will want to chim-in on this topic just like they did with the mental hospitals, and prevented MA from having involuntary admittance which the mother wanted to do, but was prevented by the actions of the ACLU.

Oh btw... many doctors following the guidelines set out by the American Academy of Pediatrics "Injury Prevention Program" have for years been collecting information on firearms in homes with children.

The AAP´s position on guns has always been "no guns" so of course they have no agenda. /s

Two points:

1. Last week several posts showed NRA-friendly language embedded in Obamacare that made it illegal for doctors to capture the answers to the "do you have any guns at home?" question and then forward this to any government agencies. The NRA apparently go Harry Reid to slip this into the bill at the 11th hour. So not only is HIPPA a roadblock, but now Obamacare is too. So now not only will doctors get sued by victims of gun crimes, but they´ll get sued by gun owners who have had their privacy violated. Lose-Lose for doctors.

2. If doctors will have to ask the "do you have guns at home" question and then report to authorities if the answer is yes, will Obama´s daughters get in trouble when they answer yes? After all, technically, the SS details all carry weapons in the Obama´s house(s) whether in DC or Hawaii.

My doctor´s practice was part of a pilot study back in 2010. The questions started off innocuously enough: Have you traveled overseas recently?, etc. The third question was "Do you have any guns in the house?". I told the nurse with a added profanity that it was none of her business.

When I took one of my flock in for a checkup the other week, there was a substitute doc there who asked the question. I answered indirectly saying most people in my neighborhood own guns. She followed with asking if I kept them locked up. "What locked up?" was my answer. She gave up. By the way, my regular doc would have known better than to ask.

I haven´t read the actual legislation proposed, but what I get out of it is that doctors who feel their patients may be a danger to themselves or others, ask about guns in the household. My father went through a severe depressive episode several years ago and the doctor advised my mother to get the guns out of the house. I don´t know what the reporting requirements will be or if patients need to meet some threshold before reporting occurs. But iif we´re talking about keeping guns out of the hands of mentally unstable people, this may be a start.

Of course, the purpose of physicians asking about guns is not to encourage or promote safety, it´s to find out where the guns are and put pins in the map so as to know where to go to get them.

The correct answer to the question is, "Doctor, can we stay on topic, my medical issues?"

I have no guns and I am NOT going to tell my doctor about the B-52 Bomber I have in my garage. She would refer to to a psychiatrist,
but he is likely at the (gun) range practicing. Seriously, there is NOTHING one can think about our current Administration which would be too outrageous, because no matter how idiotic an idea you have, they always top it with more and more truly delusional ones. I doubt if even one doctor in 100 would even consider asking a patient about weapons, not ask, even CONSIDER. Obama is simply an alien to our culture and laws.
That is my OPINION.

#3, teachers have been mandatory reporters in certain situation for years...and that wasn´t a ´fascist state´. It is about time that public safety got in line in front of patient privacy in the mental health field.

The psychiatrist in Colorado knew that her patient was deteriorating and had various fixations...yet she was unable to tell anyone. He killed and injured a lot of people. I, and a lot of other people, think she should not fear the ´privacy´ regulations and be able to report to law enforcement, or be able to seek inpatient evaluation for him.

#29 is correct. Our pediatrician asked our kids, about 20 years ago, about guns in our home. When I asked why he wanted to know, he told me that the American Academy of Pediatricians had mandated that they collect this information from patients.

By the way, the kids jumped up and down and told the doctor all about their supersoaker water guns.
