Brett Kavanaugh Just Declared
War on Roe v. Wade

Slate, by Mark Joseph Stern

On Thursday night, the Supreme Court blocked a stringent Louisiana abortion law by a 5–4 vote, with Chief Justice John Roberts joining the liberals to keep the measure on hold. Roberts’ vote is surprising, but not a total shock: The Louisiana statute is a direct violation of the Supreme Court’s 2016 ruling in Whole Woman’s Health v. Hellerstedt, and until the court overturns that decision, the Louisiana law cannot take effect. To Roberts, this precedent matters. To Justice Brett Kavanaugh, it does not. Kavanaugh so disagreed with the majority that he wrote a dissent explaining

I find it hard to believe that requiring an abortion doctor to have surgical privileges at a nearby hospital provides "absolutely no medical benefit to women." If nothing else, it is one way of screening out the Kermit Gosnells of the abortion industry.

Usually you´d hear me back a pro-life position. That´s not what this case was about. It´s about whether a lower court needs to obey a higher court ruling. Whether it´s on abortion or bagels, the legal reasoning is the same. The court had ruled that the law they struct down was effectively capricious (requiring admitting privileges as an arbitrary hurdle). So, I´m not surprised with Roberts, and I think it´s fair. Don´t take it as Roberts flipped.

Abortion is a surgical procedure. Requiring physicians who perform abortions to have surgical privileges at a local hospital would seem logical to me.

Not mentioned in this article is the fact that Roberts voted against"Women´s Health," the ruling said to invalidate the Louisiana law. He is therefore likely to vote to uphold the Louisiana law when it finally comes before SCOTUS. He will vote to overturn the previous SCOTUS ruling and just doesn´t like having the 5th circuit think it can do it.

The court will never overturn Roe VS Wade. The court found it is in the Constitution, what would be the rationale for overturning it? It´s a horrible decision like Dred Scott, but the court will never admit they made a mistake.

Stern is wrong. Requiring providers who preform abortions to have privileges at a local hospital provides for a minimum level of competence in the provider as well as ready access to the hospital should there be complications. This is simple common sense.

Advocates of abortion don´t care about the health and safety of pregnant women who undergo abortion procedures. They look upon any safeguards as unnecessary obstacles.
This is because the whole purpose of abortion from their standpoint is genocide.

#16, the original Roe vs Wade decision stated that if the human fetus is a person, the entire rationale for legal abortion collapses.

All a court has to do is state a consistent rational definition of person: something like this:

"Every man, every woman, and all of their offspring are human beings. Every human is a person. Human rights begin where human life begins. Human life begins with the creation of a human zygote."

Same definition in other words:

"Every member of the human species is a person. Neither this court, nor any court, has the authority to create two classes of human being, one with rights and one without."

They might want to note that several times in history, various regimes have denied the personhood of disfavored classes of human beings (slaves, Jews, babies before birth). This has never turned out well.

For the last two years, millions of Americans have come to view Deputy Attorney General Rod Rosenstein as a kind of national insurance policy. This assessment is now in need of revision. Rosenstein is the guy who appointed Special Counsel Robert Mueller to investigate whether Russia tried to interfere in the 2016 election a week after President Donald Trump fired FBI Director James Comey. As the president rages on Twitter, Rosenstein is seen as the avatar of what one anonymous administration called the “steady state” — the resistance to Trump from within.

It was 1982 and he was on a retreat with his classmates from St. Lawrence, a Roman Catholic seminary for teenage boys training to become priests. Leaders asked each boy to rank which he would rather be: burned over 90 percent of his body, paraplegic, or gay. Each chose to be scorched or paralyzed. Not one uttered the word “gay.” They called the game the Game of Life. The lesson stuck. Seven years later, he climbed up into his seminary

The Green New Deal that Democrats unveiled last week has a grand ambition to eliminate fossil fuels in 10 years, retrofit every building in America, and guarantee high-paying jobs in the bargain. If you want to see how that works in the real world, consider the public housing projects near Rep. Alexandria Ocasio-Cortez’s New York office. The New York City Housing Authority (Nycha) has a more modest goal of a 30% reduction in greenhouse-gas emissions by 2027.
