Can Kansas make a sperm
donor cough up child support?

There’s a rather strange case brewing out in Kansas right now involving a man being sued by the state for child support. That, in and of itself, is sadly not all that unusual in modern society, but this one has a twist. The guy was a sperm donor. But that’s not the only twist in an increasingly complicated tale. If you’re planning to donate sperm in Kansas, you may want to do it through a doctor. That’s one message from the case of William Marotta of Topeka.

Comments:
I have zero sympathy for the guy.

Read the article before criticizing him. Ignorance is ruining our country.

The only question that comes to my mind is ´Was he compensated?´ If he received a monetary payment, preferably in the form of a check, it would bolster his argument. As for the article´s fixation upon the lack of legal representation, providing that the terms were not onerous to either party, that seems a bit of a stretch. Finally, if the state wants to stretch the bonds of credulity to the extreme and argue that Mr. Marotta was committing an act of prostitution, well stand- by for the arrival of the circus.

With regards to the authors final argument concerning the potential for dead-beats to claim that they were only ´donating´, we already have this situation now.

Why not produce children the way the good Lord intended us to produce them? Sounds quaint and backward these days?

A simple contract written by a lawyer for $200 would have alleviated this problem.

#2, I´ve read the article. He should never have donated sperm to a couple of lesbians. Children need a father and not a make believe family.

Reply 7 - Posted by: Fosterdad, 1/7/2013 8:17:21 AM     (No. 9102746)

If you´re going to make this guy pay child support, then I should be able to get child support from my adopted daughter´s biological father. Yes, he gave up his parental rights, but so did this guy. What´s the difference?

The state is pursuing him for child support because one of the lesbian mothers, now single, sought welfare payments from the state. I´m surprised the former lesbian partner hasn´t provided monetary support for the child she and her partner had. /s

Either this dude is on the hook, or the taxpayer is.

Reply 9 - Posted by: rocket-j-squirrel, 1/7/2013 8:41:05 AM     (No. 9102791)

The difference, #7, is that you did the adoption legally. The courts never recognized the private agreement between the hapless father and the lesbos. Which also brings up an equally interesting question. If a baby momma can´t name who the baby daddy, is she entitled to welfare?

I hope his view stands up in court, and he avoids this stiff penalty.

a man and a woman enter into an agreement in good faith, but since a lawyer was not involved, the state decides their agreement was invalid. guess who is held to have complete financial responsibility?

Reply 12 - Posted by: skedaddle, 1/7/2013 9:01:06 AM     (No. 9102839)

Seems to me that if the state wants the sperm donor to pay child support then he should have the option of paying or taking custody of the child, especially since the 2 "moms" can´t seem to take take of the child.

The problem isn´t the contract, it´s the lack of a disinterested witness to that contract. Had they either hired a lawyer or used a physician a third party would have a contemporaneous record of the agreement.

He should not have donated sperm to this weird twosome. That does not excuse the evil and greed of these two women.

I never thought all this donation stuff was a good idea to begin with. I understand the desire to have children but if you can´t do it the regular way, then maybe you weren´t meant to.

Personally, I think he does owe support. He knew what he was doing. Next time, buddy, get it in writing if you don´t want the responsibility for your actions.

Make him pay.
He participated in creating a human being without ANY responsibility.
As to the baby mom getting welfare without naming the father- perhaps it is time to insist they name the daddy or NO welfare.
If some of these predator males have to pay they won´t be so anxious to spread their mediocre seed.
Also, judges can lock them up for non support and that will at least keep them off the street and prevent more baby mommas.
Harsh?
What is harsh is 70 percent illegitimacy rates in black community and 40 percent with whites.Time to stop this train wreck.
Why should taxpayer support ignorance and sloth?

I never quite, quite understood this concept of "signing away your responsibilities." Signing away your rights, yes, --- but your responsibilities correlate to somebody else´s rights, in this case, the child´s.

A child has a right to a whole constellation of natural goods from his or her parents: his identity, his name, his place in a kinship system, nurture, education, care, provision and inheritance. All of these begin with the first right: the right to a mother and father. You can´t sign away what your child needs to survive and flourish in this world.

If you don´t want to be a father, don´t put your sperm into a woman´s genital tract.

That´s simple enough, isn´t it?

I´ll vote for the child´s rights every time.

I read in another article last week on this same subject that said this couple has six or seven other children. If they are wanting support for all of them, you can understand why the state is putting it´s collective foot down. I don´t know the origins of the other children but possibly there will be other "fathers" taking part in the support of the offspring.

Disappointing to see Michelle´s old site refer to a father as merely a sperm donor.

