A judge on Friday rejected claims by the Mennonite owners of a Lancaster County furniture maker that new federal health-care mandates violate their free-speech and religion rights by making them pay for employees´ contraceptive services. In a 34-page ruling, U.S. District Judge Mitchell S. Goldberg said the owners of Conestoga Wood Specialties Corp. did not prove that complying with the Patient Protection and Affordable Care Act amounted to a "substantial burden" on their religious rights or that they qualified as a "religious employer" for an exemption. The Mennonites and others might want to change their stance on this issue. The way the obama administration is screwing the American public on a daily basis we just might need those contraceptive services.

The judge says it is up to the employees, so downsize the company by laying off 47 employees getting the number down to 48, below the line for companies to have to participate. Mennonites are resourceful so someone will quickly start another company up and hire the laid off employees. The "someone" will probably be from the same family.

As much as I agree with them, I don´t see how these for profit, private corporations cases can demonstrate that the government is impeding their right to exercise of religion. Corporations are a business form and are established under the law to carry out a set mission as set forth in their corporate bylaws. None of which has to do with the religion of their owners. They are strictly a commercial enterprise. They are established and chosen by the stockholders for the very reason they are separate and apart from the stockholders thus providing the stockholders with a protective wall insulating them from the actions of the corporation. The owners picked the corporate form for the very reason they are held as distinctly separate from the owners. Yet now they owners want to claims that they are one and the same. I just don´t see how that is going to work. It works for the Catholic enterprises like hospitals, schools, etc, for example because they are inherently religious but not a for profit corp. The only interest the owners have is a profit motive. The owners are unimpeded in their exercise of religion. Hope they find a way.
