| Boston - Massachusetts will appeal a federal judge's decision to grant a convicted murderer's request for sex reassignment surgery, prison officials announced Wednesday. The state Department of Correction said that it believes the medical care Michelle Kosilek is receiving is adequate and that the court didn't address what it says are legitimate safety concerns of protecting her in prison. U.S. District Judge Mark Wolf ruled this month that the surgery is the only adequate treatment for Kosilek's gender-identity disorder, a condition Wolf said is a "serious medical need." He said denying surgery violated Kosilek's Eighth Amendment rights. It was the

Comments: Isn't it possible to show that the judge is just crazy and his ruling is therefore void? Ask the judge how any of these surgeries actually create a sex change.

If he wants to be a she, give her a plastic table knife and have at it. Self mutilation either way, but at least we don't get stuck with the tab.

Let him get the operation as long as he pays ALL the expenses. If you do that, they can't say they are violating his 8th amendment. There is nothing that says we have to pay for anything though.

I guess his disorder led him to kill the natural born woman he married as well. What do they do with her after sex change? Does she go to women's prison? Women's prison is much safer to inmates than men's prison. This case has moved from the theatre of the absurd to the sublime.

I believe in equality... if this guy is going to have a sex change operation, then ALL the inmates should have one as well. So let's tell his buddies in prison that, because Kosilek wants a sex change, everyone else must have one as well (its about fairness and equality). Then let's let them all out into the yard for recess and see where it goes from there.

The stae of Mass. is puttingup a feeble fight against thsi ruling because the public is upset about it.But someone like Coup Deval couldn't care less about the expense of doing this and probably agrees with the judge in principal. This is just like Rahm's phony fight against the teachers union in Chicago and they got their way, anyway. This joker will get the sex change operation and it'll be a huge door opener for others in prison around the country.
Obamacare has sex change provisions in it,it just hasn't been publicized. The left truly believes in this theory that people are born in the wrong body when it's all psychological.

We at Townhall have been covering this hotly contested Senate race for months and the results are finally in: With 36 percent of precincts reporting, Elizabeth Warren has been declared the next junior Senator from Massachusetts. Warren has never held public office before and the eye-popping $40 million she raised this election cycle evidently proved more than enough to unseat incumbent Senator Scott Brown. This was the most expensive Senate race of 2012 -- by a long shot.

CNN’s Peter Hamby reported that Mitt Romney‘s internal polling showed President Obama leading in Ohio by five percentage points.Per Hamby’s post: The number represented a sharp final bump for Obama in Ohio, a race that had essentially been a tied race through much of the previous week, according to the campaign’s daily tracking. The polling, which also showed a tight race in Pennsylvania, explains why Romney officials decided to send their candidate on last-minute Election Day visits to Cleveland and Pittsburgh.

The Obama and Romney campaigns may be gearing up for a very late night, with one Obama campaign adviser predicting that in Florida alone, "they'll be counting until 2 a.m." The Obama adviser said signs suggest the race is quite tight, though the campaign claimed to be "holding strong" in key battlegrounds like Ohio, Pennsylvania and Wisconsin. The adviser also said turnout among black voters in Virginia was better than expected, suggesting that could be a problem for Mitt Romney. Republican operatives in Virginia, though, predicted a razor-thin victory for their candidate in the state.

Washington - Early returns on Tuesday in what is anticipated to be a dead even presidential election contained no surprises, as CNN projected President Barack Obama will win his home state of Illinois and eight other races while Republican challenger Mitt Romney will win nine states. All races called so far went as expected after the roller-coaster ride of an election campaign that was buffeted by a superstorm and missteps on both sides. Obama and Romney ran dead even in final polls that hinted at a result rivaling some of the closest presidential elections in history, reflecting the deep political

A week after Hurricane Sandy slammed into the East Coast, a majority of voters said President Barack Obama’s response to the crisis wasn’t a factor in their vote, according to early exit polls. Fifty-five percent of those surveyed, per CBS News’ early exit polling released by radio station WKZO in Kalamazoo, Mich., said Obama’s handling of the storm was a minor factor in their vote or wasn’t a factor at all. Twenty-six percent named Sandy as an “important” factor, and 15 percent said it was the “most important” factor in their decision.

Mitt Romney is leading among independents in both Ohio and Virginia, early exit polls show. In Ohio, the former Massachusetts governor takes 56 percent of self-identified independents, compared with 40 percent for President Barack Obama. That’s a huge decrease for Obama from 2008, when the exit polls found him winning independents in Ohio by 12 points, 52 percent to 44 percent for John McCain. The numbers are similar but slightly tighter in Virginia: Romney takes 53 percent of independents there, according to ABC News exit polls, a 12-point lead over Obama. In 2008, Obama won independents in the state by

Mitt Romney and President Obama each racked up early and expected victories Tuesday night in relatively safe territory, while some of the biggest battlegrounds that will decide the election remained too close to call. All the big swing states where polls have closed -- Florida, New Hampshire, Pennsylvania, Ohio, Virginia and North Carolina -- were too close to call, Fox News projects. (Snip) Obama will also win three of Maine's four electoral votes, Fox News projects. It is unclear where the state's fourth electoral vote will fall. As expected, the presidential race is tight in Ohio, where the polls just closed: President Obama is winning women 55 percent to 44 percent in the early CBS News exit poll, while Mitt Romney is leading 52 percent to 46 percent among men. Women made up 51 percent of the electorate, compared to 49 percent among women. Thirty-nine percent of voters so far identified themselves as Democrats, compared to 30 percent calling themselves Republican. Thirty-one percent identified as independent or something else, and Romney has a big edge among this group - 56 percent to 40 percent for Mr. Obama.

