It´s amazing, the difference a $250 million defamation lawsuit can make. The Washington Post published an editor’s note Friday evening admitting, way too late, that it badly bungled its coverage of the Covington Catholic High School story. Major newsrooms, including the Post, falsely reported in January that a group of Covington Catholic High School students had abused and taunted an elderly Native American protester, Nathan Phillips, after the March for Life in Washington, D.C. What they are "SORRY FOR" is only that they GOT CAUGHT WITH THEIR BOVINE EXCREMENTAL Reporting; while having to face the fact they MAY POSSIBLY, HAVE TO PAY A HUGE FINE !

The litigation should be fully tried before a court. The plaintiffs should have full discovery of the WP´s internal papers and depositions of its people that will show the degree of malice, mendacity and willful policy of distortion that infests the newspaper. The extent of the rot must be fully disclosed. When the discovery procedures start, the WP will quickly abandon its phony principle that "Democracy dies in darkness." That is for the little people.

I kind of doubt the post (small p) actually has $250,000,000 laying around. In addition I don’t think you can buy insurance that covers you for libel. If they lose they are gone.

Sadly for WaPo, the smelly Kentucky Walmart shopper filled jury will probably not understand the days of front page, on-purpose life destruction of an innocent minor completely made up by a WAY in the back teeny comment of "oops" on a Saturday edition. They´re just not quite Washington DC and NYC educated enough to believe the incredible contrition and fake, er, I mean honest apology by WaPo. And the jury MIGHT even think (I know, we flyover´s are such goober hicks) that WaPo only did it to try to help them win the Kentucky jury trial or win the WaPo appeal. However, we bare foot dirt walkers lack the elite subtle nuance and genius understanding that is so abundant in the nation´s capital. What a shame.

I´m not sure the Waa Poo "admitted" anything. It sounds more like they described the process in which the story developed and state simply that it appeared the Covington kids were at fault and then they discovered they probably were not. It´s like they stumbled over the truth after it clubbed them over the head and it was impossible to ignore. Their claim is, Yeah, they got the story wrong but they didn´t DO anything wrong.

The fact that the Washington Post took so many days to admit it screwed up, although the true story was out in hours, should be irrefutable proof that there was malice in their reporting.

"All the malicious fake news that is unfit to print"

The National Enquirer at least tries to verify a story before printing it.

Okay, let´s get realistic on at least a couple of points:
1. The Wapo correction/retraction was written by the attorneys, toned down as much as possible at the insistence of the Wapo editors.

2. The attorneys recommended printing the correction to show that the Wapo is contrite, it no longer insists that Sandmann was an aggressor, and to mitigate any eventual damages award, should the case go to trial.

3. The proud Wapo editors intentionally stuck this admission in the Saturday morning edition of the paper, which far fewer people are likely to read.

4. Though Sandmann´s attorneys initially have demanded $250m in damages, part real and part punitive, it´s overwhelmingly likely that Wapo will successfully settle the case for somewhere in the neighborhood of $5m to $20m, which is still not chump change for a couple weeks of teenager humiliation.

I´d love to see this case to go to trial and see a jury award upwards of $100m, but that´s not realistic.

Was it worth $250,000,000 to have a reporter and editor deliberately print a false, untruthful story about an innocent teenager when it would have cost you nothing to print the truth; or to apologize promptly when you got caught?

One of my college professors, long ago, told our class a maxim I have never forgotten:

"Everyone has a right to their opinion, but no one has a right to be wrong in their facts."

There you go. From this day forward tell your staff to get the facts, write the facts, and report the truth.
