In a case freighted with major constitutional implications, a federal appeals court on Friday overturned President Obama’s controversial recess appointments from last year, ruling he abused his powers and acted when the Senate was not actually in a recess. The three-judge panel’s ruling is a major blow to Mr. Obama. The judges ruled that the appointments he made to the National Labor Relations Board are illegal, and hence the five-person board did not have a quorum to operate. But the ruling has even broader constitutional significance
“This panel of the D.C. circuit has accomplished what Minority Leader Mitch McConnell failed to do. Minority Leader McConnell said that his No. 1 objective was defeating Barack Obama and Barack Obama’s attempt to govern. This D.C. circuit panel has been successful where McConnell failed. they have really, effectively challenges the president’s ability to govern,” Mr. Williams said.
Mr. Williams the Founders did not set up the federal government so that the President could govern efficiently.
They set up the federal government so that the President was required to govern minimally.
We find ourselves were we are because liberals like you persistently, perniciously, refuse to accept that fact.
This is wonderful...finally, someone is standing up against this miserable tyrant who sees nothing wrong with breaking the absolute law of the land. Evil cretin. We need more men and women of integrity to stand up and stop the powermongers who are destroying this country.
This is only one of the many unconstitutional acts this sack of pus has performed. Then there are all of the unconstitutional acts by the congress. A long, long, long way to go to get back even close to where we should be.
Oh wow bamboozler thought he had free reign to reign with no reference to any laws. If this goes the same was as the healthcare bill, the supremes will rule in his favor. Roberts will say we´ve come too far with what bamster has done to turn back now, which raises a new point: Do we have to tolerate Supremes who always rule in bamboozler´s favor? Is that objective? Watch Kagan and Sotomayor rule his way every time, day in, day out. We should start a petition to have them removed, once proven they cannot be objective and are nothing more than Obama stooges. We do not have to accept status quo.
Maybe now the courts will have the fortitude to attack the BIG question of Obambi´s constitutional qualifications. I´d accept a riot in South Central Los Angeles because he was run from office than to have our Constitutiuon torn to shreds. The riots will end but a loss of our rule of law will live forever
Radical Leftists like Obama do not agree with the American political system of checks and balances. Many do not even understand it. Their mentality is that of Lenin and the Dictatorship of the Proletariat. They have contempt for true representative government because it inevitably presents and presses for a wide variety of political opinions. Leftists are elitists are authoritarians at heart. They despise the mess, clamor, confusion and above all the delay of democracy. Though they profess devotion to democratic, egalitarian ideals, what most of them actually want is a submissive population and unfettered political power to do what they think is best. Though it sounds strange to say it, a remarkable number of radical Leftists like Obama are simply unable to comprehend the idea that they just might not know and be right about everything - that people who disagree with them not only have the right to do so, but may even upon occasion prove to be correct.
American schools and universities do not seem to be doing a satisfactory job of educating future citizens in the basic principles of representative Constitutional government. This can and will have grave consequences for the Republic if it continues.
These picks were so bad that Reid wasn´t going to get them confirmed. Obama decided to break the rules and deal with the consequences if some judge ruled against him. It just the end of his first term, but a growing number of judges have learned that he´s a lousy constitutional scholar and often chooses to operate outside the law.
Any normal person would be taking a hard look at the lawyer who gave them the bad legal advice that they could make these appointments. But these people are all hardcore ideologues. They know precisely what action they intend to take, and then fabricate tortured and erroneous legal arguments to support their illegal actions.
This is a great victory and maybe a turning point in obama´s lawless behavior. We will now see if our system is truly broken. All rulings by this illegal board should be null and void. And why should the Supremes take this up? The Constitution is clear, and the court´s decision was unanimous.
This ruling isn´t going to make a whit of difference to Obozo. He will just ignore it like he did that federal judge´s ruling during the Deepwater Horizon episode. And what will be the consequences of that action? Do you really think that a federal marshall is going to the WH and arrest him? He is creating a Constitutional train wreck and that is just what he wants. To rule, not govern, without any restraints. And it seems that he is getting just that.
OK. Lets say this goes to the sort-of Supreme Court and Obama loses again. What difference does it make? Who will do anything about it and enforce the constitution? No one, in my opinion. He can just thumb his nose at everyone and half of the country will support him. Heck, they don´t even know what the LRB is or does, they don´t care. Even if the House impeached there is no way the Senate would do anything as there are probably only a dozen senators with any brass.
