| On Jan. 25, the 8th Circuit Court of Appeals rapped the president´s knuckles for disregarding the constitutional limits on his power. If the court´s unanimous opinion, Noel Canning v. NLRB, is upheld on appeal, it will reverse the centurylong trend toward unfettered presidential power and breathe new life into the checks and balances the Framers devised. The president picked this legal fight when he made three appointments to fill vacancies on the National Labor Relations Board (NLRB) on Jan. 4, 2012. The date is important, because the president claimed to be making "recess appointments."

"that´s not fair. OTHER presidents did it why can´t I? We must have a level playing field."
If only it were this easy to slap his wrists and nudge the dark one to do the ´right´ thing. That will never happen He will ignore the ruling and do as he wishes. Shades of the ruling made on off shore drilling.

Is the court that made this ruling correctly identified in the article? I thought that the court that ruled was the Court of Appeals for the DC Circuit?

I believe #2 is correct. The 8th District Circuit court was involved in another NLRB matter, but not this one.

MOORE, Okla. Authorities have clarified and significantly downgraded the number of homes damaged or destroyed in this week´s tornado in an Oklahoma City suburb. Oklahoma City Police Department spokesman Dexter Nelson said Thursday that the most recent count indicates that 1,200 homes in the city and the suburb of Moore were affected by Monday´s storm. The mayor of Oklahoma City announced at a news conference Wednesday that as many as 13,000 homes had been destroyed or damaged. There was no immediate explanation for the differing estimates.

He will not mediate between the parties; his work will almost exclusively involve contacts with Israel. (ORLANDO, Fla.) — A Chechen immigrant shot to death in central Florida after an altercation with an FBI agent had several ties to that of one of the Boston Marathon bombing suspects who authorities were questioning him about at the time.(Snip)Three law enforcement officials, speaking on condition of anonymity, said Todashev had lunged at the FBI agent with a knife. What´s so interesting about 60 tea partiers protesting the IRS in San Jose, California on Tuesday, May 21st? The fact that this bit of information was conveyed to the protesters by a Department of Homeland Security officer who was also in attendance. What was a DHS agent doing at the San Jose Tea Party protest? (snip) they weren´t just spying on us in San Jose and monitoring us in San Francisco, they were watching us throughout the entire state

On “Fox News Sunday” last weekend, White House aide Dan Pfeiffer was asked about President Barack Obama’s whereabouts the night of the Sept. 11 attack in Benghazi. This was the night when we lost our first ambassador in 30 years, and when three other Americans were killed in an attack that lasted all night long at multiple locations within the eastern Libyan city. Since the president is commander in chief, one would think where he was and what he did during such an event would be of obvious public concern.

House Oversight and Government Reform Committee Chairman Darrell Issa said embattled IRS official Lois Lerner waived her Fifth Amendment rights and will be hauled back to appear before his panel again. The California Republican said Lerner’s Fifth Amendment right to avoid self-incrimination was voided when she gave an opening statement this morning denying any wrongdoing and professing pride in her government service. “When I asked her her questions from the very beginning, I did so so she could assert her rights prior to any statement,” Issa told POLITICO. “She chose not to do so — so she waived.”
