| A federal appeals court in New Orleans is set to hear a case on whether the government can take possession of an individual’s cell phone records from their carrier without a search warrant. A federal court has already denied the government’s bid to obtain the records without a warrant. Judge Andrew Napolitano weighed in on Fox Business Network this morning, saying the government’s argument represents a new theory of the Fourth Amendment “that no one’s ever heard of in 230 years.” The Justice Department argues that the Fourth Amendment does not apply to a third

My battery is still in use even when I have turned off my cell phone. To maximize battery life, I will now need to remove the battery completely, when traveling, or if the battery is not holding a charge well.

These warrantless searches have been going on for a long time, helped along by the Patriot Act and lots of other anti-freedom laws and judgements over the years. It has been chipped away one piece at a time (with public safety or health as the preferred excuse) until we are left with nearly nothing. We must never forget that NO government is a friend of freedom. It doesn't matter who wins this election because it never has. They all take away a little more.

Blocked by Congress from expanding gun sale background checks, President Obama is turning to actions within his own power to keep people from buying a gun who are prohibited for mental health reasons. Federal law bans certain mentally ill people from purchasing firearms, but not all states are providing data to stop the prohibited sales to the FBI´s background check system. A federal review last year found 17 states contributed fewer than 10 mental health records to the database, meaning many deemed by a judge to be a danger still could have access to guns. The Obama

Authors of the newly released Senate immigration bill touted the package Thursday as a "bipartisan breakthrough" in advance of a critical hearing, as opponents began to organize against the bill -- claiming it doesn´t do enough to enforce existing immigration law. Sen. Marco Rubio, R-Fla., who has put his conservative reputation on the line with his involvement in writing the bill, took to the floor late Thursday afternoon to defend it. Though critics have homed in on the bill´s pathway to citizenship for illegal immigrants, Rubio said the package would also fix a "broken" legal

Now that we know who the bombers are and one of them is dead, and that they are Chechen Muslims, the media has gone into “Palestinian” mode insisting that we need to talk about the conflict in Chechnya. We can talk about Chechnya, but the issue there and everywhere else is Islamic nationalism or Islamism. The bombers could have been from Chechnya or Mali or Bosnia or Iraq or Egypt or Afghanistan or any Muslim country where Islamists are active. And that’s most Muslim countries, especially after the Arab Spring. There is a conflict in Chechnya and Iraq

President Barack Obama delivered an impassioned speech Thursday at the memorial service for victims of the Boston Marathon bombing. But that was to be expected. We all know Obama can give a stem-winder. What wasn’t expected was that this would be by far the toughest week of the Obama presidency—the first time I can remember the president being dealt an unequivocal policy defeat. Only the “shellacking” of the 2010 midterm comes close, and even there a case can be made that achieving the decades-old progressive dream of universal health care was worth losing the House of Representatives and a

Black lawmakers and civil rights groups are concerned by a proposal in the Senate´s immigration reform bill that would do away with “diversity” visas that are often a pathway for African and Caribbean immigrants to enter the United States. Advocates said they haven´t seen evidence yet that a new merit-based program is an acceptable replacement for the diversity visas, which total 55,000 each year and are granted via a lottery. Hilary Shelton, director of the NAACP Washington bureau, said he is telling lawmakers not to eliminate the diversity program when comprehensive immigration reform moves forward.

Desperate to keep up with their face passed schedule, Senate Democrats proceeded to hold their first of just two hearings on the 844-page Schumer-Rubio immigration bill today, despite the unfolding events involving immigrant bombers in Boston. Department of Homeland Security Secretary Janet Napolitano had been scheduled as the main witness at today’s Judiciary Committee, but she cancelled her appearance minutes before the hearing began, citing her obligations to oversee the ongoing situation in Boston. You can watch the hearing, which now features just two witnesses, neither of which are form the Obama administration, here.

BuzzFeed has linked to the YouTube page of Tamerlan Tasarnaev – the older brother in the pair suspected of bombing the Boston Marathon earlier this week. A video he linked to on his page is titled, “The Emergence of Prophecy: The Black Flags From Khorasan.” The video deals with a key part of jihadist mythology: That one of the most significant battles fought against the “infidels” will take place in the Khorasan, a geographic area that includes parts of Afghanistan, Pakistan, Iran, Uzbekistan and Tajikistan. As my colleague Bill Roggio has explained, “The Khorasan is considered by

Judging from the tone of the conversation in the media and inside the Beltway surrounding efforts to enact comprehensive immigration reform and stricter gun laws, one could be forgiven for assuming that either of these issues were legislative priority for Americans. Multiple polls have confirmed, however, that they are not. The latest, a Gallup poll, shows that only 4 percent of Americans view guns or gun control or immigration reform as a priority for lawmakers. A Gallup poll of 1,005 adults, taken from April 4 – 7, shows that Americans’ top priorities remain the economy and unemployment.

April has not been kind to those who subscribe to the tenets of cultural and social liberalism. The advocates of progressivism in American life have suffered two defeats in recent weeks – one fight they sought but the other was unforeseen. The trial of Kermit Gosnell has forced the media and the public to ask themselves some disturbing questions about the nation’s abortion laws and the disdainful treatment of pro-life ideas and advocates by the press. Similarly, gun control advocates suffered a dramatic defeat yesterday at the hands of the country’s elected representatives. Neither of these events

The head of the National Rifle Association mocked President Obama´s Rose Garden "tantrum" after losing the gun control fight in the Senate, charging Thursday that Obama suffered the worst defeat of his presidency because "he bit off more than he could chew." David Keene told Secrets that the president and his team misplayed their hand because they don´t have a sense of the public´s attitude toward gun control. "They just can´t gauge the public reaction to what they do because they don´t have any sense that the public has feelings different than they do," said Keene.

