| Ted Cruz may have the aura of a future presidential contender, but is he even eligible to run? The newly sworn-in Texas senator and rising Republican star was born in Canada, to a mother who was born in Delaware and Cuban father. That’s triggered a debate about whether he’s eligible for the nation’s highest office — nevermind that he’s been in Congress less than a week. While there’s no legal precedent for Cruz’s situation, most constitutional scholars surveyed by POLITICO believe the 42-year-old tea party sensation would be OK. Any member of a minority group (or majority, in the case of women), who is also Republican, is obviously a fraud in some way, therefore prima facie illegitimate for any elected office. I thought we´d all learned that by now.

It took me only seconds to locate this opinion from a Congressional Research Service The weight of legal and historical authority indicates that the term "natural born" citizen would mean a person who is entitled to U.S. citizenship "by birth" or "at birth", either by being born "in" the United States and under its jurisdiction, even those born to alien parents; by being born abroad to U.S. citizen-parents; or by being born in other situations meeting legal requirements for U.S. citizenship "at birth".

IMHO, Ted Cruz is too strong a believer in the Constitution to even consider a run. He´s also smart enough not to voice the reasons and reduce the chances of some of the other potential candidates. I look to him to be a far more conservative Senator than Kay Bailey Hutchison.

Even though consideration of Cruz as a presidential candidate at this time is silly and premature, it is ironic that Politico would be concerned about his eligibility. They were never concerned about Obama´s lack of eligibility.
I guess if he wants to run, Cruz will just have to get the same Adobe software that Obama used to generate his certified birth certificate.

The requirements for the office of President were established by the Constitutional Convention -- not by "the [later] weight of legal and historical authority...."
That´s how it works.
[Do I have to point out George Washington´s admonition, that "The Constitution, as it at any time exists, is sacredly obligatory on all, until changed by an authentic act of the people"? Pretty close paraphrase. And dead-on fact. And it doesn´t say anything about the [guffaw] "weight of legal and historical authority."]
The Framers started with the definition from Emmerich de Vattel´s [who?] "The Law of Nations" {what?]. The Framers debated and revised to definition to suit our circumstances. Madison [IIRC] discussed the details. There were four copies of "The Law of Nations" in the hands of the Constitutional Convention delegates, as well as Benjamin Franklin´s own personal copy, which he acquired in 1775. And how much of the above does the average poster know?
So. Still wanna debate NBC anyone?

You are wrong, #23. The Supreme Court is the final authority on what the Constitution means. There is no authority--none--that says someone with one citizen parent is not natural born. And there is a lot of authority that says the contrary. Such a person is not required to be naturalized and is issued a passport and all the privileges of citizenship on showing that his or her mother (or father) is a US citizen.

On “Fox News Sunday” last weekend, White House aide Dan Pfeiffer was asked about President Barack Obama’s whereabouts the night of the Sept. 11 attack in Benghazi.
