| After four days on a crippled cruise ship with overflowing toilets, stifling heat and hours-long waits for food, at least one passenger from the Carnival Triumph is seeking legal revenge. But lawyers familiar with cruise ship lawsuits suggest angry passengers should think twice before rushing to the courts. Unless passengers suffered major injuries or other losses due to negligence by the cruise operator, they would be better off accepting compensation from Carnival Corp, they said.

It seems that unless a passenger suffers a fairly serious injury, he is buried in the legal caveats in his contract with the cruise line (otherwise known as "the ticket").

This is grossly inaccurate. You will see many successful suits or perhaps a class action suit against Carnivor. Obviously Reuters has a vulgar understanding of tort law among the several states -- even if passengers signed a choice of law provision, there will be a worthwhile cause of action against Carnivor. There may also be some claims under Contract as well. Reuters obviously cannot afford decent legal advice.

It´s pretty tricky to sue because of all the clauses and jurisdiction issues. My brother said he´s never take a cruise suit unless it involved serious injury or death. The fine print in the ticket/contract pretty well covers the company´s butt.
That said, no one I know is dumb enough to get on one of those foreign floating feedlots. Yuck.

Please, let´s get the story straight.
The PAX will get a full refund, a future free cruise, and 500. each.
It was an unfortunate incident to be sure, and I really feel sorry for them, but it was not anyone´s fault. Some days you´re the windshield, some days you´re the bug.

This isn´t about a cruise, but Rush sure made a relevant point today: the only problem this ship suffered was the loss of electricity. And this is what our country will be like when our grids are shut down or unable to be used for lack of coal, etc. Think about it. And it only took three days for people to get upset.

I have been strongly tempted to get a rubber stamp, and when I go to a hospital, or see a doctor, to stamp the legal statements, with the words "Singed under Duress".
When you are bleeding, you have no choice.
Furthermore, why should I sign something for a cruse? The airlines don´t ask for it.

The lack of sanitary conditions on the ship was very dangerous. I bet 99% of the people on the Carnival Cruise will NEVER use their voucher for a free cruise -- unless they give it to disliked relatives.

#4, I disagree that it´s ´not anyone´s fault´ because the cruiseline had 4 days to get these passengers off that ship and somewhere with santitary conditions. They were not 2,000 miles away from civilization and IMO it could have been done. This is where I think the cruiseline is vulnerable. I think they will have a class-action suit and will settle for several thousands per passenger.

MOORE, Okla. Authorities have clarified and significantly downgraded the number of homes damaged or destroyed in this week´s tornado in an Oklahoma City suburb. Oklahoma City Police Department spokesman Dexter Nelson said Thursday that the most recent count indicates that 1,200 homes in the city and the suburb of Moore were affected by Monday´s storm. The mayor of Oklahoma City announced at a news conference Wednesday that as many as 13,000 homes had been destroyed or damaged. There was no immediate explanation for the differing estimates.

One of two men allegedly being questioned in connection with the Boston Marathon bombings was shot and killed by an FBI agent in Florida on Tuesday, (Snip)A friend of Ibragim Todashev said he and Todashev were being investigated as part of the Boston bombings. He said Todashev, 27, knew bombing suspect Tamerlan Tsarnaev because both were MMA fighters. The man claims he and Todashev were interviewed by the FBI for nearly three hours on Tuesday. The friend said he left the interview, and when he came back to the apartment he found that there had been a shooting.

On “Fox News Sunday” last weekend, White House aide Dan Pfeiffer was asked about President Barack Obama’s whereabouts the night of the Sept. 11 attack in Benghazi. This was the night when we lost our first ambassador in 30 years, and when three other Americans were killed in an attack that lasted all night long at multiple locations within the eastern Libyan city. Since the president is commander in chief, one would think where he was and what he did during such an event would be of obvious public concern.