Attorney General Eric Holder expressed frustration and anger Thursday over the Senate´s defeat of gun control legislation this week, but vowed he will continue to fight for measures to prevent gun violence. “Despite my disappointment and, quite frankly, my frustration and anger at the filibuster in the Senate yesterday that led to the failure to adopt some of those changes, despite the fact that a majority voted for them, I and my colleagues throughout the administration remain committed to standing with the families of Newtown,” said Holder in testimony before the House Appropriations Committee on Thursday.

Yesterday, the most modest of gun control proposals died in the Senate. It would have expanded background checks to people purchasing weapons at gun shows and online sales, enjoyed 90 per cent support among the public and came on the back of the tragedy at Newtown. Yet, despite all that it had going for it, the Toomey-Manchin bill raised just 54 votes--six short of the number necessary for passage. “This is a pretty shameful day for Washington,” said Obama afterwards. It wasn’t exactly a red letter day for him, either. Why did the no-brainer bill fail? Four reasons:

President Obama angrily blamed the defeat Wednesday of his centerpiece gun-control proposal on lies spread by the National Rifle Association, calling it “a pretty shameful day for Washington.” “The gun lobby and its allies willfully lied about the bill,” Mr. Obama said in the White House rose garden about 90 minutes after the vote. “It came down to politics.” As he spoke, Mr. Obama was surrounded by family members of victims of the Newtown, Conn., school shooting. Also with him was former Rep. Gabby Giffords of Arizona, wounded in an assassination attempt.

The Senate delivered a devastating blow to President Obama’s agenda to regulate guns Wednesday by defeating a bipartisan proposal to expand background checks. It failed by a vote of 54 to 46, with 5 Democrats voting against it. Only 4 Republicans supported it. Democratic Sens. Mark Pryor (Ark.), Max Baucus (Mont.), Heidi Heitkamp (N.D.), Mark Begich (Alaska) and Senate Majority Leader Harry Reid (Nev.) voted against it. Reid supported the measure but voted against it to preserve his ability to bring the measure up again. GOP Sens. John McCain (Ariz.), Susan Collins (Maine), Pat Toomey (Pa.) and Mark Kirk

While the media are bearing the brunt of public skepticism over the handling of the Boston bombing, the behavior of government is also eroding public trust. Yesterday´s promised but cancelled news briefing is just one symptom. Andrew McCarthy of PJM notes that "Misinformation rather than enlightenment has been the order of the day in the investigation of Monday´s terrorist bombing of the Boston Marathon," and that part of it is the natural outgrowth of the desire of investigators to keep the details of their investigations secret, so as not to alert suspects.

Mark Kelly, the astronaut husband of former congresswoman Gabrielle Giffords, on Thursday upbraided senators who voted against gun legislation by saying they voted “out of fear.” ”If that vote had been a secret ballot, I bet you it would have passed with 80 votes,” Kelly told reporters. He was referencing the compromise authored by Sens. Joe Manchin (D-W.Va.) and Pat Toomey (R-Pa.) to expand background checks for gun buyers. It failed to advance in the Senate, with a vote Wednesday afternoon of 54 to 46.

After all the controversy – it was too much, and too expensive; it would be marred by protests – this morning’s funeral for Lady Thatcher in London was a splendid and memorable affair, which did her memory, and her country, proud. It was a moving, dignified and pitch-perfect occasion: unmistakably British, and a fitting send-off for the country’s greatest post-war prime minister. Big Ben fell silent – for the first time since the funeral of wartime leader Winston Churchill – and tens of thousands of admirers lined the streets to applaud Lady Thatcher’s coffin

Washington — President Barack Obama says the Senate’s opposition to a bill that would have expanded background checks for gun buyers marks a “shameful day” in Washington. He says a minority of senators decided “it wasn’t worth it” to protect the nation’s children. Obama spoke in the Rose Garden shortly after the Senate vote rejecting a bipartisan effort to expand federal background checks to more firearms buyers. (Snip) The president pinned the blame for the measures failure, though five Democrats also opposed the plan. He also said the gun lobby and its allies “willfully lied” about background check bill.

Misinformation rather than enlightenment has been the order of the day in the investigation of Monday’s terrorist bombing of the Boston Marathon. The anxiety stemming from the attack and the stream of inaccurate news about it is further freighted, moreover, by the FBI’s confirmation that two letters addressed to top political officials — President Obama and Senator Richard Wicker (R., MS) — tested positive for ricin, a deadly poison. As noted below, a man identified as Kenneth Curtis of Tupelo, Mississippi, has reportedly been arrested in connection with the mailings. Early this afternoon, massive confusion

WASHINGTON -- A senior Democratic senator who helped write President Barack Obama´s health care law stunned administration officials Wednesday, saying openly he thinks it´s headed for a "train wreck" because of bumbling implementation. "I just see a huge train wreck coming down," Senate Finance Committee Chairman Max Baucus, D-Mont., told Obama´s health care chief during a routine budget hearing that suddenly turned tense. Baucus is the first top Democrat to publicly voice fears about the rollout of the new health care law, designed to bring coverage to some 30 million uninsured Americans through a mix
