Public must not give predators free pass
Boston Herald, by Jessica Heslam

The dust hasn’t even settled yet, but many of the powerful men accused of sexual misconduct against women in the #MeToo movement are already creeping out of the woodwork in desperate bids to make a comeback. And shame on us for letting them. The latest is comedian Louis C.K., who cracked jokes to an adoring crowd at a New York City comedy club Sunday night. Ex-U.S. Sen. Al Franken (D-Minn.) said last month he hasn’t ruled out a political comeback. Fallen “Today” show host Matt Lauer recently assured some doting female fans he’d “be back on TV.”

I am very tired of women who hope to cash in on decades-old incidences of bad behavior by men, incidences that are now supposed to be categorized as sexual predation. I wonder what percentage of these cases are actual sexual abuse as compared to run of-the-mill flirting.

Idiotic. Al Franken was a capable comedy writer and a bad Senator, neither of which makes him a predator.

Matt Lauer was a dishonest pseudo-journalist and a terrible husband. He behaved badly towards women, and took advantage of them whenever he could.

These things are not crimes, and it is a serious mistake to treat them as if they were. Meanwhile, President Clinton, who beat and raped a woman in a hotel room has had a free pass from people like Jessica Heslam for decades.

The hypocrisy is staggering.

Matt Lauer´s misconduct was criminal if done in the workplace with lower level staffers. As were Bill Clinton´s actions with Monica Lewinsky. The EEOC issued regulations against sexual harassment in 1980. When someone continues to flirt after being told to buzz off, it constitutes harassment.

The Truth About Polygraph Tests

News organizations would render a valuable service if, whenever they report that someone has taken or proposes to take a polygraph, they reminded readers (or explained to them) that polygraphs are voodoo. Junk science. They are no more reliable than a pack of Tarot cards. Polygraph evidence is inadmissible in court. There is a good reason for that. To check Brett Kavanaugh’s qualifications for the Supreme Court, Congress would do well to ask him whether he believes Frye v. United States and United States v. Scheffer were correctly decided. This would be far more illuminating (and meaningful)

Eviscerating Kavanaugh: Sen. Feinstein,
have you no sense of decency?

Watching the slow, public evisceration of U.S. Supreme Court nominee Brett Kavanaugh by Senate Democrats —on the strength of one unsubstantiated charge of alleged sexual aggression 36 years ago when Kavanaugh was in high school — a question comes to mind: Have you no sense of decency, Sen. Feinstein? Decency was once an important feature of the Democratic Party’s story. Long before Bork became a verb, long before Clarence Thomas was dragged through the mud because a conservative black man proved a profound threat to Democrats, the party held fast to the notion of decency.

I hadn’t seen the article yet—my print issue is slow to arrive out here on the left coast—but it appeared online a few days ago, and I’ve given it a quick skim. A nation gawks as Washington sinks deeper into the muck, but put aside your disgust long enough to digest what we’re seeing. Three big things are on display. First, Democrats are proving again that their force multiplier is a win-or-die zealotry. They were on a mission to kill anybody President Trump chose to replace retiring Supreme Court Justice Anthony Kennedy and, within minutes of Brett Kavanaugh’s nomination, Senate minority leader Chuck Schumer announced he would fight Kavanaugh “with everything I have.” All 10 Dems on the Judiciary Committee pledged to vote no.

Christine Blasey Ford, the California professor claiming Supreme Court nominee Brett Kavanaugh sexually assaulted her more than 35 years ago, late Tuesday demanded a "full investigation" by the FBI before she attends any congressional hearing or "interrogation" into her accusations. In response, Judiciary Committee Chairman Chuck Grassley, who said Ford is still invited to speak to the committee, countered that "nothing the FBI or any other investigator does would have any bearing on what Dr. Ford tells the committee, so there is no reason for any further delay.” Lisa Banks, one of Ford´s lawyers,

History does repeat itself. Back in 1991, a college professor named Anita Hill accused Supreme Court nominee Clarence Thomas of sexual misconduct that she claimed had occurred many years before. The accusation came at the last minute, after lengthy hearings that had shown Thomas in a highly positive light. Senators took the charges seriously, even though Thomas, who is black, said during his nationally televised confirmation hearing that the charges amounted to “a high tech lynching.” Now it’s happening again, with Professor Christine Blasey Ford’s accusation that Judge Brett Kavanaugh drunkenly tried to rape her when they were both teenagers

But a Republican nominee to the Supreme Court is tried in the media, where Mr. Kavanaugh must now do the impossible: prove an assault never happened.
