A psychiatrist who treated accused Colorado theater gunman James Holmes rejected a law enforcement offer to involuntarily confine him for 72 hours after he told her six weeks before the shooting that he fantasized about killing "a lot of people," the Denver Post reported on Wednesday. Citing an unnamed source, the newspaper said that Holmes made the remark to his therapist, Lynne Fenton, on June 11. But when a University of Colorado police officer asked whether to detain Holmes on a psychiatric hold, Fenton said no. A psychiatric hold is usually involuntary hospitalization for mental health evaluation.

Had he been put on psychiatric hold, the authorities could have gotten a search warrant and learned from his computer and ammunition supplies that he had no good in mind. Psychiatrists need to be more circumspect.

The privacy laws provided by HIPPA among others, are tilted so heavily in favor of the indivdual patient that it would take your breath away.
In this case, Holmes would have had to have told his psychiatrist that he was going to do something quite specific as to time, place, and method. At that point, when she had a specific threat, she could have had him involuntarily hospitalized for evaluation.
HIPPA was passed and signed into law with the best of intentions. But the lawyers took over, and now it is virtually impossible to get information on family members, unless the family member grants his or her permission. And the more troubled the patient, the less likely it is that the permission will be granted.

#2 has it. HIPAA has made reporting anything a potential federal offense and grounds for major lawsuits.

PIERMONT, N.Y. — The driver of a speedboat carrying a bride-to-be and five others that crashed on New York´s Hudson River late Friday night has been charged with vehicular manslaughter. Rockland County Sheriff´s Department Chief William Barbera said Saturday 35-year-old Jojo John of Nyack was also charged with vehicular assault. Trayvon Martin’s father, Tracy Martin, will appear on Capitol Hill on Wednesday afternoon to offer remarks to a hearing of a newly formed caucus. The Congressional Caucus on Black Men and Boys will hold its first hearing starting at 3 p.m., during which Tracy Martin will offer opening remarks, according to a release from caucus co-chairs Del. I have a suggestion. How about an exhibit on Tawana Brawley? If the purpose of the new National Museum of African American History and Culture at the Smithsonian is to remember racial controversies, as the proposed Trayvon exhibit seems to confirm, then how about an honest look at the phenomenon of hate crime hoaxes? Particular attention should be paid to the role of the media in both the Trayvon and Tawana materials. Police shot and killed an armed teen in the South Bronx early today after the suspect opened fire and refused to drop his gun, police said. Two rookie cops heard shots fired near East 151st Street and Courtlandt Avenue around 3 a.m. and ran in the direction of fire, police said. The uniformed officers saw Shaaliver Douse, 14, of the South Bronx, chasing another person through the streets, according to cops. Douse, who was arrested in May on attempted murder charges for shooting a 15-year-old, fired at the man running on East 151st Street this morning, police said.
