| The D.C. Circuit Court of Appeals ruled Friday that President Obama´s January 2012 recess appointments to the National Labor Relations Board were unconstitutional and invalid. Bloomberg reports: The U.S. Court of Appeals in Washington in a unanimous ruling today sided with Republican lawmakers and a canning company that challenged the appointments. The judges said the definition of “the Recess” in the Constitution’s Recess Appointments Clause is limited to the period between one Congress and the next, and that Congress had begun a new session at the time the president made the appointments.

It´s a start. Not much more than that--Obie tends to ignore many federal court orders, such as the court order that Interior Department issue oil and gas drilling permits in the Gulf of Mexico to those applicants who have proven that they satisfy all the statutory and regulatory requirements.
This will immediately be appealed to the Supremes. It would be good to see SCOTUS uphold the DC Circuit and smack Obie down on at least one of his willful violations of the separation of powers. His flagrant issuing of Executive Orders where Congress doesn´t immediately pass legislation for everything he wants should likewise be appealed.

This is a true waste of money to appeal. They had to think that if a Dem Justice got the case they might possibly win. Since that didn´t happen and the correct law has been cited, there is virtually no chance of winning. My guess is he´ll wait a year or so when he wants an appointment which is currently being blocked and then strike when the bulk of the Senate is on vacation. Then it will have to go all the way through court again.

What part of the ruling UNconstitutional don´t you understand that you continue the same old same old waaah what´s the difference? The difference is the little dictator has been handed his backside for a change. The ruling left only ONE time the president can legally make a recess appointment. That is when the entire congress is no longer viable at the end of a year awaiting the swearing in of a new Congress. Who knows how the Supreme court will rule if they even agree to hear a the case. Until then ILLEGAL stands.

Dead Ted Kennedy was especially nasty to Estrada. Remember Kennedy´s disdain when he questioned estrada about estrada´s parents, and how kennedy sneered that estrada´s parents were successful?

After Judge Bork no two justice nominees have ever been treated as shamefully as Miguel Estrada and Charles Pickering. It´s good to see him get some revenge.

Multitasking, job-hopping Chelsea Clinton has quietly taken on a big new job at New York University. The former first daughter has tackled what the school calls a “multifaith” role as co-founder and co-chair of its brand-new Of Many Institute. WASHINGTON – The Internal Revenue Serviced scandal today spread further within the White House and closer to President Obama. White House spokesman Jay Carney today disclosed that Obama’s chief of staff, Dennis McDonough, and other top White House officials had advance warning that the IRS was targeting conservative groups. Stuart Varney said this morning on "Varney & Co." that one of his producers was given a questionnaire with some surprisingly intrusive questions on it when he switched doctors. One of the questions was whether he/she was concerned about unsecured weapons in the home. Another asked whether he/she was "in a relationship in which you have been physically hurt or are you afraid of your partner?"
