A Terrible College Case Shows
the High Cost of ‘Believe Women’

National Review, by David French

Original Article

Through much of the last month, the American people have been treated to a version of the emotional and ideological argument that’s dominated the American academy for much of the last ten years. The argument goes something like this: Women rarely lie about rape. Thus, the failure of criminal or civil justice systems to achieve overwhelming rates of conviction or impose liability at the rates of predation means that fundamental reform is mandatory. (snip) It’s been a disaster. From coast to coast, accused students — typically men punished for sexual assault with barely a chance to defend themselves — are filing lawsuits

Sue the college/university and all the Stasi counselors/administrators involved into permanent penury in every such case.

They deserve nothing less.

Stupid should hurt a lot. And they should serve as a very painful example to the other NPCs that have the urge to pull these sorts of kangaroo court proceedings.

Perhaps, #1, 40% of rape accusations turn out to be false, but that seems unlikely unless you can provide the link. What is more likely is that most rapes are never reported because most women are not raped by someone hiding in the bushes. Most women are raped by an acquaintance. After being assaulted by someone that they were friendly with, it´s only normal to question the reality of what happened and for the victim to blame themselves (we do raise girls to be nice). A lot of victims are hurt when people believe that 40% of all rape accusations are false. In addition to the emotional toll, the financial cost of rape is high - victims often drop out of school or quit jobs while recovering and therapy is not cheap. Don´t be so quick to assume most women are lying.

Suppose a man is on trial for rape or civil sexual harassment. During jury selection one or more prospective female jurors advise candidly that, sight unseen, they believe the female victim. They further advise the court that as far as they are concerned it is up to the accused to prove himself innocent. What would happen if the judge assured the women that they would be able to remain on the jury with those beliefs? When one or more of the factfinders have disclosed actual bias, the proceedings would be manifestly unfair. A trial judge would be in professional jeopardy for permitting such blatant unfairness in a trial.

Hearings that involve the taking of evidence and sworn testimony with a person´s career hanging in the balance are "quasi-judicial" in nature. Fundamental fairness is also expected. When male and female senators blatantly announce that sight unseen, voice unheard, they already believe the accuser--and therefore they intend to flip the burden of proof--they have admitted actual bias and an intent to deny fundamental fairness. That is what Justice Kavanaugh meant when he said the proceedings were a "disgrace." Moreover we should not expect judges accused of rape to display the same dispassionate neutrality reserved for the proceedings over which they preside and is intended by term "judicial temperament."

I don’t believe in blanket “believe” policies for either gender.

Women and men (we’ve had some of those talk about abuse much later) must get over their fear of reporting incidents as they occur. To parents or authorities. With details.

Waiting for years is just not a good thing for anyone.

They must also not allow themselves to be used - exploited - for political reasons or no woman will be believed. And they should never allow themselves to be abused in return for favors or career advancement.

#6, My husband was a sex crimes investigator. Don´t be shocked by the statistic. Hookers who don´t get paid or paid enough frequently cry rape. Women who want to get male roommates/boyfriends out of their apartment will as well. Then there are the women who are annoyed that their BF broke up with them or a suitor did not call after a one night stand.

There are many who do not report rape but that is their choice. Law enforcement takes every allegation seriously and investigates it to find CORROBORATING evidence.

No reason whatsoever to believe women over men.

Evidence, facts, cross examination, DUE PROCESS.

Many women, when no long term commitment is forthcoming after "giving him what he wants" (entirely voluntarily) are extremely angry, and seek revenge.

As with gossip, I suspect that women are much more likely to engage in lying about sex than men. Other than teenagers, few men will divulge past sexual encounters. The ones that do are likely lying. Women, on the other hand, are the ones who read romance novels, watch soap opera television and doctor shows. And actually believe them!

When men are falsely accused their names are dragged through the mud and often it affects their future. I think that false accusers should be identified on a list just as sex offenders are. After all these women sometimes go on to accuse others later in life just as Avenatti´s crazy woman did. Judge Kavanaugh was not her first victim and it seems to me that the police should have a record of these idiot women and their false charges so that other men do not have to suffer.

I expect many girls end up in a wrestling match with an octopus. Scary and maddening, yes. Assault? Or just a boy being a pig? Moms need to teach their daughters how to defend themselves, how to set firm limits, how to get help. Doesn’t always work, but worth knowing. At least will probably convince the teenaged jerk one is seriously annoyed. A knee in the groin is a fearsome thing, I hear.
A doctor friend worked ER in a small town from time to time, and had the occasional gal show up upset, claiming to have been raped. He, a kind, serious soul, always went through the protocol carefully, but over the years was never able to prove anything medically. No bruising or vaginal lacerations, no torn clothing, no other signs of physical trauma, no ejaculate recovered. The rape counselor/nurse who interviewed the victims said, “Usually a girl busted curfew afraid of parental ire, woman in a fight with her ex, or got drunk, looking for an alibi. Sounds harsh,” she admitted, “but that’s why you can’t find any evidence. At least around here, rape just doesn’t happen very often.”
I believe, then, the FBI numbers, and they may be a little conservative.

Washington — Millions of Americans are waiting for Robert Mueller to give them the final word on whether the Trump campaign conspired with the 2016 Russian election interference effort — and whether their president is under the influence of a foreign adversary. Millions of Americans may be sorely disappointed. Unless Mueller files a detailed indictment charging members of the Trump campaign with conspiring with Russia, the public may never learn the full scope of what Mueller and his team has found — including potentially scandalous behavior that doesn´t amount to a provable crime.
