In a case freighted with major constitutional implications, a federal appeals court on Friday overturned President Obama’s controversial recess appointments from last year, ruling he abused his powers and acted when the Senate was not actually in a recess. The three-judge panel’s ruling is a major blow to Mr. Obama. The judges ruled that the appointments he made to the National Labor Relations Board are illegal, and hence the five-person board did not have a quorum to operate. But the ruling has even broader constitutional significance

Oh wow bamboozler thought he had free reign to reign with no reference to any laws. If this goes the same was as the healthcare bill, the supremes will rule in his favor. Roberts will say we´ve come too far with what bamster has done to turn back now, which raises a new point: Do we have to tolerate Supremes who always rule in bamboozler´s favor? Is that objective? Radical Leftists like Obama do not agree with the American political system of checks and balances. Many do not even understand it. Their mentality is that of Lenin and the Dictatorship of the Proletariat. They have contempt for true representative government because it inevitably presents and presses for a wide variety of political opinions. Leftists are elitists are authoritarians at heart. They despise the mess, clamor, confusion and above all the delay of democracy. Though they profess devotion to democratic, egalitarian ideals, what most of them actually want is a submissive population and unfettered political power to do what they think is best. Though it sounds strange to say it, a remarkable number of radical Leftists like Obama are simply unable to comprehend the idea that they just might not know and be right about everything - that people who disagree with them not only have the right to do so, but may even upon occasion prove to be correct.

American schools and universities do not seem to be doing a satisfactory job of educating future citizens in the basic principles of representative Constitutional government. This can and will have grave consequences for the Republic if it continues.

These picks were so bad that Reid wasn´t going to get them confirmed. Obama decided to break the rules and deal with the consequences if some judge ruled against him. It just the end of his first term, but a growing number of judges have learned that he´s a lousy constitutional scholar and often chooses to operate outside the law.

Any normal person would be taking a hard look at the lawyer who gave them the bad legal advice that they could make these appointments. But these people are all hardcore ideologues. They know precisely what action they intend to take, and then fabricate tortured and erroneous legal arguments to support their illegal actions.

This is a great victory and maybe a turning point in obama´s lawless behavior. We will now see if our system is truly broken. All rulings by this illegal board should be null and void. And why should the Supremes take this up? The Constitution is clear, and the court´s decision was unanimous.

This ruling isn´t going to make a whit of difference to Obozo. He will just ignore it like he did that federal judge´s ruling during the Deepwater Horizon episode. And what will be the consequences of that action? Do you really think that a federal marshall is going to the WH and arrest him? He is creating a Constitutional train wreck and that is just what he wants. To rule, not govern, without any restraints. And it seems that he is getting just that.

OK. Lets say this goes to the sort-of Supreme Court and Obama loses again. What difference does it make? Who will do anything about it and enforce the constitution? No one, in my opinion. He can just thumb his nose at everyone and half of the country will support him. Heck, they don´t even know what the LRB is or does, they don´t care. Even if the House impeached there is no way the Senate would do anything as there are probably only a dozen senators with any brass.

It´s a start - but it´s a start that is too late.

The judges decision will be ignored (ala Gulf drilling) and nothing will happen.

Obo knew this should be the outcome of his appointments. It was a gamble since the Supreme Court is not reliable constitutionalists. (ala Obamacare, McCain/Feingold)

NLRB should be defunded immediately since there is not a legal quorum sitting on the board.

#15, it´s time to link the reckless disregard for the rule of law to the out-of-control Senate Democrats who didn´t stand-up and defend the U.S. Constitution like they´re required to do, and took oath.

There are a bunch of Senate Democrats who are running in 2014, and it´s time to stick them with the out-of-control spending, debt and everything else. After all, they didn´t do their job in last 4 years.

No, #7. The media is misrepresenting the issue - even Fox news - so it is no surprise that people don´t understand. NO one else has ever done this, because Obama made these recess appointments when the Senate was still technically in session. Actual recess appointments are not unconstitutional and it does not matter how many were made by Bush or Reagan. When the dems began using profarma sessions to prevent recess appointments by Bush, he did not try to make appointments anyway as Obama has. The distinction is quite pronounced.

Anytime we get an abuse-of-oower ruling from an appeals court, that is prtty good.
Levin says it is not a criminal situation but that any of the cases before the NLRB during this time shoud file suit and firle to have the suit result overturned.

This will come up later as abuse of power. If we can get 3 or so of these sbuse of power ruling it will smear his legacy and might be more. thing grind slowly in the US jurisprudence

Apologies to #7. You are not wrong. Although the suit was brought because Obama made appointments while the Senate was still technically in session, the judges decision is much broader and puts other recess appointments in question.
