The Opening for a Fresh
ObamaCare Challenge

Wall Street Journal, by David B. RivkinN, Jr. and Lee A. Casey

Original Article

Posted By:cheeflo, 12/6/2012 11:07:45 AM

ObamaCare is being implemented, having been upheld as constitutional by the Supreme Court in June in a series of cases now known as National Federation of Independent Business v. HHS. It is becoming increasingly clear, however, that the court took a law that was flawed but potentially workable and transformed it into one that is almost certainly unworkable. More important, the justices also may have created new and fatal constitutional problems.

Comments:
Maybe Justice Roberts really was playing the long game.

These guys briefly touch on the thing that has bothered me all along and that is, equal protection under the law. How can a law specifically exempt a group from being held accountable by it? Namely those who wrote the law. What kind of a supreme court do we have that would allow a law to stand that says that politicians (and supreme court justices) be exempt from a law of the land? Corruption of the highest order!

It is tantalizing to think that Roberts has been, and is, a Conservative after all and may have set the table for Obamacare to be held unconstitutional through this type of challenge.

Then again, I can easily see him coming up with more convoluted reasons for ruling against anything that threatens Obamacare.

OP--"the long game." Exactly! By calling Obamacare a tax, Chief Justice Roberts opened the door for someone to challenge it based upon the Uniformity Clause (all taxes must be uniform within the US).
Yet another reason to give the dems fits! And they asked for it!

Scientists can now say with extreme confidence that human activity is the dominant cause of the global warming observed since the 1950s, a new report by an international scientific group said Friday. Calling man-made warming “extremely likely,” the Intergovernmental Panel on Climate Change used the strongest words yet on the issue as it adopted its assessment on the state of the climate system.

WASHINGTON — With a wide grin and a quick step, letter carrier Kenny Clark brings more than the day´s mail to the people on his route in suburban Maryland. (snip) "He´s a neighborhood icon — him and his truck," said Amy Dick, who lives on Clark´s route. But his future, and that of the U.S. Postal Service, is in doubt. The Postal Service lost $1.9 billion between January and March, and $15.9 billion last year. The 238-year-old institution loses $25 million each day, and has reached its borrowing limit with the federal Treasury. Daily mail delivery could be threatened within a year, officials say.

When the histories of this administration are written, I hope fervently that last Friday, May 10, does not figure prominently in them. But I fear that it might: the double-barrel revelations that the White House hasn’t quite been telling the whole story on Benghazi and that some mid-level IRS people targeted some Tea Party groups for scrutiny are guaranteed to ramp up the crazy. But to what extent? I fear it could be considerable, and the people in the White House damn well better fear the same, or we’re going to be contemplating an extremely ugly situation come 2015, especially if the Republicans have held the House and captured the Senate in the by-elections.

Original Twinkies are coming back—but under new management—and with a vow to use nonunion workers. Some five months after Hostess shut down over a standoff with its unions, the restructured company is expecting to put its snacks back on store shelves in the coming months. The Hostess closing left more than 18,000 people out of work across the country—with the vast majority belonging to the Teamsters and the Bakery Union. With Hostess back in business, labor analysts say the union movement may have taken a major hit just when it seemed to be gaining lost energy with recent walkouts or job actions.

A more aggressive President Obama followed up last night's debate today by saying that viewers did not see "the real' Mitt Romney. Via America Rising and the IJR, is this the key that finally unlocks the enigma of Harry Reid, tinpot demagogue? Maybe, from moment to moment, this guy just … doesn’t realize what’s coming out of his mouth. Hard to believe he could forget saying on the Senate floor that all ObamaCare horror stories — all of them — are a GOP/Koch brothers fairy tale designed to besmirch the stellar reputation of the Affordable Care Act. Those remarks got heavy coverage in conservative media, and even got picked up at WaPo. You don’t toss a grenade that powerful without choosing your

As part of its plan to reduce U.S. greenhouse gas emissions, the Obama administration is targeting the dairy industry to reduce methane emissions in their operations. This comes despite falling methane emission levels across the economy since 1990. The White House has proposed cutting methane emissions from the dairy industry by 25 percent by 2020. Although U.S. agriculture only accounts for about 9 percent of the country’s greenhouse gas emissions, according to the Environmental Protection Agency, it makes up a sizeable portion of methane emissions — which is a very potent greenhouse gas. Some of these methane emissions come from

All 17 Democrats on the House Oversight and Government Reform Committee have called on Chairman Darrell Issa (R-Calif.) to end the “partisan” investigation into the Benghazi attack “and begin focusing instead on conducting responsible oversight to implement constructive reforms.” The Dems, led by ranking member Elijah Cummings (D-Md.), charged that the probe “has been characterized by wild and unsubstantiated political accusations that turn out to be completely inaccurate.” They proceeded to outline those instances in the five-page letter. “Continuing this reckless pattern of launching wholly unfounded accusations on national television — and racking up more and more Pinocchios in the process —

When Jorge Mario Bergoglio became Pope Francis a little more than a year ago, the first thing that struck those who knew him well was his unexpected, beatific smile. “In Argentina, he didn’t smile like that,” Sergio Rubin, the pope’s biographer, said this week at a conference sponsored by the Ethics and Public Policy Center. “That was the big surprise.” Since then, the pope has mostly kept on smiling — in homilies, in audiences, in meetings with the homeless and the poor. If you look at the pictures from Francis’ meeting with President Obama on Thursday, though, the smile is there only some of the time.

More than six million Americans have now signed up for private insurance under the Affordable Care Act, according to the White House, with just four days to go until the end of its first open enrollment period. While traveling in Italy on Thursday, President Obama shared the news in a conference call with thousands of health-care navigators and volunteers helping enroll people on state and federal marketplaces. As the volume of consumers seeking health plans has surged -- there were over 1.5 million visits to HealthCare.gov Wednesday and more than 430,000 calls to the marketplaces´ call centers -- Obama urged those on

London - England’s public health agency says two people have caught tuberculosis from a pet cat, the first time the bacterial disease has been documented to spread from cat to human. In a report published Thursday, Public Health England said it concluded TB samples taken from the cat and from two people in contact with the animal were “indistinguishable” and that the cat was considered to be “the likely source of infection.” Between December 2012 and last April, veterinarians identified TB in nine pet cats in Berkshire and Hampshire, west of London. Public Health England said the two people who caught TB were recovering and said the risk

Right now, a crime wave is sweeping the nation, and everyone in this out-of-control mob has a D after their names, even if most of the media are loath to report it. If you are a low-information voter, a Globe subscriber, say, you have been told endlessly that the root of all evil in American politics is the Tea Party, better known in your moonbat media as “teabaggers.” Oddly, however, the hacks rounded up over the last few days, well,

MSNBC host Chris Hayes had an entirely different type of animal on his hands with PA Americans For Prosperity Director, Jennifer Stefano. President Obama marveled at the sheer size of the Colosseum during a private sightseeing tour Thursday night in Rome. "This is bigger than some current baseball stadiums," Obama told reporters, noting the size exceeded Wrigley Field in his hometown of Chicago. "I have to check on what it seats. It´s remarkable. Unbelievable." The amphitheatre, located in central Rome, was constructed between 70 and 80 A.D., and was estimated to hold between 50,000 and 80,000 spectators. The Colosseum was home to gladiator battles and animal hunts during the Roman Empire. Obama walked along a platform running through the center of the
