ObamaCare´s subsidized insurance exchanges are supposed to be up and running in little more than a year, putting a key piece of the federal health care law into action. But it´s unclear that will happen, especially with a growing number of states saying they don´t want the cost and regulatory headaches. The exchanges are where consumers without employer-based coverage will shop for insurance under ObamaCare and receive a tax credit toward its purchase if they are eligible. But 21 states have expressly declined to set up their own exchanges, with nine others still undecided ahead of the Dec. 14 deadline.

I was surprised last night to hear a conservative view on TV.

A university professor from ASU said Governor Brewer´s decision to not set up a state exchange made sense. Setting up an exchange was buying a pig in a poke. You wouldn´t know what you were agreeing to.

The program was on PBS in Phoenix and the academics here usually worship Obama as much as academics elsewhere. And they bash Arizona state government whenever possible.

IF the exchanges blow up, let the Feds take the heat. If they can meet their own self inflicted deadlines. With this group, the question is, did they think the states would just rollover and do the exchanges, or do they really want the states to let them do it as part of their master plan? (yes, I´m paranoid).

What they did, was make a mistake. They either misjudged and thought every state would leap onto the bandwagon, or, made a legal oversight. Either way, states that don´t sign on don´t get the penalty or fine for people with no insurance. Particularly, no employer mandate.

Not hearing about this on the MSM are you? Not even Fox. Nope. Not while "Obama´s IRS" scrambles to attempt to rewrite the law to cover the loophole.

Smart states are staying out. Can´t invent law where there is none, can´t just change the law because you messed up, and perhaps Roberts was brilliant afterall. With no penalty, no state cooperation, no money. Dead ACA.

Just to clarify, in Mo., we, the people, voted in Nov. to ban state exchanges. In fact, the ban passed in EVERY county, including the three (yup, only 3 of 114) that had Obama majorities. Don´t know what Nixon would have done if left to his own devices. Who knows, he might have been relieved.

FTA: "The U.S. Department of Health and Human Services said last week it will impose a 3.5% fee on insurance plans sold via federally run exchanges. This lets HHS sidestep ObamaCare´s lack of any funding for federal exchanges."

They have absolutely no authority to do that! If congress and the courts let this stand then any federal agency can just impose "fees" (i.e. create new taxes) on products whenever they want more funding. In that scenario the budgets, congress and the constitition are meaningless.

Abuse Of Power: Any scandal investigation that expects a "Eureka!" moment, a White House e-mail, or Oval Office smoking gun will be misguided. In fact, the dots are already connected directly to the president. Barack Obama is not foolish enough to have a tape recording system hidden in his desk. And his administration staff are not careless enough to send one another incriminating e-mails. If the president was behind the IRS unlawfully harassing conservative groups seeking tax-exempt status, we can be sure the communications were all sotto voce and in persona, like any good Chicago political operator.