As expected, Republican candidate for President, Mitt Romney, won West Virginia’s five electoral votes in Tuesday’s General Election over President Barack Obama. National media outlets called the race in West Virginia shortly after polls closed at 7:30 p.m. President Obama’s fate in West Virginia has never been in question, as he garnered just 60 percent of the democratic vote in the May primary. The other 40 percent of that vote went to Texas federal inmate Keith Judd, who was placed on the ballot in West Virginia. President Obama has been hugely unpopular in the Mountain State since he first ran

Early exit polls show Election Day voters are slightly more Republican than in 2008 and broadly concerned about the state of the U.S. economy. Six in 10 voters said the economy is their top issue according to the poll, which was released by The Associated Press and conducted on behalf of a consortium of media companies. Less than a quarter of voters said their families were better off than four years ago — a point seized on by many Republicans as the results leaked out.

The Patrick administration clamped down the lid yesterday on Herald requests for details of Tamerlan Tsarnaev’s government benefits, citing the dead terror mastermind’s right to privacy. Across the board, state agencies flatly refused to provide information about the taxpayer-funded lifestyle for the 26-year-old man and his brother and accused accomplice Dzhokhar Tsarnaev, 19. On EBT card status or spending, state welfare spokesman Alec Loftus would only say Tamerlan Tsarnaev, his wife and 3-year-old daughter received benefits that ended in 2012. He declined further comment.

Marathon bombings mastermind Tamerlan Tsarnaev was living on taxpayer-funded state welfare benefits even as he was delving deep into the world of radical anti-American Islamism, the Herald has learned. State officials confirmed last night that Tsarnaev, slain in a raging gun battle with police last Friday, was receiving benefits along with his wife, Katherine Russell Tsarnaev, and their 3-year-old daughter. The state’s Executive Office of Health and Human Services said those benefits ended in 2012 when the couple stopped meeting income eligibility limits. Russell Tsarnaev’s attorney has claimed Katherine — who had converted to Islam —

Tamerlan Tsarnaev is telling no tales. The older of the two brothers who committed the Boston Marathon bombings was likely the one who planned the attack, but when he died in a shootout with police just days after the blasts, his thoughts and motivations vanished with him. But the brain that was home to his angry mind remains, and in this case that may mean something. Tsarnaev was an amateur boxer who won the New England Golden Gloves competition as recently as 2009 and 2010. That speaks to a young man with a healthy sense

Two unnamed U.S. officials have told the Associated Press that the surviving suspect in the Boston bombings was unarmed when police captured him hiding inside a boat in a neighborhood back yard. The report contradicts the Boston police department´s own account of Dzhokar Tsarnaev´s capture on Friday - after commissioner Ed Davies described a firefight between him and officers before the terror suspect was captured. The New York Times also said an M4 rifle had been found on the boat - another claim contradicted by the latest revelations. Officers had originally said they had exchanged gunfire

President Obama and the First Lady have come up with a crafty strategy to prevent their daughters from getting tattoos — and it banks on the girls thinking their parents are deeply uncool. “What we’ve said to the girls is, ‘If you guys ever decide you´re going to get a tattoo, then mommy and me will get the exact same tattoo. In the same place,’” Obama said with a smile. “And we´ll go on YouTube and show it off as a family tattoo.” “And our thinking is that might dissuade them from thinking that that somehow that´s

Since the Boston bombing suspect, Dzhokhar Tsarnaev, was captured, there’s been quite a debate over his Miranda rights and how to treat him — given that he’s a United States citizen. An Associated Press report out this morning is sure to add fuel to the fire. As soon as he was read his Miranda rights, it says, Tsarnaev stopped talking. The report notes that Tsarnaev was read his rights 16 hours after his interrogation had began. Then, he fell silent: Dzhokhar Tsarnaev immediately stopped talking after a magistrate judge and a representative from the U.S. Attorney’s office entered his

This time, it’s of GOP pollster and frequent Fox News analyst Frank Luntz remarking that Rush Limbaugh, Mark Levin, and other right-wing talk radio hosts are “problematic” for the Republican Party’s efforts to reach out to other demographics and to fight the polarization of politics. The video was recorded on an iPhone while Luntz delivered a College Republicans-sponsored speech at the University of Pennsylvania earlier this week. Most of his speech reportedly consisted of his thoughts on how words matter — for

As Obamacare was winding its way through the Senate in 2009, Sen. Chuck Grassley (R., Iowa) slipped in an amendment requiring that members of Congress, and their staff, enroll in Obamacare’s health insurance exchanges. The idea was simple: that if Congress was going to impose Obamacare upon the country, it should have to experience what it is imposing firsthand. But now, word comes that Congress is quietly seeking to rescind that provision of the law, because members fear that staffers who face higher insurance costs will leave the Hill. The news has sparked outrage

The one clear thing that came out of last week´s chaotic activity in Boston, Massachusetts is that real reporters were missing. For that matter, they´ve been missing since last year´s attack in Benghazi. From Benghazi, the Gosnell abortion trial, gun control debates, immigration and then the Boston Marathon bombings, television news reporting has become positively painful to watch. The First Amendment to the Constitution grants freedom of the press but this was supposed to endow it with a responsibility to be the people´s watchdog. The modern Fourth Estate represented by the mainstream media has made a mockery of this privilege.