#15, it´s time to link the reckless disregard for the rule of law to the out-of-control Senate Democrats who didn´t stand-up and defend the U.S. Constitution like they´re required to do, and took oath.
There are a bunch of Senate Democrats who are running in 2014, and it´s time to stick them with the out-of-control spending, debt and everything else. After all, they didn´t do their job in last 4 years.
No, #7. The media is misrepresenting the issue - even Fox news - so it is no surprise that people don´t understand. NO one else has ever done this, because Obama made these recess appointments when the Senate was still technically in session. Actual recess appointments are not unconstitutional and it does not matter how many were made by Bush or Reagan. When the dems began using profarma sessions to prevent recess appointments by Bush, he did not try to make appointments anyway as Obama has. The distinction is quite pronounced.
Anytime we get an abuse-of-oower ruling from an appeals court, that is prtty good. Levin says it is not a criminal situation but that any of the cases before the NLRB during this time shoud file suit and firle to have the suit result overturned.
This will come up later as abuse of power. If we can get 3 or so of these sbuse of power ruling it will smear his legacy and might be more. thing grind slowly in the US jurisprudence
Apologies to #7. You are not wrong. Although the suit was brought because Obama made appointments while the Senate was still technically in session, the judges decision is much broader and puts other recess appointments in question.
Tea party groups and fiscal conservatives wasted no time Wednesday in savaging a bipartisan budget agreement negotiated between House Republicans and Senate Democrats, drawing an unusually angry response from House Speaker John A. Boehner, Ohio Republican. All sides were rating the winners and losers in the deal struck a day earlier between House Budget Committee Chairman Paul Ryan, Wisconsin Republican, and Senate Budget Committee Chairwoman Patty Murray, Washington Democrat. The modest deficit-cutting deal had some sweeteners for defense contractors and oil drillers, while air travelers, federal workers and some corporate executives would take a hit.
The White House blasted Republicans on Wednesday for criticizing President Obama’s decision to shake hands with Cuban leader Raul Castro. “There used to be a pretty important principle, that originated in the Republican Party, I believe, that partisan politics should stop at the water’s edge,” said White House deputy press secretary Joshua Earnest. “It’s unfortunate that we did see a number of Republicans yesterday who criticized the president for a handshake.” Mr. Obama shook hands with Mr. Castro on stage in South Africa at the memorial service for Nelson Mandela on Tuesday. The U.S. does not have diplomatic relations with
FAIRPORT HARBOR, Ohio — It doesn’t take long to realize that Jim Majoros is passionate about his job, as he ponders the hue of a new hunting rifle he’s working on. “I’m going to call it ‘Persephone,’ ” he said, referring to the Greek goddess. “It’s going to be light green in color, you know, more soft, but for women who want to hunt.” Business is brisk for gunsmiths such as Majoros, who repairs and customizes firearms in this small Lake Erie beach town east of Cleveland. This year, more than 82,000 new concealed-carry weapons licenses were issued in Ohio
House Republicans appeared Wednesday to be rallying around an $85 billion deal to avert another government shutdown, brushing off complaints from their right wing that the effort would trade immediate spending cuts for less-certain long-term savings. After conducting a series of closed-door briefings and polling members during a late-afternoon vote, GOP leadership aides confidently predicted that the deal struck between House Budget Committee Chairman Paul Ryan (R-Wis.) and Senate Budget Committee Chairman Patty Murray (D-Wash.) would sail through the House when it comes to a vote Thursday. The moment seemed to mark a potentially significant shift by House Republicans away
A year that began with President Barack Obama riding high after his re-election victory and inauguration ends with him in the biggest hole of his presidency. A new NBC News/Wall Street Journal poll finds the president with more Americans disapproving of his job performance than ever before; with half saying they’re either disappointed or dissatisfied with his presidency; and with 54% believing he’s facing a long-term setback. Perhaps more significantly, Obama has seen a drop in key presidential attributes, such as being honest and straightforward, being able to handle a crisis and being able to achieve his goals. “These are
