A federal judge in Montana has blocked construction of the $8 billion Keystone XL Pipeline to allow more time to study the project´s potential environmental impact. The Great Falls Tribune reports U.S. District Judge Brian Morris´ order on Thursday came as Calgary-based TransCanada was preparing to build the first stages of the oil pipeline in northern Montana. Environmental groups had sued TransCanada and The U.S. Department of State in federal court in Great Falls. Morris says the government´s analysis didn´t fully study the cumulative effects of greenhouse gas emissions, the effects of current oil prices

Perhaps we need a new rule on how many times a federal judge can be overturned by an appellate court before being removed from the bench as incompetent, "Three Strikes and You´re Out!"

Another judge legislating from the bench.

This project has been massively studied. Even BO´s State Department approved it. BO just overrode their approval.

When judges take it upon themselves to act this way, a tally of their behavior should be taken. Occurrences of this behavior should lead to letters of censure and multiple censures to impeachment.

This block by the Obama appointed judge means at least a 12 month delay as his ruling his appealed. If appeals court upholds his mad ruling, it will mean the SC may or may not hear appeal in October, 2020, with a decision out of the Court in June, 2021. All because TransCanada prefers the efficiency of a pipeline rather than trains to move oil to Texas refineries.

As to ruling, what does the “effects of current oil prices” have to do with federal law? Or is the law of supply and demand now to be determined by federal judges?

They should ignore this activist Judge and start to build the pipeline anyway. Let him enforce his ruling with his standing army, if he has one!! Otherwise, pound sand!!

I am heartily tired of activist judges making law from the bench based on feeeeeingz instead of basing decisions on established case law. If they cannot make rulings based on the Constitution, bench ´em and send ´em to the showers!!

I appreciate David’s response to my column on the FBI counterintelligence investigation of Trump, but unfortunately don’t find it persuasive. David emphasizes how the regulations governing a counterintelligence investigation focus on the activity of the foreign power. Yeah, sure. But that’s why the Times story was so explosive. It reported on a counterintelligence investigation of Trump himself, who is obviously not a foreigner, but the duly elected president of the United States. The Times story says that the FBI feared Trump might have been a witting or unwitting agent of the Russians.
