| Today, a three-judge panel of the 11th Circuit Court of Appeals voted unanimously to bar the state of Florida from forcing welfare applicants to undergo drug testing. As the judges found: “… the State failed to offer any factual support or to present any empirical evidence of a “concrete danger” of illegal drug use within Florida’s TANF population. The evidence in this record does not suggest that the population of TANF recipients engages in illegal drug use or that they misappropriate government funds for drugs at the expense of their own and their children’s basic subsistence. Ok, AJC please show us where in the constitution it stipulates that the Federal Government shall or may be responsible for welfare in the first place. I´m pretty sure the Bill of Rights has 10 amendments, not just nine. It is time for us to throw the New Deal under the bus, and returned to the intent of the founding fathers.

This talk of "a cruel desire to bash and denigrate the poor" is a bunch of hooey, but that last sentence kinda makes sense. If we´re so concerned about the wise use of tax dollars, why don´t we drug test any and all entities that receive public funds?
And even if we did do that, what part of the Constitution could be cited as support for such a requirement?

Yes, I agree. Nowhere in the constitution is the government chartered with monitoring what we ingest and punishing us for ingesting things it might not approve of. The War On Drugs is itself unconstitutional. (At least with alcohol prohibition, the gov´t back then realized it needed the legal authority to ban a substance. The gov´t doesn´t bother with such petty nonsense anymore.)
It also bears mentioning welfare itself is unconstitutional. Nowhere is the government authorized to tax some citizens to give to other citizens.

So it´s legal for employers to drug test employees without cause, but illegal for government to do the same to eliminate the irresponsible parasites.

I actually agree with this ruling ...It´s the poster child for unreasonable search and seizure - Same goes for drug testing students or a cop swabbing you for a traffic stop. Whether the govt should be issuing welfare checks and to whom is a different story