The federal health-care law is becoming a heavier political burden for President Barack Obama and his party, despite increased confidence in the economy and the public´s own generally upbeat sense of well-being, a new Wall Street Journal/NBC News poll suggests. Disapproval of Mr. Obama´s job performance hit an all-time high in the poll, at 54%, amid the flawed rollout of the health law. Half of those polled now consider the law a bad idea, also a record high. The survey of 1,000 adults conducted between Dec. 4 and Dec. 8 found a sharp erosion since January in many of the
House and Senate negotiators announced Tuesday evening a $1.012 trillion two-year budget deal to replace some of the automatic spending sequester budget cuts and avert another government shutdown in January. Rep. Paul Ryan, Wisconsin Republican, said the two-year plan is a win for Republicans since it reduces the deficit by $23 billion without raising taxes or sacrificing core conservative values. “As a conservative, I think this is a step in the right direction. What am I getting out of this? I’m getting more deficit reduction. So the deficit will go down more by passing this than if we did nothing,”
When I was a kid, I knew two different Santa Clauses. The first had a fat belly, rosy cheeks, a long white beard, and skin as pink as bubble gum. He was omnipresent, visiting my pre-school and the local mall, visible in all of my favorite Christmas specials. Then there was the Santa in my family’s household, in the form of ornaments, cards, and holiday figurines. A near-carbon copy of the first one—big belly, rosy cheeks, long white beard: check, check, check. But his skin was as dark as mine. Seeing two different Santas was bewildering. Eventually I asked my father what
US President Barack Obama may have moved the masses attending Nelson Mandela’s memorial service with his stirring eulogy, but it was his grinning "selfie" with the Danish and British premiers that set social networks abuzz. In a candid moment captured by a photographer, Denmark’s Prime Minister Helle Thorning-Schmidt can be seen holding up her smartphone, with Obama lending a helping hand, as they pose for a picture with David Cameron, all three of them smiling broadly in their seats at Soweto’s World Cup stadium.(Snip)Mashable, the news and technology website, ran the photograph under the headline: ‘‘Dear Obama: Funerals are no place
Johannesburg - A man who provided sign language interpretation on stage for Nelson Mandela´s memorial service, attended by scores of heads of state, was a "fake," the national director of the Deaf Federation of South Africa said on Tuesday. Asked about the claim by The Associated Press, South Africa´s government said it was preparing a statement. Three sign language experts said the man was not signing in South African or American sign languages. South African sign language covers all of the country´s 11 official languages, according to the federation. It wasn´t immediately clear if the unidentified man was using a
On his way to the podium at the memorial ceremony for former South African president Nelson Mandela, President Obama walked down the line of dignitaries, greeting other leaders there to pay their respects. Among the hands shaken: that of Cuban leader Raul Castro. Obama neither made a special effort to shake Castro’s hand nor to avoid him. A snub might have been awkward: In his speech, Obama praised Mandela’s “greatest gift” as “his recognition that we are all bound together in ways that can be invisible to the eye; that there is a oneness to humanity; that we achieve ourselves by
House Speaker John Boehner (R-Ohio) snapped at conservative groups that have come out in opposition to the budget deal reached Wednesday between Rep. Paul Ryan (R-Wis.) and Sen. Patty Murray (D-Wash.). "They´re using the American people for their own purposes. This is ridiculous," Boehner said at a press conference with other members of House Republican leadership on Wednesday. Over the past few days, a number of conservative groups have blasted the deal because it sets discretionary spending levels in the budget higher than previous levels under sequestration. In the past three days, the influential Heritage Action, Club for Growth, Americans
A black fashion student says he was brutally attacked by a gang of Hasidic men who shouted anti-gay slurs at him while he was walking through Williamsburg after a night of partying, the Daily News has learned. Taj Patterson, 22, was headed home to Fort Greene around 4:30 a.m. on Dec. 1 when he says more than a dozen ultra-Orthodox Jewish men began assaulting him on Flushing Ave. and yelling, “Stay down, f----t!”
A “presidential selfie” featuring President Barack Obama, British Prime Minister David Cameron, and Denmark’s Prime Minister Helle Thorning-Schmidt at Nelson Mandela’s memorial service began making the rounds this morning, but it’s the person not included in the frame who caught everyone’s attention: As anyone with two eyes and a Twitter account has noticed, Michelle Obama does not appear amused. Of course, though a picture says a thousand words, not all of those words are necessarily true. FLOTUS might not have even known the photo was taking place. Or she could disapprove of funeral selfies. Either way.
