| The D.C. Circuit Court of Appeals emphatically smacked down the crazy idea that the president has the power to make recess appointments while the Senate is not in recess. "An interpretation of ´the Recess´ that permits the President to decide when the Senate is in recess would demolish the checks and balances inherent in the advice-and-consent requirement, giving the President free rein to appoint his desired nominees at any time he pleases, whether that time be a weekend, lunch, or even when the Senate is in session and he is merely displeased with its inaction,"

Comments: He suggests, and rightfully so, that congress zero out the funding for the NLRB. In the meantime, they should be brought before the court for sanctions in disobeying the court order. Maybe Mark Levin will do something since he was involved in the lawsuit. The regime did the same thing with a New Orleans judge when they continued a moratorium on deep water drilling when ordered to stop.

I think impeachment proceedings should be started right away. While at it, send the federal marshalls over to Holder´s office and frog march him to jail.

I think this is a perfect opportunity for Scalia to correct the MSM regarding his statement about the constitution! Hopefully Levin will fast track this to the Supremes.

Impeachment is not an option. Too many radical groups are armed, trained & ready to riot.
Nooo... Obama needs to be so publicly humiliated, even his handlers will want him to resign. His Muslim Brotherhood Arab Spring bloopers may do it... or arming Al Qaeda and Mexican Cartels....

I am not advocating for violence, however they should be reminded that without the Constitution they are nothing but thugs and thieves who should be rightfully hung from trees.
The course of wisdom would be to seek to avoid that outcome. It isn´t just a matter of convenience; they ignore the Constitution at their mortal peril.

President Obama on Thursday nominated Victoria Nuland, a State Department official involved in the editing of the administration´s talking points on Benghazi, to be the next assistant secretary of state for European and Eurasian affairs. Nuland, a career foreign service officer who was until recently State´s top spokesperson, had long been expected to be nominated the post to replace Philip Gordon, who Obama picked to serve as Middle East coordinator for the National Security Council. Nuland´s nomination -- which requires Senate confirmation -- could come under scrutiny from Republicans who see her as playing a central role in shaping

America´s 100 million cable and satellite subscribers are forced to pay ever-higher bills for a growing number of channels they do not watch. The American people are being ripped off. Meanwhile, services such as iTunes and Netflix have led a revolution in how consumers purchase and experience music and video entertainment. They have upended entire industries to allow consumers to buy digital content where they want, when they want. Amid all this change, two entrenched interests — the cable television and video programming industries — have teamed up to use federal regulations to stack the deck against consumers.

Conservative radio host Mark Levin is very skeptical of the idea that President Obama had absolutely no idea about the IRS tea party targeting before the story broke in the news mere weeks ago. Levin declared adamantly that it is a “flat-out, bald-faced lie” that Obama didn’t know beforehand, citing prior reports by a few conservative news outlets picking up on the news well before the 2012 presidential election. Levin said, “I don’t believe for two seconds that Obama wasn’t aware of this.”

President Obama is a little uneasy with the way journalists have been dragged into the Justice Department’s aggressive pursuit of national security leak investigations. In fact, he has ordered Attorney General Eric Holder to conduct a 45-day review of the department’s guidelines on the issue. That bit of news was buried in the middle of the president’s hourlong speech today at National Defense University. “Journalists should not be at legal risk for doing their jobs,” President Obama said. “Our focus must be on those who break the law.” And then the news: “I have raised these issues with

Anthony Weiner’s nascent mayoral campaign is off to a rough start. Weiner made his candidacy for mayor of New York official in the wee hours of Wednesday morning, and since then there’s no indication that the process is going particularly well. The former rising star in the Democratic Party can’t shake the scandal that forced him to resign from Congress, and he may be throwing fuel on the fire. Asked this morning whether there was another shoe to drop in the sextweeting scandal that ousted him, Weiner admitted, Well, yeah.

White House press secretary Jay Carney could only explain his problems on Wednesday by telling reporters, "[T]here are a lot of you, and you´re good at your jobs and you´re smart." As easy as it might be for Carney to lob such insincere praise at former journalistic colleagues, such posterior osculations must be embarrassing for a White House so accustomed to having the press in its back pocket. Carney´s job has become more difficult in the past two weeks. Where his explanations were accepted at face value in the past, he is now met with deep skepticism. Suddenly, the

WASHINGTON – First she refused to testify. Now Lois Lerner, the IRS official at the center of the agency scandal, is refusing to resign, according to a top Republican senator. Sources confirmed to Fox News earlier Thursday that Lerner, the head of the IRS division that oversaw the unit targeting conservative groups, had been placed on administrative leave, with pay. But Sen. Charles Grassley, R-Iowa, claimed she was only put in that status after refusing to step down. He said the commissioner was in his right to demand her resignation, and said taxpayers

Former Rep. Anthony Weiner, whose career in public life came to an abrupt end when he sent lewd pictures to a college student on Twitter, jumped back into politics on Wednesday by announcing a bid for mayor of New York City. “Look, I’ve made some big mistakes and I know I’ve let a lot of people down,” the Democrat said in a 2-minute video announcing his bid. “But I’ve also learned some tough lessons. I’m running for mayor because I’ve been fighting for the middle class and those struggling to make it for my entire life.

The dam protecting the IRS scandal began to crack today when Lois Lerner, the IRS official who announced, and apologized for, the improper singling out of conservative-leaning organizations by IRS employees under her command, announced through her criminal defense lawyer that she will not testify as scheduled tomorrow before the House Oversight Committee. Rather, she will assert her Fifth Amendment right against self-incrimination. This marks an enormous milestone in the IRS investigation. It can now be taken as more or less established that crimes were committed by Obama administration employees. Lerner’s lawyer tried to minimize the significance

The public got its first look Thursday at Lois Lerner, who has gone from faceless IRS bureaucrat to the face that launched what feels like 1,000 congressional hearings and conspiracy theories. But it was only a brief sighting since she didn´t stay long at a House hearing to further probe her role in how some IRS workers came to target conservative groups seeking tax-exempt status. (Snip)She did make a short statement to declare her innocence, however. Lerner´s motivation was more transparent than much of what the IRS has done in connection with this controversy. She was determined to

When you get right down to it, the political targeting and stalling of tax-exempt applications by the IRS was an effort to defund the Tea Party. Rick Santelli, one of the Tea Party founders and my CNBC colleague, was the first to make this point. I’ve taken it a step further: The IRS was taking the Tea Party out of play for the 2012 election, as it looked to avoid a repeat of 2010 and another Tea Party landslide. There are a lot of numbers out there.

What´s so interesting about 60 tea partiers protesting the IRS in San Jose, California on Tuesday, May 21st? The fact that this bit of information was conveyed to the protesters by a Department of Homeland Security officer who was also in attendance. What was a DHS agent doing at the San Jose Tea Party protest? (snip) they weren´t just spying on us in San Jose and monitoring us in San Francisco, they were watching us throughout the entire state
