As a follow-up to my previous post, I have now read the decision, and it is a very strong one indeed. All three judges agreed that the Senate is only in recess when it has adjourned sine die (Latin for “without a day,” i.e. without setting a date to meet again). This happens only at the end of the first session of a Congress when the second session will begin (as per Amendment XX, Sec. 2) on the next January 3rd, or at the end of the second session, when a newly elected Congress will assemble on that date.

Listening to Mark Levin´s follow-up to this. The NLRB, it seems, will basically ignore the heart of this decision. They´ll only vacate the specific case, and simply "move on" with the unconstitutionally-appointed members in place.

Please contact Fox News. Both Shep Smith and Ed Henry falsley presented the issue as one regarding mere recess appointments. They then gleefully went on to proclaim that Bush made more such appointments than Obama. There was no acknowledgement of the distinction - that Obama made these appointments despite the fact that the Senate was in proforma session. Bush NEVER did this. I expect deception from all the other networks, but it is time to demand honesty from the media - starting with so-called fair and balanced Fox. E-mail is Specialreport@foxnews.com.

But will the grand kenyan emporeror, president hologram, obey the courts? OR will he insist that the appointees remain in place?
(Don´t forget, by the way, that the democrats kept the senate in session for a couple of years, with slimy James Webb calling the senate to order regularly.)

#3, You´re right. There´s NO WAY Bush could have gotten away with this. He had the media on his back 24/7; they actually DID THEIR JOBS back then. This guy can get away with anything he wants because the fourth estate is complicit. Never before has the republic been in THIS much danger because of that very fact.

Obama has already demonstrated a willful disregard for court orders. Remember the drilling moratorium? The rulings against Obamacare?

Poster # 3 - the liberal woman on Bret Bair´s 6:40 pm panel this evening tried the same deceptive equivalency but Bret was quick to correct her deception. If the Obama loving Sheperd Smith did the same thing 20 minutes later, it is more than coincidence. Would guess that WH had a conference call for reporters at 50 pm to get talking points out to them on how "Bush had 80 of recess appointments while the constitutional genius, Obama, only had 40. Bret made it clear to the rather dense A.B. ___ that Bush´s actions were during true recesses.
