| Hostess Brands Inc. agreed in court on Monday to enter private mediation with its lenders and leaders of a striking union to try to avert the liquidation of the maker of Twinkies snack cakes and Wonder Bread. Hostess, its lenders and the Bakery, Confectionery, Tobacco Workers and Grain Millers International Union (BCTGM), agreed to mediation at the urging of Bankruptcy Judge Robert Drain of the Southern District of New York, who preferred it to the more expensive, public hearing regarding the company´s liquidation. "My desire to do this is prompted primarily by the potential loss of over 18,000 jobs

Union concerned that the company´s plan would improperly cut the ability of remaining workers to use sick days and vacation.
Take the rest of your lives off on sick days & vacation.

Easy solution, just hire enough extra workers to vote the union out.

On one hand I´d like to see those jobs saved. I hate to see so many families and communities hurt. On the other negotiating with the BCTGM is like negotiating with Hamas.
What´s wrong with bonuses to company insiders. If they´ve been long time, loyal workers they´ve earned it.

I don´t think Hostess blinked - when a judge "suggests" that you pursue mediation I don´t think it´s much of a choice - it´s nonbinding; Hostess had already let the unions know that it is willing to shut down and can go back to that position any time after working through the mediation; and the unions have 13000 non-union people screaming about job loss, as they should. So I think Hostess has more leverage here, though I suspect that it will still end up liquidating because the unions are too into claiming victory by ending the company.

At the end of the day - if they can´t reach a deal, the company will still close. When you are in Chapter 11 you are required to pay your expenses going forward. If they aren´t profitable, investors will no longer provide financing and then they will have no more choices. This is a last ditch effort by the Bankruptcy Judge to help the parties come together. There is a tremendous amount of negotiating in Chapter 11 cases. There will be more concessions. If the Union isn´t willing to accept more then the company will not be operating at a profit and they will close or they will drastically scale back their production and jobs will be lost either way.

If they have a buyer in Mexico then they don´t even have to explore any compromise. Bimbo is an apt name for the new company.

The Teemsters claim they ran the money numbers and the manufacturer was correct....no money, struggling to survive, the workers shouldn´t strike. AFL-cio claimed malarky and struck. The bankruptcy judge must have found a few drops of blood in the corpse of hostess and is attempting to give that to the union. Sad day for America.

Tiger Woods and Sergio Garcia can finally agree on something. "He called me a whiner. He´s probably right," Garcia told Golf.com on Monday at the start of the week of the BMW PGA Championship in England. "But that´s also probably the first thing he´s told you guys that´s true in 15 years. I know what he´s like. You guys are finding out." On the same day that Tiger Woods uttered one word -- "No" -- to quickly dismiss the possibility of making amends over the pair´s verbal sparring during the Players Championship, the Spaniard kept swinging at

A federal court in San Francisco Tuesday struck down Arizona´s ban on abortions after 20 weeks of pregnancy. The 9th U.S. Circuit Court of Appeals ruled that the law violates a string of U.S. Supreme Court rulings starting with Roe v. Wade that guarantees a woman´s right to an abortion before a fetus is able to survive outside the womb. That´s generally considered to be about 24 weeks. Normal pregnancies run about 40 weeks. Several states have enacted similar bans starting at 20 weeks. But the 9th Circuit´s ruling is binding only in the nine Western states

CBS News has a piece quietly mocking a Benghazi whistleblower for writing poetry in a classic example of how the MSM marginalizes opponents of Barack Obama: Raymond Maxwell, who was one of Hillary Clinton’s State Department officials who was disciplined for security lapses vis-à-vis Benghazi, has been writing poetry since he was put on leave. Significantly, some of the poetry deals with Maxwell’s frustration at being made a scapegoat: The web of lies they weave / gets tighter and tighter / in its deceit / until it bottoms out - / at a very low frequency - / and implodes...

President Obama and his allies in the House and Senate may have failed in their attempt to channel shock and anger over Newtown into passing strict new gun control legislation, but it wasn´t for lack of trying. The quick pivot from tragedy to legislation is just another indication that one party has a knack for legislating while the other spends most of its time saying no, or offering watered down versions of its opponents´ legislation. That seeming inability to quickly connect moments of national outrage with meaningful legislation on the part of Republicans will be on display

Treasury Secretary Jack Lew was told about a government watchdog´s investigation of the Internal Revenue Service in mid-March but did not learn the full extent of its findings until they were released earlier this month. Lew told the Senate Banking Committee on Tuesday that he first learned about the possible problems during a "getting to know you" meeting with the Treasury´s inspector general for tax administration, J. Russell George, on March 15. At that meeting, George ran down a number of items for Lew, including the potential for "troubling findings" in regards to the agency´s handling of tax-exempt applications

On the heels of news that the Obama administration Department of Justice was spying on reporters at the Associated Press, Monday brought the startling disclosure by the Washington Post that the DOJ had also targeted Fox reporter James Rosen for surveillance in an effort to plug up leaks. Additionally, the New Yorker’s Ryan Lizza obtained the full application for a search warrant of Rosen’s personal email account, in which the DOJ accused him of being “an aider and abettor and/or co-conspirator.” As Lizza put it, “Rosen was not charged with any crime, but it is unprecedented for the government,

WASHINGTON – The Internal Revenue Serviced scandal today spread further within the White House and closer to President Obama. White House spokesman Jay Carney today disclosed that Obama’s chief of staff, Dennis McDonough, and other top White House officials had advance warning that the IRS was targeting conservative groups. But he insisted McDonough and the other White House officials purposely kept Obama out of the loop.McDonough “rightly chose not to take action” to inform Obama, Carney told reporters at the daily White House briefing.

The Washington Post on Monday reported that Obama’s Department of Justice was investigating journalists before they started wiretapping the Associated Press – for one, Fox News correspondent James Rosen in 2010. Their headline wasn´t "Obama Team Also Spied on Fox News." Fox wasn´t in the headline, on A-1 or on A-12, where the story continued. Newly obtained court documents “reveal how deeply investigators explored the private communications of a working journalist — and raise the question of how often journalists have been investigated as closely as Rosen was in 2010.” Reporter Ann Marimow began:

A senior adviser to President Obama mounted a combative defense of the administration on Sunday, saying the controversies enveloping the White House were the result of Republican lawmakers’ trying to “drag Washington into a swamp of partisan fishing expeditions, trumped-up hearings and false allegations.”The remarks came from Dan Pfeiffer, a member of the president’s inner circle, as he appeared on all five major Sunday morning talk shows in an effort to move the administration past what commentators have described as a “hell week” of controversy and missteps.

Stuart Varney said this morning on "Varney & Co." that one of his producers was given a questionnaire with some surprisingly intrusive questions on it when he switched doctors. One of the questions was whether he/she was concerned about unsecured weapons in the home. Another asked whether he/she was "in a relationship in which you have been physically hurt or are you afraid of your partner?" Judge Andrew Napolitano explained that the question about guns comes out of a post-Sandy Hook executive order by President Obama, but it will be required under Obamacare. Varney expressed amazement

While many Americans were tuned into news coverage of the massive damage from tornadoes ravaging the state of Oklahoma, Rhode Island Democratic Sen. Sheldon Whitehouse took to the Senate floor to rail against his Republican colleagues for denying the theory of anthropogenic global warming. Whitehouse spent 15 minutes chastising GOP senators and justified his remarks by alluding to states that seek federal assistance in the wake of natural disasters. “So, you may have a question for me,” Whitehouse said. “Why do you care? Why do you, Sheldon Whitehouse, Democrat of Rhode Island, care
