ObamaCare may be the law, but a major resistance movement has already sprouted across the U.S. Though approval of the unpopular law stood at only 38% on Nov. 6, the elections were not a referendum on ObamaCare mainly because Governor Romney was unable to prosecute the case against its most despised provisions – the individual mandate, employer mandate and state-run health exchanges – since all were in the law he signed in Massachusetts. I´ve never bought that argument (made by both liberals and conservatives). The major difference between RomneyCare and ObamaCare is that RomneyCare was a state issue, while ObamaCare is a national issue.

I may disagree with the way Massachusetts decided to handle their health care, but it was well within their constitutional prerogative. ObamaCare (in my view) wildly oversteps the bounds of constitutional limitation on the federal government.

A court case is proceeding challenging ObamaCare on the basis it´s been judged a tax and taxes can only be passed by the House. I always wondered why a big deal wasn´t made of this fact immediately. I don´t agree with the author that Boehner has the slightest interest in wrecking ObamaCare. We gave him the people to defund it in 2010 and he wouldn´t even let the topic come up. Billions flowed out for O´care set up expenses and he wouldn´t say a word. In fact, he stuck the ObamaCare defunding bill in a committee for over a year where it was said to be hung up. A massive GOP Majority in the House and Boehner prevented it from seeing the light of day and had his stooges dream up reasons it couldn´t come out of committee. Even if the court does say the bill has to go back to the House, Boehner won´t mess with it. He´s a full democrat. In any case he´s made clear if we want something a lot, he´ll make sure we don´t get it so we know who´s boss. I hope people understand what they´re dealing with in Boehner.

Technically it is true that the Federal Government has strictly enumerated and limited powers and the States have Residual and unlimited powers. Romney was perfectly within his rights as long as the individual mandate was allowed by the State Constitution.
There is no such right at the Federal level which even the fiercely reviled SCOTUS opinion admits. But the ordinary low information voters who as it turns out flipped the election, cared only about free phones.
