An Ohio woman filed a $25,000 lawsuit against her employer, alleging she was fired for voting for President Obama. Patricia Kunkle of Kettering, Ohio, claimed that Dayton-based Q-Mark, Inc., threatened to fire employees of the defense contractor if Obama won re-election, with the president’s supporters to be the first to receive pink slips, the Dayton Daily News reported. Kunkle said she had a conversation the day after Election Day that indicated she voted for Obama. She was fired three days later.

Comments:
She would have better grounds if she sued under the Americans with Disabilities act. What stronger evidence is there of being mentally disturbed than having voted for King Hussein?

Unless Ohio has some law that protects the employment of people regardless of political views, her employer probably had the right to fire her.

1. Company says lay-offs will happen if the O is re-elected.
2. You know your job is at risk.
3. Claim you voted for O.
4. Get fired.
5. Sue.

She was hired as a full-time employee in May, 2012. In an economic cutback, the last ones in are the first ones out.

I heard one Democrat say that he thought that telling employees "if Obama won he was going out of business" was unlawful cooercion. And he really believed that the employer commited a crime by doing that, telling them that..It will be interesting to see how this case turns out. She will have to prove that her confession of Obama voting was the reason for the firing and that it was illegal.

If I were the company´s attorney, I´d recommend offering her a nominal settlement on the condition that the whole thing remain confidential. It will cost them ten grand to defend the suit; if she gets her job back, she´ll cost them a whole lot more in lost productivity and problems. She sounds like a moron.

That´s usually the case, #15.

Considering how a reelected Obama was certain to reduce business for defense contractors like Q-Mark, anybody who voted for him was supporting layoffs around that industry. The probable consequence would be a shrinking payroll for Q-Mark. And if layoffs have to happen, it´s only fair that the first to go be those who freely chose the guy who would push the cutbacks that cause the layoffs in the first place.

only $25,000???? She doesn´t have any imagination or she´d be asking for bigger bucks. The company will probably give her a few grand as a nuisance law suit. Not worth the company´s time to fight. But who will hire her now?

Ohio is an at-will employment state.

The general rule in Ohio is that “unless otherwise agreed, either party to an oral employment-at-will agreement may terminate the employment relationship for any reason which is not contrary to law.” Ohio courts will favor a presumption of an at-will contract “unless the terms of the contract or other circumstances clearly manifest the parties’ intent to bind each other.” The Ohio Supreme Court has held, with some exceptions, that the right of an employer to terminate an employee’s employment for any cause at any time is absolute and cannot be limited by principles that protect persons from gross or reckless disregard of their rights, or from willful, wanton, or malicious actions or acts done intentionally, with insult, or in bad faith. It appears that Ms. Kunkle was deliberately setting things up with her voluntary admission that she´d voted for Obama. However, the "threat" was a general one that had to do with Obama´s being elected. That tends to support the economic hardship defense.

You cannot legally fire somebody for their political views or because they voted for a particular candidate. However, I do NOT believe this woman. The employer may have said something like "if Obama wins, we will have to cut jobs because we cannot afford to continue this way". But I really do not think he said he would fire anyone who voted for Obama. That would be suicide. She is just looking for ways to get money now that she is out of work.

Look again:

You can be fired for a host of reasons in at-will employment, such as for being a Cubs fan (an option I’m thankful my employers have decided to forego) or for not inviting someone to your happy hour (something you would never do, of course, because you like everyone you work with). And, perhaps most pertinently these days, you can usually be fired for being of the “wrong” political affiliation (not your political affiliation – the other one).

In another case (documented elsewhere) the ACLU advised a person who was fired for expressing a political belief that it was unfair but not illegal.

The U.S. Attorney’s Office in Buffalo says 42-year-old John Berry Jr. of Dunkirk pleaded guilty Tuesday to making a false claim against the United States. Prosecutors say he filed 122 false income tax returns in 2008 and 2009 seeking refunds totaling $218,000. Authorities say more than $92,000 was deposited directly into his bank account. Berry faces up to five years in prison when he’s sentenced in August.

One of two men allegedly being questioned in connection with the Boston Marathon bombings was shot and killed by an FBI agent in Florida on Tuesday, (Snip)A friend of Ibragim Todashev said he and Todashev were being investigated as part of the Boston bombings. He said Todashev, 27, knew bombing suspect Tamerlan Tsarnaev because both were MMA fighters. The man claims he and Todashev were interviewed by the FBI for nearly three hours on Tuesday. The friend said he left the interview, and when he came back to the apartment he found that there had been a shooting.