Eric Holder versus journalism

Attorney General Eric Holder personally signed off on the warrant naming Fox News journalist James Rosen a “possible co-conspirator” in violation of the Espionage Act, Michael Isikoff reported yesterday. Which is sort of awkward, because Barack Obama also yesterday told the country (the whole country) that he didn’t want to criminalize reporting, and that he was going to ask his Justice Department to make sure not to do that anymore. Rosen wasn’t charged. In truth, the government never really intended on charging him. (Snip)That’s the scandal: That the government could charge a journalist with, effectively, spying, simply for reporting.

Of all the scandals in his administration that President Obama knows nothing about, the one Americans find most appalling is the decision by the Internal Revenue Service to target the president’s political adversaries. What’s more, as subsequent congressional testimony has made clear, the IRS isn’t particularly repentant about its actions. One thing Republicans and Democrats should therefore be able to agree on is that this is no time to significantly expand the IRS’s power. Yet that is exactly what will happen under Obamacare if no action is taken. A simple proposal: Remove the IRS from any role

Rookie Florida Senator Marco Rubio continues to work tirelessly to get the United States to annex Mexico, though an exhaustive (and exhausting) search of his 2010 election campaign reveals no promises to do, nor even a mention that he might consider doing such an outlandish thing. Au the contraire, the pre-election Rubio said all the right things about line-cutters and lawbreakers. That’s one of the reasons he’s a senator today. There are only two sure consequences of the current 800-page immigration hairball before Congress. The first is that a minimum of 11 million citizens of other countries, more Mexicans

President Obama dreamily wants

President Obama declared on Thursday that it’s time for the U.S. to leave behind the global war on terror. He might first try convincing America’s war-waging global enemies to do the same. Almost a dozen years after 9/11, the President wishfully hopes to demilitarize national security in the age of Islamist radicalism. He judges the country ready for such a step because a long fight has markedly degraded the attacking capacities of Al Qaeda and affiliates. Even so, Obama dared not utter the word victory in his address at the National Defense University, because plainly the hostiles are still coming

In a strange true-life story that seems ripped from TV crime drama (rather than the other way around), a New York City man was kidnapped and held for ransom for over a month, before the NYPD rescued him this week. Pedro Portugal was grabbed off the street in broad daylight on April 18, and held hostage in a Queens warehouse (pictured above) while a group of men attempted to extract a $3 million ransom from his family in Ecuador. Police in both countries (with the help of the State Department) tracked down the kidnappers,

WASHINGTON —In a dramatic departure from existing White House procedures, President Obama requested today that his staff start cc’ing him on stuff. “Look, I know a lot of you think I’m really busy and you don’t want to bother me,” the President reportedly told his staff in an Oval Office meeting. “But cc me anyway. It’s good for me to keep up on what’s going on around here.” “It’s not good when I turn on the news and they’re talking about something at the White House and I’m like, whoa, when did that happen?”

Amid catcalls from a Leftist heckler too blitheringly stupid to understand her dream was coming true, President Obama yesterday declared his intention to end the War on Terror — not quite 12 years since the 9/11 attacks. In what may have been the most important speech of his presidency, Obama said he would ask Congress to join him in efforts to “refine, and ultimately repeal,” the Authorization to Use Military Force passed three days after 9/11. In other words, he intends to write the War on Terror out of US law. “This war, like all wars, must end,” he said.

When you get right down to it, the political targeting and stalling of tax-exempt applications by the IRS was an effort to defund the Tea Party. Rick Santelli, one of the Tea Party founders and my CNBC colleague, was the first to make this point. I’ve taken it a step further: The IRS was taking the Tea Party out of play for the 2012 election, as it looked to avoid a repeat of 2010 and another Tea Party landslide. There are a lot of numbers out there.

Conservative radio host Mark Levin is very skeptical of the idea that President Obama had absolutely no idea about the IRS tea party targeting before the story broke in the news mere weeks ago. Levin declared adamantly that it is a “flat-out, bald-faced lie” that Obama didn’t know beforehand, citing prior reports by a few conservative news outlets picking up on the news well before the 2012 presidential election. Levin said, “I don’t believe for two seconds that Obama wasn’t aware of this.”

Nuland, a career foreign service officer who was until recently State´s top spokesperson, had long been expected to be nominated the post to replace Philip Gordon, who Obama picked to serve as Middle East coordinator for the National Security Council. On “Fox News Sunday” last weekend, White House aide Dan Pfeiffer was asked about President Barack Obama’s whereabouts the night of the Sept. 11 attack in Benghazi. This was the night when we lost our first ambassador in 30 years, and when three other Americans were killed in an attack that lasted all night long at multiple locations within the eastern Libyan city. Since the president is commander in chief, one would think where he was and what he did during such an event would be of obvious public concern.
