FORT HOOD, Texas – A judge has decided a Fort Hood shooting suspect still can face the death penalty if convicted in the worst mass shooting on a U.S. military installation. The judge, Col. Tara Osborn, on Wednesday denied Maj. Nidal Hasan´s request to remove the death penalty as a punishment option. Osborn was expected to rule later on Hasan´s request to plead guilty to 13 counts of premeditated murder in the 2009 attack on the Texas Army post. But Army rules prohibit a judge from accepting a guilty plea in a death penalty case.

If he is allowed to plead guilty, Obama and the US Army leadership escape scrutiny on why this Muslim´s officer´s anti-American hatred was ignored and why he was promoted after his jihadist rants. Plea deal also eliminates evidence about Hasan´s frequent contacts with another American Muslim terrorist, Alawaki. FBI knew of Hasan´s email exchanges with Alawaki, whom we killed in a drone strike in Yemen. Yet these contacts were apparently ignored by Army, which was about to send Hasan to Afghanistan as a psychiatrist for our soldiers. Can bet that Army accepts a plea deal of life imprisonment.

It is obvious that the administration wants to drag this out as long as possible. Nor does it want to admit the shooting was an act of terrorism. Sympathy for a "Soldier of Allah"?

The higher court ruled with a non-comment regarding his bear, thus upholding the trial court´s decision and order to shave the beard. The area most under contention (that is argued by the Army) is, that with witnesses coming to the stand to identify the culprit (Hasan), he was clean shaven when he shot the victims, and the witnesses could have trouble identifying him with his beard- aside from Army regulations that do not allow the beard. Hasan is still rcieving his full pay as a Major in the US Army. The court then issued the order for Hasan to be forcefully shaved. But, then immediately stayed the order, pending resolution of the rest of Hasan´s appeals. The trial is also now under a new Judge. Hasan has been allowed to attend court proceedings with his beard.

Also, he has not been allowed to plead guilty. The Army regulations do not allow a guilty plea in cases where the defendant may receive the death penalty- the trial must proceed as though the defendant had plead not guilty.

Should we be getting just a wee bit impatient with this case? Hassan committed his evil act in November 2009. It is now the end of January 2013 and we still have no trial for this guy. I wonder how much longer "justice" will be delayed. Why can´t the military just try the SOB? We´re in the 4th year of horsing around with no end yet in sight. You´ve got to love our legal system. We surely don´t want to trample on his rights. Let´s make sure he has his prayer rugs, his Koran, his halal meals and God forbid, don´t touch his beard.

It seems like he could effectively plead guilty by presenting no defense. Or even by voluntaryly testifying about what he did.

Would that violate any legal principles?

Instead, for some reason, this case has taken years. And one complaint after another has been examined like some new Commandment found carved on Mt. Sinai.

At the rate this case is proceeding, the man may pass on from old age before he is tried.
There is definitely something very wrong with
the system of justice in this case. You know, there are many victims here who deserve better.

SO when does his trial start...4 years later is NOT Justice, it is a sham allowing his lawyers to play the system.

Your trial starts in 1 week. If your attorneys are not ready then they face a $1M penalty for contempt of court!

Obama, being a Muslim, CANNOT sign Nidal´s death warrant. A muslim cannot sentence someone to death for killing in jihad. The worst penalty they get for killing another muslim they deem not muslim enough is a lashing.

The trial will be postponed until Obama is out of office. Mark my words on this.

Has anyone else wondered why this guy did not go for Obama himself? If you´re on a jihad, why not try to kill the POTUS? That was a goal on 9/11/01 for the plane that our guys took down in the field in PA. Hasan was on Obama´s transition team and I think I have seen him in pictures with Obama. So, if he could get that close, why didn´t he make a try for Obama? Perhaps Al Awalki (whatever his name was) had issued orders to protect Obama, but to try for non-Muslim soldiers.
