| TRENTON — The state Supreme Court ruled unanimously today that a Cape May County mother did not abuse her child by using cocaine two days before she gave birth since the infant was born unharmed. The decision by the justices underscored its belief that only a child that has been born — and not a fetus — can be protected by New Jersey´s child protection law. All child abuse cases weigh a parent´s right to "raise a child without undue interference by the state" and the state´s "responsibility to protect the welfare of children," Chief Justice Stuart Rabner wrote.

That´s right ladies, it´s cool to use dope during your pregnancy, after all the main thing is that the harm you do to you unborn child can not be used to undermine the underpinnings of Roe v. Wade.

two days before birth a 9 month old baby is just a fetus. Two days later it is a person. And they say the right is filled with neanderthals that refuse to accept science. Prove that insanity with this decision if you can.

Actually this was a good ruling. The court ruled that the state has to show that the behavior actually caused harm in order to charge someone with causing harm to a child. The question I have is, how would the court rule in a case where a mother gave cocaine to an already born child? Did the state argue that the mother´s use of cocaine was no different than if she had injected (or otherwise administered) cocaine into her child?

Outrageous.
Isn´t it true that if that fetus was killed when, let us say, the mother was injured when her purse was snatched, that the robber could be charged with murder? We can´t keep having it both ways.

Hillary Clinton´s return to the living was almost flawless. Almost. She unveiled her Twitter account (young and with-it), and referred knowingly to the pantsuit (mature and self-aware). She didn´t look tan (that would be too "Real Housewives of New Jersey") but seemed rested (that´s what almost six months of downtime will do for you) and ready (returning to her animating issues of girls and early childhood through her Too Small to Fail initiative). She picked a rocking photo (dark shades, in the bulkhead seat of her secretary of state airplane, thumbing her BlackBerry).

Such is the case for the Afghan Taliban, which was declared a FTO (Foreign Terrorist Organization) by U.S. President George W. Bush.
